having me well I wanted to talk to you

about uh Israel's Natural Gas gas uh
00:00:31
situation and the and the tremendous
00:00:33
find of of natural gas uh what impact do
00:00:36
you think it's going to have on the
00:00:38
overall geopolitical situation with
00:00:41
Israel I just recently spoke in a panel
00:00:44
where that was the question that was
00:00:45
asked you know as the great discovery of
00:00:47
gas in the Mediterranean something
00:00:49
that's going to be something that's
00:00:51
going to increase the tensions or could
00:00:53
it be really a you know impetus for
00:00:55
peace and for bringing countries
00:00:57
together and sort of in the Israeli
00:00:59
experience that at least um recent years
00:01:02
we've sort of seen the ladder that we've
00:01:04
seen the gas sort of be something that
00:01:07
allows us to sort of move aside from
00:01:09
traditional conflict related issues and
00:01:12
sort of move into more positive areas um
00:01:15
for example I was part of the legal team
00:01:17
where we um we wrote a delimitation
00:01:20
agreement our Mar to Define our Maritime
00:01:22
borders with Cyprus the country that
00:01:24
sits across from us and we were a little
00:01:26
bit late in the game actually Egypt had
00:01:28
already signed an agreement which went
00:01:30
into force in 2004 Lebanon had signed a
00:01:33
similar agreement in
00:01:34
2007 and and in 2010 we were Fally able
00:01:39
um to sign an agreement which entered
00:01:42
into force in February
00:01:44
2011 so now we're actually in the next
00:01:47
stage in stage two which is entering
00:01:49
into what's called a framework
00:01:51
unitization agreement unitization from
00:01:53
the word unit that there's a developing
00:01:56
International practice um where you have
00:02:00
if you have a transboundary reservoir
00:02:02
the ideally to maximize both profits um
00:02:05
to maximize from a technological point
00:02:07
of view the best way to do it is that
00:02:09
the both countries come together and
00:02:11
then the private lienes will develop
00:02:13
together so I would like to hope that
00:02:17
definitely the discovery of gas will
00:02:19
will lead to a positive direction for
00:02:21
for not not just between Israel and
00:02:23
Cypress but between all the players in
00:02:25
the in the region so let let's focus on
00:02:28
the on the Cypress issue can you
00:02:31
describe what the main legal issues are
00:02:33
regarding the Israeli cypriate gas are
00:02:36
there any issues regarding the border of
00:02:38
the two countries economic zones so in
00:02:41
our case with Cyprus we're in a good
00:02:43
situation because like I said in 201 our
00:02:46
agreement on delimitation of what's
00:02:48
called our exclusive economic zone which
00:02:50
is the maritime zones that are usually
00:02:53
under international law up to 200
00:02:55
nautical miles but in the case of Israel
00:02:57
and Cyprus we actually have less than
00:02:59
200 nautical miles between the two
00:03:00
countries we're talking about something
00:03:02
like 180 nautical miles roughly
00:03:04
depending on where you measure so we had
00:03:06
to enter because of the overlapping
00:03:08
areas we had to enter into a
00:03:09
delimitation agreement now in that
00:03:12
situation we already know where where
00:03:15
Cypress is and where Israel is and that
00:03:16
makes things a lot easier so now the
00:03:20
next question is what happens when you
00:03:22
have a reservoir that goes that sort of
00:03:24
sits on both sides of that line and like
00:03:27
I said unitization is the usual way that
00:03:30
countries will handle that so we're in a
00:03:33
good place with Cyprus in terms of
00:03:35
knowing exactly where they are and we we
00:03:37
are now if you have reservoirs and there
00:03:39
on the Israeli side we've discovered
00:03:41
quite a few reservoirs there are some
00:03:43
very significant finds like the Tamar
00:03:45
field and the Leviathan field which are
00:03:47
entirely in are Israel's Maritime areas
00:03:50
and once you have a defined line and
00:03:53
those we know now for sure that those
00:03:55
areas are nowhere near the cypriate
00:03:58
border then we can go ahead and develop
00:04:00
them um
00:04:02
independently um when we're talking
00:04:04
about areas that are on both sides then
00:04:07
we have to work with our neighbors now
00:04:10
we know that there's definitely one um
00:04:12
transboundary Reservoir the Aphrodite
00:04:14
field on Israel side it's the isai
00:04:17
license sometimes it's called block 12
00:04:19
we know of of one and that that is a
00:04:22
estimated to be around um 7cf in terms
00:04:25
of its potential um the cyat have
00:04:28
already started exploratory Drilling and
00:04:31
Israel is is to begin it was just
00:04:33
reported in the paper in about another
00:04:35
month or so exploratory drilling on its
00:04:37
end we're also moving along to sort of
00:04:40
finalize the framework unitization
00:04:42
agreement now that agreement it's it's
00:04:44
sort of a two level two-layered
00:04:47
agreement that you have the framework
00:04:48
agreement between the governments which
00:04:50
set forth on the macro level the rules
00:04:53
um that the lies sort of have to play by
00:04:55
in order to develop the field and then
00:04:56
the lenses will have to um abide by
00:05:00
those rules and develop together
00:05:02
hopefully um the
00:05:04
transboundary uh Reservoir which will be
00:05:06
to the benefit of both sides do you
00:05:09
expect uh Israel and Cyprus to
00:05:11
collaborate in developing infrastructure
00:05:13
for the export of natural gas these are
00:05:16
issues that are definitely on the table
00:05:18
there's a number of issues and gas
00:05:20
related um issues that are on the table
00:05:23
including possibility of cypriate
00:05:25
purchase of Israeli gas as well um
00:05:28
Cyprus is in a sort of there's a number
00:05:31
of issues sort of that are before um the
00:05:34
cypriots beyond the political issues on
00:05:37
on the island with you know the the tur
00:05:39
Turkish the situation with with the
00:05:40
North and then the occupation there um
00:05:44
but there are a number of issues
00:05:45
including that it Cypress finds itself
00:05:47
right now in an energy crisis they had a
00:05:49
major explosion in one of their power
00:05:50
plants about a year ago last summer um
00:05:54
and so they're really looking for
00:05:55
different options and and the whole
00:05:57
option of cooperation with Israel is
00:05:59
quite appealing
00:06:00
um they also you know with the greater
00:06:02
picture of what's going on in Europe and
00:06:05
and what's going on in Greece it's it's
00:06:06
sort of you know there's always the fear
00:06:08
that that could sort of bubble over
00:06:10
because there's a linkage between
00:06:12
cyprius and Greek banks that that could
00:06:14
bubble over into Cypress so there's a
00:06:16
real um you know desire to to sort of
00:06:19
work forward positively and and address
00:06:23
these issues um before something
00:06:25
negative happens and I think that's a
00:06:27
positive in terms of the the inter
00:06:29
dyamics um for how sort of allowing for
00:06:34
cooperation Paving Paving the way for
00:06:36
cooperation between the actors that
00:06:38
maybe something that you know issues
00:06:39
that are less positive can in the end
00:06:41
sort of lead to more a more positive um
00:06:44
situation between us so under the
00:06:46
agreement if Cyprus and Israel do
00:06:48
collaborate on infrastructure do you
00:06:50
think this is likely to take the form of
00:06:53
a pipeline being developed for Europe or
00:06:55
do you think it might be uh a liquefied
00:06:58
natural gas plant being set up somewhere
00:07:00
in Cyprus and if so where might that be
00:07:02
located uh nothing's been decided for
00:07:06
sure and definitely there are a number
00:07:07
of options and you've mentioned two of
00:07:09
them one is the option of the pipeline
00:07:12
um one is the option of of you know
00:07:14
plant of of to liquefy in Cyprus another
00:07:17
option is maybe floating um liquefied
00:07:20
you know to do that in the water of of
00:07:22
liquefying glass in the water and a lot
00:07:24
of that just has to do with you know
00:07:27
what are the mark the markets that are
00:07:29
available in the needs and also you
00:07:31
can't ignore the sort of Greater
00:07:33
political
00:07:34
situation um laying down a pipeline
00:07:37
under International maritime law um on
00:07:40
the high seeds all all states have a
00:07:43
right to lay pipelines and also in
00:07:45
states different exclusive economic
00:07:47
zones meaning the areas beyond the
00:07:49
territorial Waters you also have a right
00:07:51
to lay pipelines even if it's not your
00:07:53
own exclusive economic zone um the one
00:07:56
thing is that also under international
00:07:58
law the coastal state if it's in their
00:08:00
exclusive economic zone um could object
00:08:03
to the path of the pipeline and this
00:08:07
could lead to possible objections um
00:08:10
given particularly turkey's ways in
00:08:13
there and turkey has a very different um
00:08:15
sort of non-traditional approach to
00:08:17
delineation issues in the Mediterranean
00:08:20
what's your view of turkey I mean do you
00:08:22
does Israel feel that it should U
00:08:25
involve itself in in in the in dealing
00:08:28
with turkey or the Cyprus issue or does
00:08:31
Israel take the view that this is
00:08:32
primarily something that the Turkish and
00:08:35
the uh separate government should
00:08:36
resolve among themselves I mean
00:08:39
certainly you know politics is a side of
00:08:41
economics and we and this has always
00:08:44
been something even in better times that
00:08:46
we've made clear to to the Turkish
00:08:48
government that Israel wants to advance
00:08:50
its its um vital economic interest in
00:08:54
the region and I think the same would go
00:08:55
for Turkey um you know overall we would
00:08:59
like to to see ideally it would be best
00:09:01
if if all the different actors in the
00:09:02
region were on board I mean that would
00:09:04
include our neighbors to the South it
00:09:06
would include our neighbors to the north
00:09:08
and you know we could maximize this
00:09:10
great find in the Mediterranean if
00:09:12
everyone sort of worked together um and
00:09:16
we're not going to weigh in on on
00:09:18
cypriate domestic issues just like we
00:09:20
wouldn't want them to weigh in on our
00:09:22
our own issues
00:09:23
I those are two separate things sure
00:09:26
that makes a lot of sense uh let's look
00:09:28
now at Lebanon I mean what's the status
00:09:30
of the economic um Zone boundary between
00:09:34
Israel and Lebanon so first of all like
00:09:37
I said at the beginning Cypress and
00:09:39
Lebanon um actually signed a an
00:09:42
agreement in 2007 um to delineate their
00:09:46
overlapping exclusive economic zones in
00:09:48
the Mediterranean like Israel there's
00:09:51
there there are not those if you had 400
00:09:53
nautical miles then everyone would get
00:09:55
their own 200 nautical mile Zone but we
00:09:58
have a very extreme overlap um Cyprus
00:10:01
has already ratified that agreement in
00:10:03
order for an agreement usually to go
00:10:05
into full force both sides need to
00:10:06
ratify it um and with Egypt and with
00:10:10
Israel our agreements have been fully
00:10:11
ratified on both sides and deposit in
00:10:13
the UN in in full force in the Lebanese
00:10:16
case although they signed it in 2007
00:10:19
which from a legal point of view once
00:10:20
you already sign an agreement an
00:10:22
international treaty you're bound by the
00:10:24
terms of that treaty um Lebanon has not
00:10:28
ratified that agreement Cyprus has so
00:10:31
now you have a situation where they have
00:10:33
a delimitation but they're still waiting
00:10:34
for the Lebanese delimitation now in
00:10:39
interestingly perhaps curiously um in
00:10:44
2010 um Lebanon went ahead with a couple
00:10:47
of unilateral moves at the UN now
00:10:50
generally speaking if you look at the UN
00:10:52
Convention of the law of the sea which
00:10:54
is sort of the Bible of peacetime
00:10:55
maritime law and get sets out all the
00:10:57
rules of how to delineate the different
00:10:58
marit time zones um the the relevant
00:11:01
Provisions call for states to work
00:11:03
together and try to reach an agreement
00:11:05
that would be ideal or if they can't
00:11:07
reach an agreement at least try to reach
00:11:08
provisional Arrangements but certainly
00:11:10
if there's some sort of disputed
00:11:12
Maritime claims to talk to one another
00:11:15
now in the case of Lebanon um Lebanon
00:11:17
doesn't recognize Israel and so instead
00:11:20
of sort of turning to Israel and
00:11:21
discussing Maritime issues it went ahead
00:11:24
to the UN in 2010 and and um deposited a
00:11:28
series of unil Al positions um the first
00:11:31
unilateral
00:11:33
position set what Lebanon sees as its
00:11:36
delimitation with Israel um sort of
00:11:39
between Israel and Lebanon um the line
00:11:42
that runs East West between it from
00:11:45
Lebanese perspective I won't call it a
00:11:47
border because under international law a
00:11:49
border is something that is agreed by
00:11:51
both States um it then went ahead and
00:11:54
did a second unilateral position which
00:11:56
is that it took the line that it agreed
00:11:58
with Cypress in 2007 and amended it and
00:12:03
I say amended in quotations because to
00:12:05
amend it you usually need both sides and
00:12:06
under the terms of their agreement you
00:12:07
would need both sides to amend but you
00:12:10
pulled the line further south um
00:12:14
entering into what Israel believes is
00:12:17
its exclusive economic zone also
00:12:19
entering into the area that actually
00:12:21
Cypress and Israel divided um with
00:12:24
another so you have a situation um of
00:12:27
overlapping Maritime claims now under
00:12:30
international law usually when you're
00:12:33
getting to the point of trying to
00:12:34
delimit the maritime Zone you usually
00:12:36
start out with the
00:12:38
mathematical um approach of trying to
00:12:40
find out what the median Line is now
00:12:42
clearly this is not one single number
00:12:44
it's it's a complicated process where
00:12:46
you pick points on the coast and there
00:12:49
are there are definitely ways accepted
00:12:52
practice in C cartography under law of
00:12:55
how you pick those points in the in the
00:12:58
on the coast you pick points and you try
00:13:00
to reach a median line um that said if
00:13:04
you were to go to International court if
00:13:06
you were go to
00:13:07
arbitration um the you know the judge or
00:13:11
the the AR the the mediator might look
00:13:13
at some other special circumstances to
00:13:16
see if anything else should weigh in
00:13:17
when delineating the maritime border now
00:13:21
these special circumstances can be a
00:13:23
number of thing there's no Clos list it
00:13:24
could be um was there a historic
00:13:26
agreement between the parties in the
00:13:28
maritime Arena
00:13:29
it could be something like you know is
00:13:31
there a very odd Geographic situation
00:13:35
that you might have all sorts of rock
00:13:36
rock formations and how does that weigh
00:13:38
in does the mathematical approach
00:13:41
perhaps create total disproportionality
00:13:43
in terms of who's getting what again a
00:13:46
number of things now one of the things
00:13:47
we've seen in case law that that also
00:13:50
weighs in um was you know when the
00:13:52
question of particularly in gas practice
00:13:55
and oil practice you know would that
00:13:57
influence the maritime Del delineation
00:13:59
we actually have case law that says no
00:14:01
that wouldn't influence the situation
00:14:03
unless there was either explicit or
00:14:06
tacit
00:14:07
acquiescence now in the case of Lebanon
00:14:09
in their unilateral positions from
00:14:11
2010 um we see those positions as being
00:14:15
problematic Israel we see those position
00:14:17
being problematic um from both a legal
00:14:20
and cartographic point of view in terms
00:14:21
of how we see the proper way of
00:14:24
delineating the maritime what should be
00:14:26
the border between Israel and Lebanon
00:14:28
and so in order to prevent tacid
00:14:30
acquiescence so that if we would ever
00:14:32
get to a case where we were trying to
00:14:34
resolve our situation we felt it was
00:14:37
important in July in July
00:14:40
2011 um to submit our pursuing to a
00:14:44
government decision our version of what
00:14:46
we think the maritime delimitation
00:14:48
should be between Israel and Lebanon and
00:14:50
this created a sort of a triangle of a
00:14:54
disputed area we'll say that Israel this
00:14:56
is not unique and this actually doesn't
00:14:58
have to do with with the politics of the
00:14:59
Middle East there are loads of areas
00:15:01
throughout the world um where there are
00:15:04
ongoing and sometimes quite
00:15:07
controversial Maritime disputes I me if
00:15:09
you take a look in the I you're you're
00:15:11
an economic journalist I'm sure you know
00:15:13
about all the disputes going on between
00:15:15
China and Japan this the the the the
00:15:19
South China Sea area um Korea ways in
00:15:24
there too there's a lot of many many
00:15:27
Maritime disputes if you go into the
00:15:30
website of the international court of
00:15:31
justice see just how many Maritime
00:15:33
border disputes they've they've been
00:15:35
involved in you go in the permanent
00:15:36
Court of arbitration they've been
00:15:37
involved in a number the um there was a
00:15:40
there's a chamber that was set up under
00:15:41
the UN Convention of the law of the sea
00:15:44
they just had their for first ruling
00:15:46
between Myanmar and Bangladesh this is
00:15:48
not something unique um that said what
00:15:52
is somewhat unusual is that you're
00:15:54
talking about particularly if you look
00:15:56
at lebanes submissions you know it's
00:15:59
difficult for them to even say the word
00:16:00
Israel they usually um will not even say
00:16:04
Israel by name and so the question is
00:16:06
how we're going to get to a resolution
00:16:08
in this area in our submission in
00:16:10
Israel's submission to the UN in 2011
00:16:13
where we gave our own version of where
00:16:15
we see the maritime border with Lebanon
00:16:18
we did emphasize however in our letter
00:16:20
to the Secretary General that we are
00:16:22
interested um in resolving this dispute
00:16:25
with all and and resolving all these
00:16:27
issues with our neighbors and this is
00:16:29
something that's very important we
00:16:30
really took the language of the UN
00:16:32
Convention of the law of the sea and we
00:16:34
tried to mirror the language about
00:16:36
trying to be positive and open to
00:16:38
dialogue that is if the dialogue is a
00:16:42
professional dialogue that is based on
00:16:44
legal principles an accepted cardgraphic
00:16:46
practice and doesn't tries to stay away
00:16:49
from politics there a way to solve these
00:16:51
problems in a purely technical kind of
00:16:54
way and and we would hope I think again
00:16:58
getting back to your question that that
00:16:59
would really lead us to a win-win
00:17:01
situation I mean there's a lot to be
00:17:02
gained on the Lebanese side there's a
00:17:04
lot to be gained on on the Israeli side
00:17:06
and so long and we saw this in our
00:17:08
experience with Cypress so long as you
00:17:10
have ambiguity you know even about just
00:17:12
a meter of where the border is supposed
00:17:14
to be investors won't come investors
00:17:16
will come when they know that they can
00:17:18
get you know definite coordinates of
00:17:21
where where each site is and and I think
00:17:23
that the Lebanese government knows that
00:17:25
as well uh let's turn on to Egypt
00:17:29
uh is the Israeli government getting
00:17:31
involved in the dispute between and the
00:17:34
government of Egypt or is the official
00:17:36
attitude that this is a commercial
00:17:38
dispute I I would say on that issue um
00:17:41
the latter that that particular issue um
00:17:45
is a private commercial um matter it's
00:17:47
being handled in private in private
00:17:50
channels it's it's a classic you know
00:17:53
contract's issue of uh you know material
00:17:55
breach of contract and and it's being
00:17:57
handled and in the way that any sort of
00:18:00
breach of contract would be handled and
00:18:02
does the Israeli government regard the
00:18:04
discontinuation of natural gas supplies
00:18:07
from Egypt as a diplomatic issue or and
00:18:10
a test of the new Egyptian government's
00:18:12
attitude towards the Egypt Israel priest
00:18:15
treaty and Egypt's commitment to it I me
00:18:18
I think that's going a bit far again I
00:18:20
think that this is a commercial issue
00:18:22
and it's and it's being handled between
00:18:23
commercial actors there I think to tie
00:18:26
it in with the peace treaty is is a
00:18:28
little bit sort of getting mixing apples
00:18:31
and oranges it's a stretch it's a
00:18:33
stretch I mean for for us it is very
00:18:35
important and and ha you know luckily
00:18:39
thus far the Egyptian government has
00:18:41
also said you know emphasized the
00:18:43
importance of of maintaining um the
00:18:46
peace treaty between Israel and Egypt
00:18:48
this has been something that's been a
00:18:49
wonderful thing um and so and we hope to
00:18:53
to maintain that and
00:18:56
so and you and you know who knows maybe
00:18:59
we'll have the opportunity for
00:19:01
cooperation on on our you know in the
00:19:04
maritime Arena maybe we'll you we've
00:19:06
been surprised they always said you know
00:19:08
in biblical you know literature that we
00:19:10
live in the land of milk and honey and
00:19:12
we're always asking where's the milk
00:19:13
where's the honey and here we've
00:19:15
discovered all of a sudden you know
00:19:17
everyone's kind of shocked by that and
00:19:19
so again you know talked about the
00:19:22
northern front maybe also on the
00:19:24
southern front this could be something
00:19:25
that could be positive well uh standing
00:19:28
now to the the Palestinian Authority
00:19:30
what's uh Israel's policy towards the
00:19:32
gas Fields found in a near the area of
00:19:35
the economic zone of the Palestinian
00:19:36
Authority there's the Mediterranean
00:19:39
coast of the Gaza Strip MH well and
00:19:42
first of all there's some ambiguity in
00:19:44
terms of the the legal status of the
00:19:46
maritime areas off the coast of Gaza
00:19:48
right now because the so far Hamas
00:19:52
controls strip it's Hamas that controls
00:19:55
it and not the Palestinian Authority now
00:19:57
in the in late '90s actually
00:19:59
um rights were granted um to to British
00:20:02
company British gas um in in in gas
00:20:06
Fields off the coast of the Gaza Strip
00:20:09
um actually from an Israeli point of
00:20:11
view we would like to see the
00:20:13
development of those gas Fields so long
00:20:15
as the proceeds don't fall into Kamas
00:20:18
hands we don't you know have any
00:20:20
objections to those rights being
00:20:22
exercised um and then you know as As you
00:20:25
move further north then there are there
00:20:27
there are fields that are being being
00:20:28
developed on the Israeli side that are
00:20:30
on on our South border but not across
00:20:33
from the Gaza Strip um there are other
00:20:36
issues that are involved in terms of
00:20:38
Maritime areas of the Gaza Strip but
00:20:39
that more has to do with not peacetime
00:20:41
law um Peace time maritime law but
00:20:44
rather laws of armed conflict and the
00:20:45
security situation and unfortunately in
00:20:48
recent years we've seen um the maritime
00:20:51
Arena which is really used for some 90
00:20:54
plus per of all all Transportation trade
00:20:57
in the world at some Point goes through
00:20:59
the sea and we've seen you know
00:21:01
otherwise innocent commercial shipping
00:21:04
being taken advantage of um to smuggle
00:21:06
in um weapons in into our areas into
00:21:10
terrorist groups um that are out for the
00:21:12
destruction of Israel and we saw um
00:21:15
about a year ago uh one ship Victoria
00:21:18
with 50 tons of weapons being smuggled
00:21:20
on it if you would have looked at the
00:21:22
crates I actually I saw the crates you
00:21:24
had um things like lentils and cotton on
00:21:28
the crat and and and the crew had no
00:21:30
idea but you know various actors figured
00:21:33
out a way to smuggle in quite Advanced
00:21:35
you know Atlanta sea ter weaponry and
00:21:38
you have other situ we had one boat that
00:21:40
was caught with 500 tons of Weaponry
00:21:42
just to give you an idea of what we're
00:21:44

Russia expressing interest and sort of

looking into what exactly uh are there
