crescendo of the brass man playing
00:00:40
which you know made me smile
00:00:43
my he was a fun friend always cracking
00:00:47

00:01:15
quiet just like like it is now and he

came in and he said well let's drop him
00:01:19
off and his girlfriends

00:03:05
it's good yeah
00:03:11
that's something that's in run weeks
00:03:14
I mean it doesn't look here but that's
00:03:16
that's a very very high ramp
00:03:19
he was he he was a dead and skateboard
00:03:22
that he had no fear whatsoever when it
00:03:24
came to Ryan
00:03:24
[Music]
00:03:31
my heat was a really talented
00:03:34
skateboarder and you could just tell
00:03:36
like his heart was in it and he just
00:03:38
loved it because he was here all the
00:03:40
time and it was really passionate about
00:03:42
it and he was doing stuff that I'd never
00:03:45
seen anybody else do especially at his
00:03:47
age
00:03:48

00:03:52
I like to keep myself fit but he wasn't
00:03:54
a poser I'd like to take his shirt off
00:03:56
in the summer because you just
00:03:58
skateboarded and he was practicing spot
00:04:00
so much he was so healthy and fit lovely
00:04:03
smile long brown hair as opposed to
00:04:06
where I've got he was just a handsome
00:04:09
very handsome young man
00:04:12
oh he's looking out for me giving me
00:04:15
advice telling me how to dress you know
00:04:19
always putting a little bit of money in
00:04:21
my pocket whenever he needs a day or
00:04:23
literally anything he was always there
00:04:25
he was that big brother that everybody
00:04:27
always ever wanted
00:04:28
[Music]
00:04:31
what I could see between my he and his
00:04:34
brother Josh my he was always there for
00:04:37
him caring for him making sure that he
00:04:39
was good but not only that might he was
00:04:41
obviously doing his own thing with his
00:04:43
own friends but he would allow Josh to
00:04:45
be included in that so he was a really
00:04:48
good older brother
00:04:51
we used to have play fights in the
00:04:53
living room as well made me have to tell
00:04:55
you what Amy moment I did sit there like
00:04:57
we were laughing in like a little
00:04:59
wrestling or Dina
00:05:00
I am being tall and these big kids and I
00:05:04
use this for 11 small small child it was
00:05:08
funny to watch
00:05:09
well we looked out of those and you
00:05:11
think these are all dreams and the
00:05:13
horizons that were never going to say it
00:05:16
could have been this it couldn't have
00:05:17
been there
00:05:18
they're not just what if it's weird
00:05:21
ripped away from you
00:05:23
[Music]
00:05:31
I remember the 6th of April first
00:05:34
because that was the day before Joshua's
00:05:37
birthday it just turned yeah 16th it was
00:05:40
a nice spring day
00:05:42
every morning you check on everybody
00:05:45
he's asking
00:05:47
he'd do what he needs us to do around
00:05:49
how she sort of watching dishes you'd
00:05:52
clean up for me mom
00:05:54
I want to have eaten once everything was
00:05:56
done I needed to do he'd go out and
00:05:59
enjoy his day with his friends
00:06:01
[Music]
00:06:10
it was actually running a bit late and
00:06:13
he came and he said well let's drop them
00:06:15
off and his girlfriends
00:06:17
let's get into about like around 11
00:06:19
o'clock and then around my heat popping
00:06:21
each other and he comes over to me and
00:06:22
says should I wear any clothes are
00:06:24
because I know you've been weird and
00:06:27
um
00:06:28
all defensive no no no I haven't no I
00:06:31
haven't known for well I have water's
00:06:33
clothes
00:06:35
I'm reluctantly agree but I was never
00:06:37
ever not gonna tell you if I'm just
00:06:39
tired wanting to go to bed so he went in
00:06:42
the kitchen to get some cans of coke and
00:06:44
saw the bits to sit up and watch some
00:06:46
movies or something when he got around
00:06:48
there
00:06:52
prompt them
00:06:54
so I kind of walked into the bathroom
00:06:57
which led into the kitchen doorway
00:07:00
and I said to Michael said to him
00:07:05
and I never got to finish the sentence
00:07:12
I was the loudest loudest loudest noise
00:07:14
I've ever heard
00:07:21
I'd seen these two big holes in the
00:07:23
window and follows me dodged into the
00:07:26
living room and me brother shouted get
00:07:29
down and I was lying I was Airline on
00:07:33
the floor in the living room
00:07:35
shocked
00:07:39
he didn't know what to do it was it was
00:07:42
horrible he was just Frozen
00:07:44
and he snapped out of it
00:07:47
you don't pass me and then Emily seconds
00:07:49
I'm thinking I'm okay
00:07:52
he's okay because he's running belong to
00:07:54
me we've just gone into the hallway
00:07:55
where we felt there was no windows and
00:07:58
we had to hold of each other we were
00:08:00
sort of like trying to protect each
00:08:01
other thinking nobody's got to hit but
00:08:03
okay
00:08:04
there's no blood
00:08:07
Michael said Dad
00:08:10
[Music]
00:08:15
and then each launched it just uh you
00:08:19
like it will be
00:08:22
[Music]
00:08:29
so that's the moment she realized
00:08:31
there's something seriously wrong
00:08:34
me and my dad we flipped around and we
00:08:37
lifted up as tough to see
00:08:39
we thought it was just one but there was
00:08:42
two and we've seen the one in his chest
00:08:43
and we did what I thought I'd I should
00:08:46
do and that was
00:08:48
cover the hull with a towel because I'd
00:08:53
seen that that's what you do and
00:08:55
it didn't work and
00:08:58
the noises it was it's it's a haunting
00:09:02
noise that I'll always remember
00:09:06
and I remember shouting to him come on
00:09:09
mate you're gonna be okay you're gonna
00:09:10
be okay I remember the color just
00:09:13
draining from his face
00:09:15
[Music]
00:09:17
I picked up the iPhone the first thing I
00:09:20
said was my brother's being shot
00:09:22
[Music]
00:09:26
okay
00:09:32
we don't know
00:09:34
myself
00:09:41
police received a telephone call from
00:09:43
Mikey's younger brother Josh
00:09:46
very distressing very you were a young
00:09:49
man who was fearful
00:09:51
you were a young man
00:09:52
[Music]
00:09:54
screaming begging his brother not to die
00:09:59
he had the presence of mind to tell the
00:10:02
call Tiger that he was fearful for his
00:10:06
and his family's safety
00:10:08
because he didn't know whether or not
00:10:11
his silence we're gonna return
00:10:15
we don't even know if we're safe we
00:10:18
don't know if we're safe are we here
00:10:20
right now
00:10:22
Michael became unresponsive I tried to
00:10:26
give CPR
00:10:31
and it was just I was I was doing the
00:10:33
best I could and he was kept on asking
00:10:35
was there people still there and then
00:10:37
there was a banging on the door
00:10:39
and I didn't know whether it was the
00:10:41
police or it was these people
00:10:45
he wanted to find more shots
00:10:46
[Music]
00:10:48
but it was the neighbors
00:10:51
and uh
00:10:52
[Music]
00:10:54
I couldn't see the faces on terrified
00:10:57
they were when they see what they saw
00:11:01
trying to keep myself alive screaming
00:11:04
trying to fall into the police audio
00:11:06
and then Michael just all of a sudden
00:11:08
made this noise
00:11:10
that allowed just
00:11:14
so much louder louder and louder and
00:11:18
lasted for about three seconds
00:11:19
[Music]
00:11:20
and it was me Sean uh not once it would
00:11:25
not want to leave us
00:11:27
yeah
00:11:29
and I looked at him
00:11:32
and he was scared
00:11:35
he was terrified
00:11:38
and he just his eyes all back
00:11:42
he just he died there
00:11:44
[Music]
00:11:53
[Music]
00:11:57
did you get any more present yeah yeah
00:12:00
what are you gonna get your mum
00:12:03
I was that's nice what are you gonna get
00:12:05
your dad
00:12:08
okay
00:12:09
instincts doesn't he
00:12:12
no okay
00:12:16
[Music]
00:12:22

00:12:24
murder happened late on April the 7th
00:12:27
and I think as crime report quite often
00:12:30
I'd be dialed into what's happening
00:12:31
pretty much 24 7. we knew that there'd
00:12:34
been a shooting that night and we knew
00:12:36
that somebody had been hurt
00:12:37
[Music]
00:12:38
it all happened so fast from the the
00:12:42
arms response came through the door
00:12:45
and they brought in a defibrillator
00:12:48
and
00:12:50
not even that was working
00:12:52
away in the ambulance still trying to
00:12:54
resourcitate them
00:12:57
we were watching from from the front
00:13:00
door I'm getting taken away you have to
00:13:03
put a sheet over them and we ended up
00:13:05
there for about 20 minutes
00:13:08
getting spoken to by these police
00:13:10
officers
00:13:12
um
00:13:13
they were reassuring and I was telling
00:13:14
us that there's a chance you might
00:13:16
survive but 20 minutes after
00:13:20
you got the call back on the radio to
00:13:22
say that he passed and me and he does
00:13:25
we just broke down
00:13:27
[Music]
00:13:29
all right
00:13:37
I remembered my phone going off quite
00:13:40
early in the morning it was the
00:13:42
protective superintendent and he
00:13:45
explained about we've had the death of a
00:13:48
young man before long I was in my car
00:13:50
driving to work
00:13:53
became aware that sadly it become a
00:13:55
murder investigation and after that
00:13:57
attention turns to two things for anyone
00:13:59
who's a victim and two what are the
00:14:02
circumstances have led to this scenario
00:14:05
based upon the nature of the shooting
00:14:08
coming outside of the home in through a
00:14:10
kitchen window they were looking outside
00:14:13
the home for shell casings for Witnesses
00:14:16
who may have seen cars or people coming
00:14:18
and going there's a lot less guns in the
00:14:21
United Kingdom compared to the United
00:14:23
States so looking at who may have a gun
00:14:26
how this gun could be moves throughout
00:14:28
the city
00:14:34
I started reading a little bit about the
00:14:37
deceased the first thing that stood out
00:14:40
was he was only a young man
00:14:42
you know reading from the intelligence
00:14:45
picture that we had started collating he
00:14:49
had his life ahead of him I found out
00:14:51
subsequently that Mikey was a keen
00:14:54
Sports person that he was a really good
00:14:56
skateboarder
00:15:01
me and my humor were
00:15:07
kind of helped me get comfortable in the
00:15:10
skate park and and introduced me to
00:15:13
other people and the friend group that
00:15:15
they all had here and then just started
00:15:18
to like help me skate and teach me teach
00:15:21
me all the stuff that he knew
00:15:23
he was on a skateboard first time we had
00:15:25
a video with him and he was actually
00:15:27
inside the building of this complex and
00:15:31
he fell off it and landed on the floor
00:15:33
and then that was sort of like the start
00:15:35
of you know his genius Escape board and
00:15:38
he never fell off a skateboard after
00:15:39
that
00:15:41
one of my favorite memories with my heat
00:15:43
was when he took me to Southport for the
00:15:46
first time and I haven't been there
00:15:47
before and my he was like wait for this
00:15:50
tram to come come past and then we'll go
00:15:53
behind it but I didn't know what he was
00:15:55
going to do and then this try and come
00:15:56
by and he's like quick grab onto it so
00:15:59
next thing we both graveled the Baha the
00:16:01
tram on our skateboards and this charms
00:16:03
pulling us down the track and we're just
00:16:05
laughing our heads off
00:16:08
foreign
00:16:12
[Music]
00:16:27
and it's not that far away from bootle
00:16:30
in the docklands and it predominantly
00:16:31
work in class people probably I am the
00:16:34
background that I came from as a working
00:16:36
class Lance
00:16:38
um
00:16:39
you aren't you level of criminality
00:16:41
weird hearts a couple of shootings
00:16:45
across the wide emergic side region and
00:16:48
neighboring Force area the thing that
00:16:51
became apparent to me
00:16:53
soon after and I think this was within
00:16:56
the first 24 hours so we're still in
00:16:58
that golden hour base is that there were
00:17:01
two Rivals factions that were operating
00:17:07
to having a shooting there isn't
00:17:09
necessarily a surprise but with Michael
00:17:10
being the target it was quite confusing
00:17:12
as to what the motive might have been
00:17:14
and why he might have been targeted
00:17:17
in this specific area there was a lot of
00:17:20
escalating gang activity there were
00:17:23
shootings going back and forth police
00:17:24
knew that this was the right age group
00:17:27
to be potentially gang involved they
00:17:30
were worried that there was some
00:17:31
involvement and so I'm sure the first
00:17:34
thing they were looking into is was Nike
00:17:36
involved in a gang did he have any
00:17:38
contacts was there something that led
00:17:40
this to occur or was he simply just the
00:17:43
victim of a tragic unpreventable
00:17:45
shooting
00:17:46
[Music]
00:17:47
he wasn't an obvious Target and that was
00:17:50
clear very very early on from this not
00:17:53
just from what the police are saying but
00:17:54
also from the friends and the family
00:17:56
that we started to get into contact with
00:17:59
uh witness had told us that there were
00:18:02
two male figures who arrived at a
00:18:05
location
00:18:06
on a specific make and model of a bike
00:18:09
it was an electric bike and it was a
00:18:12
sore on bike
00:18:14
we start to see messages from on things
00:18:16
like social media and tributes to it
00:18:18
became almost a bit peculiar because so
00:18:20
often when this happens once you find
00:18:22
out who it is you can almost you can
00:18:24
almost see the pattern in which it's
00:18:26
taken place with Michael it was just
00:18:28
nothing obvious whatsoever living is an
00:18:31
area that's that's gone through
00:18:32
difficult times recently yeah there was
00:18:34
a lot of Industry particularly around
00:18:36
the the docks in the northern Liverpool
00:18:38
area
00:18:39
working on various lines of inquiries
00:18:43
which included Community intelligence
00:18:46
people were genuinely concerned people
00:18:50
with fearful
00:18:52
first priority for police is to examine
00:18:54
whether this was a truly random shooting
00:18:57
if there was some connection or if there
00:19:00
was even a mistaken connection that
00:19:03
could have led to this shooting the
00:19:05
first would be looking at everybody as a
00:19:08
potential suspect and knowing they could
00:19:10
strike on another member of the
00:19:11
community
00:19:14
why was he shot in his home your home
00:19:17
meant to be a safe place who was it who
00:19:19
targeted him was he involved in gangs
00:19:21
did he upset somebody was it a
00:19:23
retribution for something else that he
00:19:25
did and then you start thinking who else
00:19:29
is at risk
00:19:31
there's a Scramble for information quite
00:19:33
often there's a delay between what the
00:19:34
police are willing to tell you before
00:19:36
you can actually put that information
00:19:37
out there but even before then you start
00:19:39
to piece together what's happened it's
00:19:42
just a case of dot in the eyes and
00:19:43
crossing the teeth
00:19:45
the first thing I wanted to get a little
00:19:47
bit more of is what can we get from CCTV
00:19:51
what can we get from anpr
00:19:54
Witnesses so we needed to cover quite a
00:19:59
massive area as quickly as possible
00:20:05
talk to police officer I've got to go
00:20:07
and speak to his mum I said I can't tell
00:20:09
you anything else
00:20:11
I don't know what's going on but
00:20:12
Michael's dad
00:20:13
[Music]
00:20:19
everybody just broke down quiet because
00:20:21
we just couldn't comprehend what it's
00:20:24
got our
00:20:26
this was a normal family night in
00:20:30
[Music]
00:20:36
[Music]
00:20:38
of what happened
00:20:42
I could see at the bathroom upstairs the
00:20:44
leaves the needles the equipment deduced
00:20:50
it's you know a general thing that said
00:20:52
machines and blood Footprints 100
00:20:56
minutes
00:20:58
um I couldn't read his mom see I
00:21:00
couldn't let myself see that
00:21:04
so we'll just put a towel over the head
00:21:05
and then Joshua Linda's sister
00:21:08
downstairs in the same way that's I
00:21:11
don't know what I had
00:21:12
so then I forgot to see how that
00:21:14
traumatic memory
00:21:16
I've seen
00:21:17
when it happened at the bottom of the
00:21:19
stairs
00:21:21
[Music]
00:21:25
with Michael it was just nothing obvious
00:21:27
whatsoever
00:21:29
it looked like a targeted murder because
00:21:31
it happened at his home shots had been
00:21:33
fired from his window so obviously you
00:21:35
think someone has deliberately gone
00:21:37
there to Target him and there must be a
00:21:38
reason for that but the more that we
00:21:40
found out about Michael the more we
00:21:41
found out about his family almost the
00:21:43
more the more information we got the
00:21:45
more confusing this seemed because it
00:21:47
was very very difficult to place a
00:21:48
motive on what happened
00:21:52
I wasn't just looking for
00:21:54
evidence connected to the shoots in the
00:21:57
active murder in Mikey I always wanted
00:22:00
to see a sort of lifestyle that he have
00:22:02
was Mikey a gangsters they use it Lydia
00:22:05
firearms and they have wealth did he
00:22:07
have anything that I could give as a
00:22:10
motive for why he was targeted and
00:22:14
I didn't find it
00:22:16
didn't find other than a couple of
00:22:18
parent Riders
00:22:19
I remember walking away from the scene
00:22:22
knowing that the assailant the targeted
00:22:26
Mikey I knew that
00:22:28
they were shooting
00:22:30
to harm Nike and this was from
00:22:33
information that I got
00:22:36
and the days and weeks after make us men
00:22:39
for the first week we were in a bubble
00:22:42
and then we were allowed to go back
00:22:44
towards the house and they said we could
00:22:46
go inside the house
00:22:48
the bullet holes were still in the
00:22:49
window there was still shout to Glass
00:22:51
all over the kitchen on top of Joshua's
00:22:53
birthday cake it was a sight to see you
00:22:56
know abandoned in the living room
00:22:58
spots of Bloods in the hole you know but
00:23:02
everyone was saying the same thing
00:23:05
why am I he
00:23:07
the reality kicked in actually quite a
00:23:10
far way down the line and after that
00:23:14
happened we were
00:23:16
told that we couldn't no longer stay
00:23:18
there because it was a crime scene and
00:23:20
we had to stay somewhere else and it was
00:23:23
such a hard decision because that's the
00:23:25
only home I've ever known
00:23:27
for 16 years in my life
00:23:30
and that decision was probably one of
00:23:33
the hardest decisions to make and
00:23:36
not to go back
00:23:47
and the night of his murder Mikey
00:23:49
Rainsford was looking forward to
00:23:52
spending night with his girlfriend he
00:23:54
asked his dad for a lift he was so
00:23:56
excited about the evening he was in his
00:23:57
kitchen and shots came through the
00:23:59
window and unfortunately he died and his
00:24:02
dad and brother's arms in a hallway in
00:24:04
his own home
00:24:05
[Music]
00:24:06
the local policing team we were able to
00:24:09
start Lincoln because Intel were coming
00:24:12
in with different names but two names
00:24:15
that were quite high upon that list
00:24:18
were pip
00:24:19
and worm
00:24:21
I also started looking a bit closer to
00:24:25
an incident that occurred not so long
00:24:28
before the shooting and this incident
00:24:31
involved an allegation of criminal
00:24:33
damage
00:24:35
and it occurred Rossini streets that
00:24:38
address happened to be the home address
00:24:40
if Joyce
00:24:42
Smith
00:24:44
who is the mother
00:24:45
of James and Michael Foy
00:24:48
these are the two prominent members of
00:24:51
the Gang
00:24:53
going from local intelligence and from
00:24:57
statements by officers
00:24:59
who were quite quickly able to narrow
00:25:02
down that people was in fact the
00:25:04
nickname for James and worm was in fact
00:25:07
their nickname for Michael
00:25:10
heard about the potential involvement of
00:25:12
the fouries before they were charged
00:25:13
during the kind of the early stages of
00:25:15
police investigation you know it's a
00:25:17
family that was known about in the area
00:25:19
and I'd sat in the same room as Michael
00:25:21
for just a couple of years earlier when
00:25:23
he was jailed for for drug dealing for
00:25:25
his involvement a gang that dealt drugs
00:25:27
in the streets around where he lived
00:25:29
Michael hasn't been dead for 24 hours
00:25:32
yeah they had in the region of 60 phone
00:25:36
calls all say the same names that late
00:25:40
I'd never heard of the phrase I'd never
00:25:43
heard James or my hopefully I always
00:25:46
knew that he didn't know who it was
00:25:50
because he never had enemies never had
00:25:54
he never never upsets anyone he never no
00:25:58
one ever had a reason to Target him
00:26:00
telephone data led us to execute a
00:26:04
warrant at an associate of the Foy
00:26:07
Brothers
00:26:08
we subsequently seized their phone
00:26:11
didn't get the firearm or the motorbike
00:26:13
but the telephone data
00:26:16
resulted on us executed a warrant an
00:26:19
associate of the voice
00:26:21
just we knew that they'd been in touch
00:26:24
communicating on the phone
00:26:27
within the relevant time
00:26:30
we subsequently seized this person's
00:26:34
phone and was able to get it downloaded
00:26:37
and embedded within Snapchat was a still
00:26:42
image also bedded
00:26:46
within this photograph
00:26:49
was a very
00:26:51
thick message
00:26:54
which said something along the lines of
00:26:57
tell yamar
00:26:59
doc don't use bricks
00:27:01
then it had two emojis which looked like
00:27:05
it was saying
00:27:08
don't use bricks Bang Bang
00:27:12
foreign
00:27:16
[Music]
00:27:29
came out the house that morning a whole
00:27:31
of Huntington roads every single
00:27:33
neighbor was stood on the front garden
00:27:36
and the hairs come out come down the
00:27:39
street and we followed it up in a car
00:27:41
and there was there was like a it was
00:27:44
like about 20 cars behind us following
00:27:47
us down this little roads little quiet
00:27:49
Road
00:27:49
[Music]
00:27:56
[Music]
00:27:59
eulogy uh
00:28:02
as we drove past the school
00:28:05
um
00:28:06
all the teachers and the pupils that
00:28:08
come out
00:28:10
and they lie on the street
00:28:15
and the all Applause
00:28:20
he was known as a positive person within
00:28:23
that community and for that Community
00:28:24
you only have to look at the scenes for
00:28:26
his funeral
00:28:28
foreign
00:28:31
[Music]
00:29:00
this shows it because what this this
00:29:02
picture shows is smile
00:29:05
but it doesn't show you the 20 people I
00:29:08
was a shot of how many friends and our
00:29:10
war we was with people
00:29:13
[Music]
00:29:16
in his own home while he was doing
00:29:19
absolutely nothing wrong
00:29:20
police saw this and knew they had very
00:29:23
dangerous offenders out on the streets
00:29:25
and they were moving as fast as they
00:29:27
could to remove them
00:29:30
Michael Rainsford murder the storyline
00:29:32
essentially started just after 10
00:29:34
o'clock on the night of April the 7th
00:29:36
what happened essentially was the home
00:29:38
of the voice where their mother was
00:29:39
alone bricks got put through the window
00:29:41
and that sparked a whole series of
00:29:43
events really with with the brothers
00:29:45
finding out about it trying to think who
00:29:47
might be responsible and then trying to
00:29:49
enact retribution as as quickly as as
00:29:52
possible
00:29:53
bricks were thrown through the window
00:29:56
if the family seat of the voice
00:29:59
the mom then made a telephone call to
00:30:02
his son James
00:30:04
who in turn contacted Michael Foy
00:30:08
Arrangements must have been made because
00:30:11
we were able to prove that James
00:30:13
traveled
00:30:15
to a nearby park and Michael's
00:30:17
girlfriend dropped him off at that
00:30:19
location
00:30:21
the CCTV evidence shows two people
00:30:24
traveling back towards Racine Street on
00:30:27
that motorbike we know that the foy's
00:30:30
made telephone calls to the associates
00:30:34
and then they seemed to travel
00:30:36
directly to Harrington
00:30:39
I believe somebody gave them
00:30:43
make its name
00:30:44
[Music]
00:30:46
and likely to be his address
00:30:54
boys did not have any evidence
00:30:58
suggest that Maggie was responsible
00:31:02
for the damage
00:31:04
but again if you look at it a
00:31:07
breakthrough window
00:31:08
and their responses to use firearm
00:31:12
in an hour they're pulling the trigger
00:31:14
something that they don't even know yeah
00:31:16
that tells you everything that you need
00:31:17
to know about them the lack of due
00:31:19
diligence like a thought process even in
00:31:21
terms of you know the trail of clues
00:31:24
that they leave that help the police to
00:31:25
solve their crime it doesn't belie any
00:31:27
sophistication it belies an idiocy and a
00:31:30
complacency in an arrogance
00:31:32
[Music]
00:31:46
we executed the Warrens at the foy's
00:31:49
house
00:31:50
sadly James was not there but we found a
00:31:53
number of items which we thought were
00:31:56
relevant we were able to confirm that
00:31:59
they had access to electric bikes
00:32:01
because there were component parts and
00:32:04
charges Etc the witness stated that one
00:32:07
of them was wearing the Montclair
00:32:09
jackets or at least one of them and we
00:32:11
recovered similarly described jackets
00:32:14
within the property
00:32:16
both brothers James and Michael Foy were
00:32:19
arrested by members of the team
00:32:23
both gave no comment interviews and were
00:32:27
recovered the invoice for the purchase
00:32:30
of the reds are on bike so we're able to
00:32:34
put those
00:32:36
in the voice possession
00:32:39
another key pieces of evidence was that
00:32:41
we sent off the jackets to be examined
00:32:46
and the scientists was able to find
00:32:51
gunshot residue
00:32:53
on the Garment
00:32:55
the type of GSR was what you would
00:32:58
expect for the killer of Mikey to be in
00:33:01
contact with
00:33:03
[Music]
00:33:05
it makes me feel heartbroken that his
00:33:08
life was quite short by these monsters
00:33:11
because he meant nothing but good to to
00:33:15
the world and to the people around them
00:33:17
and
00:33:18
um
00:33:19
you know it does make me emotional to
00:33:21
think
00:33:23
kind of the impact that's that's having
00:33:26
on his family as well
00:33:30
[Music]
00:33:35
in retribution for
00:33:39
a broken window
00:33:41
where these two Lads lived with the
00:33:43
mother
00:33:44
and see forth
00:33:46
[Music]
00:33:47
and an hour before my son's murder
00:33:50
somebody had thrown a bricks through
00:33:51
their window
00:33:53
and in there
00:33:55
it's delusional
00:33:57
gangster
00:33:59
world's criminal World somebody was
00:34:02
going to pay
00:34:03
[Music]
00:34:08
my brother's life over a broken window
00:34:12
to any rational person
00:34:14
that seems so deserted to do something
00:34:16
like that
00:34:18
you know to take another person's life
00:34:20
over a broken window
00:34:22
[Music]
00:34:24
we were told that a lot of the evidence
00:34:26
they had was circumstantial
00:34:28
it was going to be a really tough case
00:34:30
to to prove because
00:34:32
there was no core
00:34:34
there's no motivation these were
00:34:37
important pieces of evidence
00:34:40
the two brothers set off with mergers
00:34:42
intent
00:34:44
and executed Mikey in his kitchen
00:34:48
before callously jumping back on the
00:34:52
bike
00:34:53
and heading back towards the family
00:34:55
seats
00:34:57
the call data and the telephone
00:34:59
information
00:35:01
CCTV suggested at some stage
00:35:07
assisted them with disposing of
00:35:11
the bike
00:35:13
were never able to prove
00:35:16
where the weapon went
00:35:18
all disposed of it is it hidden
00:35:21
[Music]
00:35:27
the trial itself every day was like
00:35:29
tearing the page of a book that you'd
00:35:31
never read because we were being told
00:35:33
for the first time
00:35:36
on diluted
00:35:38
um
00:35:39
to see them too
00:35:41
scrawny kids who thought that they were
00:35:45
Outlaws
00:35:47
with guns
00:35:50
on the first day of the trial as the sio
00:35:53
you're probably more nervous than the
00:35:55
family because that's the first phase
00:35:57
that the church is going to look at the
00:36:01
technicality the legality of things that
00:36:03
you've done when the defense put forward
00:36:06
their case
00:36:08
you know it's not personal but it feels
00:36:10
personal
00:36:12
if they question something they didn't
00:36:14
get or something that they are accusing
00:36:17
that wasn't done in a certain way you
00:36:20
feel personal because you've left that
00:36:23
case for over a year
00:36:24
you've lived breathe sleep eat
00:36:26
everything
00:36:29
there is a lot to take in and I stopped
00:36:32
to come to play background and phone
00:36:35
call it's so hard to listen to the full
00:36:37
thing you can hear everything
00:36:39
there was no Lamas at all for any of
00:36:42
them nothing made sense
00:36:44
you know I had no doubt in my mind that
00:36:47
the jewelry were going to say innocent
00:36:49
or guilty
00:36:51
I know killed me Sean and I know I knew
00:36:54
what they're gonna say
00:36:56
covered the murder trial throughout I
00:36:59
was there every day of the six week none
00:37:00
again for sentencing at the end and
00:37:03
they're really really difficult
00:37:05
processes to be involved with the
00:37:07
horrible because you have lives on the
00:37:09
line you have a life that's already been
00:37:10
lost the family's lives and they've been
00:37:12
torn apart by what's happened and
00:37:13
they're desperate for justice
00:37:15
these trials take place and they're so
00:37:17
tense and they're so emotional the
00:37:20
consequences are the actions of whoever
00:37:21
responsible you know they lie heavy on
00:37:24
the atmosphere of the courtroom because
00:37:25
so much is at stake whatever they're
00:37:27
going to get convicted get a sentence
00:37:29
Center Jail in this case it's murder so
00:37:31
you know it's a mandatory minimum life
00:37:33
sentence
00:37:35
calls it a criminal trial I think the
00:37:38
brothers was it's almost like it was a
00:37:40
theater
00:37:41
there were points that
00:37:43
yes they were listening intently
00:37:46
but
00:37:47
at the same time
00:37:49
there were points that they showed a
00:37:52
disregard for the process
00:37:54
um head down
00:37:56
eyes turn away smirking smiling at each
00:37:59
other I don't think I was surprised
00:38:02
because they had that almost arrogant
00:38:06
attitude
00:38:07
throughout the course of the
00:38:08
investigation
00:38:10
[Music]
00:38:18
I went to the theater I couldn't miss
00:38:20
that and I remember just every single
00:38:23
day I was there I couldn't take my eyes
00:38:25
with them just just knowing it was then
00:38:28
we've done that
00:38:31
he wasn't with us anymore and it was
00:38:34
just a Shard of
00:38:36
relief comfort that the people who don't
00:38:38
know being killed but it wasn't bringing
00:38:40
them back
00:38:41
it really was extraordinary what
00:38:44
unfolded in Liverpool Crown court that
00:38:45
day we've heard the foys and their
00:38:48
Baristas protesting their innocence
00:38:50
they were
00:38:52
being a bit more
00:38:55
about things which repulsed us because
00:38:58
you know
00:39:01
disgusting
00:39:02
just announced I do a little guilty one
00:39:04
by one still start to swear that's
00:39:06
shouting
00:39:08
punch the walls
00:39:11
James foy's Barrister got up he I
00:39:13
thought some of the words that still
00:39:15
live with me today to be honest and he
00:39:16
said all of a sudden his client wanted
00:39:18
to tell the court he was guilty he was
00:39:21
the person that pulled the trigger that
00:39:23
night and it was just stunning
00:39:25
[Music]
00:39:29
James and Michael Foy were sentenced for
00:39:32
their crimes on the 12th of March in
00:39:34
2021 James Foy was sentenced to a
00:39:37
minimum of 28 years in prison and
00:39:39
Michael Foy received a minimum of 30
00:39:41
years in prison for the murder that they
00:39:44
committed
00:39:45
I was pleased with the length of
00:39:47
sentences but we had the pattern to have
00:39:50
the life sense into every day of the
00:39:53
week after this to see Michael's clothes
00:39:55
in the wardrobe to think of all the
00:39:58
horizons that they've stolen
00:40:03
[Music]
00:40:06
I have never commented on sentences I'd
00:40:09
never
00:40:10
try and say I think it should be more I
00:40:12
think it should be less
00:40:13
because I think the judges will have all
00:40:16
the facts and they would have given a
00:40:18
good explanation in the seminar do a
00:40:20
thing the sentence was probably
00:40:23
appropriate for an offensive murder yeah
00:40:25
it was it's every member of the team
00:40:28
who wants to give the rainford Family
00:40:31
Justice you can only walk away knowing
00:40:34
that you've done your best
00:40:36
and on this occasion
00:40:39
I did my best
00:40:45
at the end of that child he actually
00:40:46
said we'll be outing 40 years but your
00:40:49
brother will still be in the mood
00:40:52
that's stuck with me every day
00:40:55
because
00:40:56
[Music]
00:40:58
that is it's true they'll be out in
00:41:02
fourth years but I'll never love my
00:41:04
brother back
00:41:06
and
00:41:07
it just breaks me out to know that
00:41:11
he could have gone on to be such an
00:41:14
amazing person the other future he
00:41:17
really did have a future whether it was
00:41:20
into skateboarding but it was
00:41:22
photography
00:41:23
and it was fishing he had a future
00:41:28
perfect and it's really sad that he's
00:41:32
gone
00:41:33
[Music]
00:41:37
and you could go into the Escape Park
00:41:39
he'd ever been to before where all the
00:41:42
local kids were skating
00:41:44
and it's all stop
00:41:46
I watch who's this kid you know it was
00:41:49
that talented you know you could have
00:41:51
you know it could be it could have gone
00:41:54
as far as he wants to
00:41:57
think that it's really devastating that
00:41:59
he would be able to live out all of
00:42:03
these opportunities that would have been
00:42:06
there waiting for him given all of his
00:42:09
talent he could have done a whole host
00:42:11
of different things with his life
00:42:13
especially now with the BMX and the
00:42:16
skateboard and it's kind of getting more
00:42:18
popular than with the Olympics and stuff
00:42:20
like that and I genuinely believe my he
00:42:23
could have you know given them all a
00:42:25
room for the money because he was just
00:42:27
that good
00:42:27
[Music]
00:42:30
since Michael was murdered we all
00:42:32
changed for the worst
00:42:34
physically and mentally at his happily
00:42:37
draw the curtains and never go out again
00:42:41
and when you do go out you put a mask on
00:42:44
because of what it does to you and it's
00:42:46
a save for Joanne but she's mum
00:42:51
you take care of the dancers before
00:42:54
these things you know when you walk
00:42:57
around the house and
00:43:00
[Music]
00:43:05
the first thing I did when I came back
00:43:07
was
00:43:09
closely to the window and from there
00:43:12
I went straight up to the dream
00:43:15
and I lied and I just I just lied if I
00:43:19
was you know just just holding his
00:43:23
personal belongings you know
00:43:26
it was it was horrible
00:43:31
[Music]
00:43:45
oh
00:43:50
I'm haunted by saying I was scared
00:43:53
terrified by almost in the last seconds
00:43:56
of his life
00:43:57
when he should have been sitting in the
00:43:59
car going to see a girlfriend
00:44:01
you know
00:44:03
what would the future have held you know
00:44:04
get engaged
00:44:06
to have an old child moving it together
00:44:09
just because I wanna
00:44:12
you know do the growing up all the
00:44:14
things well you know they also still had
00:44:16
a lot of fun things to do lots of
00:44:18
millions and millions and billions of
00:44:19
them and you see me we made
00:44:22
are there those animals so far away
00:44:28
seeing that happened to the person you
00:44:30
look up to most
00:44:32
it it ripped me apart you know I
00:44:36
remember trying to be this strong man
00:44:39
I felt like I lost a piece of me that
00:44:41
that night I really did you know
00:44:44
someone I looked up to so much
00:44:47
he's never there anymore you know what I
00:44:49
mean
00:44:50
it broke me
00:44:52
I'll never heal from now
00:44:55
okay I think Father Christmas has got
00:44:57
everything he needs to know
00:44:59
do you remember Christmas
00:45:03
I need to get your message okay put this
00:45:05
in the book for them okay
00:45:08
all right okay here you go bye
