Forensic Files (HD) - Season 13, Episode 10 - Window Watcher - Full Episode

March 05, 2021 / 21:16

This episode covers the murder of Gary Elwood, the assault on his girlfriend Janet Haynes, and the investigation that led to Jonathan Graham's arrest.

On a hot night in Oklahoma, Gary Elwood was murdered in his home while his girlfriend, Janet Haynes, was assaulted by the intruder. Janet heard Gary scream for help and ran to assist him, but the attacker chased her back into the bedroom.

Investigators found no signs of robbery, leading them to question Janet's account. Despite initial skepticism, her story was corroborated by forensic evidence, including footprints and blood patterns.

After years of investigation, police arrested Jonathan Graham, who was found with items suggesting he was involved in violent crimes. DNA evidence linked him to both the murder and the assault.

Graham pled guilty to first-degree murder and rape, and the episode highlights the advancements in forensic science that ultimately led to his conviction.

TL;DR

Gary Elwood was murdered and his girlfriend assaulted; Jonathan Graham was later arrested and convicted based on DNA evidence.

the peeping tom goes one step further
00:00:08
and commits
00:00:09
an unspeakable crime the scenario here
00:00:12
thankfully is not a scenario we see very
00:00:14
often this was someone
00:00:16
that was an avid window peeper and been
00:00:19
there before
00:00:20
for 20 years he eludes police and even
00:00:23
returns to the crime scene
00:00:25
the kitchen is the brawl the guy had
00:00:27
made his way back to the scene
00:00:29
to relive it eventually he goes one step
00:00:32
too far it's one of those aha moments
00:00:34
that you get
00:00:35
we assumed it would be a you know 14
00:00:37
year old kid

gary elwood went to bed early

00:01:06
just after midnight they heard a noise
00:01:09
coming from the living room
00:01:11
gary went to investigate
00:01:15
she heard him scream for help she heard
00:01:17
noises she heard sounds of a struggle
00:01:20
this of course brought her to fully
00:01:21
awake almost instantaneously
00:01:24
janet ran to help but without her
00:01:26
glasses couldn't see clearly
00:01:29
she was able to tell us that he was
00:01:30
wearing gloves and
00:01:32
had underwear on
00:01:35
the assailant chased janet back into the
00:01:38
bedroom where she was assaulted
00:01:40
he would try over the course of that
00:01:43
attack to knock her unconscious to
00:01:45
to suffocate her to a point where she
00:01:47
would lose consciousness
00:01:48
she ben can say you don't have to kill
00:01:50
me he says yes i do
00:01:53
and i think pretty much she managed to
00:01:56
just talk him out of that possibility
00:01:59
after several hours the attacker left
00:02:03
that's when janet discovered gary's
00:02:06
lifeless body
00:02:08
now in a state of shock she managed to
00:02:11
call police
00:02:14
she was asking me is he dead is he dead
00:02:17
i know he's dead
00:02:18
he's dead gary elwood had been stabbed
00:02:22
to death police found his body near the
00:02:24
front door
00:02:26
he was only 27 years old gary was
00:02:30
evidently surprised in the dining area
00:02:32
of the house which was in the front
00:02:34
i noticed a crack in the sheet rock on
00:02:36
the wall
00:02:39
that was obviously done by the force of
00:02:41
being driven into the wall
00:02:42
it was almost an outline of his body
00:02:44
where he crashed into the wall
00:02:47
gary was divorced a successful
00:02:49
businessman with no
00:02:50
known enemies he was
00:02:53
a first class guy smart intelligent
00:02:56
knew exactly where he was going the
00:02:58
things that were important in life
00:03:00
cared a lot about people gary and janet
00:03:03
had been dating for only a short time
00:03:05
so she didn't know whether gary knew his
00:03:08
killer
00:03:11
her eyesight had some limitations and
00:03:13
the darkness of the room
00:03:15
contributed a great deal to that even
00:03:16
though she'd spent a significant amount
00:03:18
of time with him in the room
00:03:20
she said the attacker was in his early
00:03:22
twenties had blonde hair
00:03:24
was just under six feet tall and had
00:03:27
a scraggly beard police
00:03:31
across oklahoma were looking for a man
00:03:33
who fit
00:03:34
this description but some members of the
00:03:37
police department
00:03:39
began to question janet's story
00:03:42
we always questioned how a guy that may
00:03:44
be carrying his clothes
00:03:46
and stripped down his underwear carrying
00:03:47
a knife and blood all over him
00:03:49
you know where is he going to go and how
00:03:50
is he going to get away without somebody
00:03:52
noticing that
00:03:56
first on the scene to a gruesome murder
00:03:58
i found out that gary had been
00:03:59
murdered as we were watching the evening
00:04:01
news they would ask me
00:04:03
is there any possibility that gary was
00:04:04
involved with drugs the answer is
00:04:06
absolutely no
00:04:08
gary elwood was brutally murdered by
00:04:10
someone who broke into his home
00:04:12
in the middle of the night but the
00:04:14
motive didn't appear to be robbery
00:04:17
nothing of value was missing and the
00:04:19
victim's girlfriend
00:04:21
janet haynes survived the attack
00:04:24
what i found fascinating about that
00:04:28
was the fact he did not resort to
00:04:30
physical violence toward the victim
00:04:32
he was simply trying to subdue her he
00:04:35
didn't beat her
00:04:36
he didn't use profanity toward her he
00:04:39
didn't attempt to stab her
00:04:40
even though he could have very easily
00:04:42
done that
00:04:43
investigators started to question
00:04:45
whether janet haynes
00:04:47
might have known the perpetrator or
00:04:49
perhaps the perpetrator knew
00:04:51
her we thought it was possible it could
00:04:54
have been an ex-boyfriend or at least
00:04:55
someone who had
00:04:58
either trying to date her or something
00:05:01
like that
00:05:01
it's almost like he's trying to remove
00:05:04
the object between him and the girl
00:05:09
yet another unusual detail was janet's
00:05:12
description of the killer
00:05:14
she said he was wearing only his
00:05:16
underwear
00:05:17
and a pair of gloves it just didn't ring
00:05:21
right to any of us we really wanted to
00:05:24
just
00:05:25
verify that she was being up and up with
00:05:27
us
00:05:28
so janet was given two extensive
00:05:30
polygraph examinations
00:05:32
and she passed both times police look
00:05:36
for evidence
00:05:37
to corroborate janet's story at the time
00:05:40
luminol was just becoming available so
00:05:43
investigators decided to try it
00:05:46
their reaction was woo because they were
00:05:49
amazed at what it was revealing at that
00:05:52
time and
00:05:53
from that scene it got the nickname
00:05:55
locally here wu juice because
00:05:57
it was such a weird feeling to be
00:05:59
watching what's going on and we realized
00:06:01
what great potential
00:06:02
this luminol has the luminol was further
00:06:06
proof that everything janet told
00:06:08
investigators
00:06:10
was true all sudden you start seeing
00:06:13
footprints appearing in the dark it's
00:06:15
almost like you're walking in the
00:06:16
footsteps of the person
00:06:18
and the hair stands up on the back of
00:06:19
your neck because at that moment
00:06:21
you're seeing the actual direction that
00:06:23
this assailant had walked
00:06:25
and investigators found other evidence
00:06:27
to corroborate janet's story
00:06:30
the screen in the dining room window had
00:06:32
been cut the likely point of entry
00:06:36
under the master bedroom window in the
00:06:39
soft dirt
00:06:40
were some bare footprints from an
00:06:42
individual with a size
00:06:44
11 foot and investigators discovered
00:06:48
a faint fabric impression in the dirt
00:06:50
underneath the window
00:06:52
it's a pretty good detective work i
00:06:54
think if you you could tell that
00:06:55
they see a buttocks imprint on the
00:06:58
ground beneath the window it looked as
00:07:00
though that
00:07:00
person had spent quite a lot of time
00:07:02
under that window
00:07:04
from that window the killer had a clear
00:07:08
sight line into the bathroom
00:07:12
janet told investigators she took a
00:07:14
shower before she went
00:07:16
to bed to investigators this
00:07:19
told a story perpetrator in this
00:07:22
particular case was a window peeper
00:07:24
window peepers looked for victims of
00:07:27
opportunity
00:07:28
and once he discovered that there was in
00:07:30
fact a woman
00:07:32
inside that residence that's where he
00:07:34
decided to commit his crime that
00:07:36
particular night
00:07:37
because the killer entered the house
00:07:39
wearing only his
00:07:40
underwear and a pair of gloves fbi
00:07:44
profilers believed his target was janet
00:07:47
not gary and he must have believed
00:07:50
she was alone it was our opinion that
00:07:53
the target in this crime the primary
00:07:55
target in this crime
00:07:56
was janet he wanted to rape her that's
00:08:00
the reason the primary motive for
00:08:01
entering that residence to begin with
00:08:05
hazelwood believes the perpetrator had
00:08:08
never killed before
00:08:09
in this particular case we felt it was
00:08:12
panic stabbing
00:08:14
he had not expected to encounter gary at
00:08:17
that particular point
00:08:19
the fbi created an entire profile of the
00:08:22
person they believe
00:08:23
perpetrated this crime we estimated his
00:08:26
age to be between i believe 22 and 27.
00:08:30
his education we said he had graduated
00:08:32
from high school
00:08:33
he lived within walking distance of
00:08:35
where the crime had been committed
00:08:38
hazelwood predicted that the killer
00:08:40
would be so traumatized
00:08:41
that his weight would fluctuate and he
00:08:44
would look for a legitimate reason
00:08:46
to leave the area this was a frightening
00:08:49
experience for this
00:08:51
person because in our opinion he'd never
00:08:53
killed before
00:08:54
and that he and he did not intend to
00:08:56
kill when he went into that residence
00:08:59
but if the killer had left town how
00:09:02
would police find him
00:09:07
police believed that gary elwood's
00:09:09
killer was someone
00:09:11
who lived near the crime scene was a
00:09:14
window peeper
00:09:15
in his early to mid-20s and would leave
00:09:18
the area
00:09:19
after the crime inside the crime scene
00:09:23
investigators found some foot
00:09:25
impressions in blood
00:09:27
one had plenty of ridge detail your feet
00:09:30
and your hands
00:09:31
have unique fingerprints the dermal
00:09:33
patterns on your feet are unique to you
00:09:35
just as your fingerprints are unique to
00:09:36
you
00:09:37
on your hands all police needed now
00:09:41
was a suspect i went from door to door
00:09:44
have you lived here how long have you
00:09:45
lived here who you know in the
00:09:47
neighborhood
00:09:48
who you associate with the neighborhood
00:09:51
they found
00:09:52
one promising lead 18 year old bill
00:09:55
winters who lived two blocks away from
00:09:58
the crime scene
00:10:00
his parents had moved out of state and
00:10:02
left him alone
00:10:03
in that house he wasn't a big guy he
00:10:06
would have been just the right size to
00:10:07
get through the hole in the screen
00:10:10
as the profile predicted shortly after
00:10:13
the murder
00:10:14
winters left town to live with his
00:10:15
parents in missouri
00:10:18
during police questioning winters denied
00:10:21
any involvement in gary elwood's murder
00:10:23
and willingly provided a print of his
00:10:26
right foot
00:10:28
it did not match the bloody print found
00:10:31
in the victim's home
00:10:33
i was extremely frustrated not only is
00:10:35
all the weight on your shoulders because
00:10:37
this is your unsolved case but
00:10:40
it also weighs on the police department
00:10:42
too it's just something that
00:10:44
you can't afford to let go of
00:10:47
three years passed then an inmate at the
00:10:51
local jail contacted police about his
00:10:53
former roommate
00:10:55
bob johnson someone who came forward and
00:10:58
claimed that
00:11:00
their roommate at that time in 86
00:11:04
johnson had come home bloodied and said
00:11:06
that he had killed somebody
00:11:09
johnson's mug shot looked remarkably
00:11:12
like the composite drawing of the
00:11:14
suspect
00:11:15
he didn't fit the fbi profile but
00:11:18
his background made him a likely suspect
00:11:23
his ex-wife told the investigators that
00:11:25
mr johnson
00:11:26
had a significant drug problem and he
00:11:28
was conducting
00:11:30
those burglaries to help support that
00:11:31
habit
00:11:35
janet haynes identified johnson in a
00:11:38
photo lineup
00:11:40
she put the finger on johnson so i'm
00:11:42
sure at that point edmund investigators
00:11:44
clearly thought they had their man
00:11:47
by this time dna testing was standard
00:11:50
practice
00:11:51
so johnson's dna was compared to semen
00:11:54
from
00:11:54
janet haynes rape test kit
00:11:58
and his footprints were compared to the
00:12:01
bloody footprints at the crime scene
00:12:04
it was just a matter of days that we got
00:12:07
those results back
00:12:08
and conclusively excluded him as a
00:12:11
suspect of this homicide he it was not
00:12:13
his footprint
00:12:14
it was not his dna type that was left
00:12:16
behind
00:12:18
the case went cold again
00:12:23
investigators never gave up but they
00:12:26
were running
00:12:27
out of ideas
00:12:30
three years later on a hunch they
00:12:33
revisited the scene of the crime
00:12:35
not even sure what they were looking for
00:12:39
we go back into the house and we're just
00:12:43
looking around because it sat there for
00:12:45
several years
00:12:46
vacant was there anything they missed
00:12:50
something they hadn't thought of and
00:12:53
then
00:12:54
they found a potential clue right on the
00:12:57
floor in the kitchen area
00:12:59
is the bra it didn't look
00:13:03
new but it wasn't there the last time
00:13:06
they were inside the home
00:13:07
shortly after the murder was it possible
00:13:12
that this belonged to janet haynes
00:13:15
i verified the bra belonged to her
00:13:19
one of the things that is characteristic
00:13:22
of a lot of rapists is that they will
00:13:25
take a trophy
00:13:27
and one of the the trophies that
00:13:30
we felt that he took during time was the
00:13:33
female's bra
00:13:34
so i believe that the guy had
00:13:38
made his way back to the scene to relive
00:13:41
it
00:13:44
but if the killer had been back in the
00:13:46
neighborhood
00:13:47
it might have been only for a visit this
00:13:50
guy had some direct ties to the
00:13:52
neighborhood
00:13:52
somehow some way either relatives in the
00:13:56
neighborhood or
00:13:57
he had lived there over the next
00:14:00
18 years police checked dozens of
00:14:04
suspects from
00:14:05
seven different states none panned out
00:14:10
then in the spring of 2004
00:14:14
tv viewers in edmond oklahoma
00:14:17
saw this story scott eggleston says he
00:14:21
knew someone had been watching his
00:14:23
family for months
00:14:24
even taking photos through a crack in
00:14:25
the blinds we assumed it would be a
00:14:27
you know 14 year old kid but it wasn't a
00:14:31
kid
00:14:32
it was a grown man the father
00:14:35
came around the house and found a
00:14:37
suspect dressed completely in black
00:14:39
he had arranged an outfit
00:14:42
that was like a turtleneck where he
00:14:44
could pull it up over his face and he'd
00:14:46
just cut out holes for his eyes and a
00:14:47
hole for his mouth so he could breathe
00:14:50
and the man was barefoot
00:14:54
i've got a little adrenaline rush and i
00:14:56
said where are we
00:14:58
i came straight back to the station
00:15:01
pulled out a map and realized that i was
00:15:05
directly straight across where gary
00:15:08
had been killed almost 18 years ago
00:15:12
was this the man who killed gary elwood
00:15:15
and sexually assaulted janet haynes
00:15:18
almost
00:15:18
20 years earlier
00:15:23
pulled up his turtleneck to cover his
00:15:25
face
00:15:26
just started walking when police
00:15:27
arrested 40-year-old jonathan graham for
00:15:30
peeping into the window of a teenaged
00:15:32
girl
00:15:33
they suspected he was more than just a
00:15:36
voyeur
00:15:37
in his possession were items for a more
00:15:41
violent crime a bag was found
00:15:45
with several different kinds of knives
00:15:47
three pair of handcuffs flecks
00:15:49
cuffs condoms sex lubricants sex
00:15:53
toys lock picking tool bandana black
00:15:56
clothing which in our business
00:15:59
that's a rape kit police now suspected
00:16:03
graham was responsible for the murder of
00:16:06
gary elwood
00:16:07
and the sexual assault of janet haynes
00:16:10
crimes that occurred 18 years earlier
00:16:13
in the very same neighborhood
00:16:17
at the time of gary elwood's murder
00:16:19
graham was living with his parents just
00:16:21
a couple of blocks from elwood's home
00:16:23
and that's where he was living now after
00:16:26
a brief stint in the army
00:16:29
with a warrant police searched graham's
00:16:32
home
00:16:33
on his computer they found child
00:16:36
pornography and pictures of women
00:16:39
he'd secretly photographed
00:16:42
investigators took an inked print of
00:16:45
graham's feet
00:16:47
i remember i was just sitting there
00:16:49
thinking about that just
00:16:51
just yeah oh i hope this one works out
00:16:55
analyst jim stokes searched for
00:16:57
corresponding ridge detail
00:16:59
on the crime scene footprint and the one
00:17:03
taken from
00:17:04
jonathan graham i was able to
00:17:07
isolate an area on the outside of the
00:17:10
foot
00:17:11
that being it was a right foot
00:17:13
impression so it would be the right side
00:17:15
of the foot about midway down
00:17:19
stokes called investigators with the
00:17:21
news
00:17:23
i was really quite surprised and excited
00:17:27
yeah that was a pretty cool day there
00:17:30
was a lot of cheering on the phone so
00:17:32
i still remember the scream in my ear
00:17:35
finally graham's dna profile
00:17:38
matched the biological sample from janet
00:17:41
haynes rape test kit
00:17:44
it was like the weight of the world
00:17:45
being lifted off your shoulders it was
00:17:47
just
00:17:48
you can't describe it the fbi profile
00:17:52
had been remarkably accurate in
00:17:54
predicting the perpetrator's age
00:17:56
education and where he lived
00:17:59
graham also admitted he lost weight
00:18:02
after the murder and joined the army
00:18:05
where he worked
00:18:06
in military intelligence after he was
00:18:09
discharged
00:18:10
he returned to oklahoma i guess that was
00:18:12
his best situation
00:18:14
to move back into an area that he was
00:18:16
familiar with the same old neighborhood
00:18:18
that he once lived in
00:18:19
you know a decade plus ago
00:18:22
but why would graham return to the same
00:18:25
neighborhood
00:18:26
where he killed gary elwood decades
00:18:29
earlier and commit the same crime
00:18:32
of window peeping knowing that if he got
00:18:35
caught
00:18:36
he'd immediately be a suspect in
00:18:38
elwood's murder
00:18:40
and the answer is simply that he was a
00:18:43
window peeper and he was
00:18:45
driven to commit those types of crimes
00:18:48
that's
00:18:48
what was exciting to him and i believe
00:18:52
that he felt he would not be
00:18:54
caught why because he was so proficient
00:18:56
at what he had been doing over
00:18:58
all those years
00:19:01
prosecutors believe that graham stood
00:19:04
outside gary elwood's home on the night
00:19:07
of the crime
00:19:08
and watched while janet haynes took a
00:19:11
shower
00:19:11
[Music]
00:19:18
graham thought janet was there alone
00:19:20
since he couldn't see
00:19:21
gary from his vantage point
00:19:28
after janet went to bed prosecutors
00:19:31
think
00:19:31
graham removed his clothes and shoes
00:19:34
outside
00:19:35
then entered the house by cutting the
00:19:38
window screen
00:19:40
he made enough noise that he woke gary
00:19:42
who went to investigate
00:19:44
the two fought
00:19:48
then graham stabbed gary to death
00:19:52
and for the next few hours terrorized
00:19:55
janet
00:19:59
graham left clear footprints in gary's
00:20:02
blood
00:20:03
which later tied him to the scene along
00:20:06
with the dna evidence
00:20:10
facing a possible death sentence
00:20:13
jonathan graham pled guilty to
00:20:15
first-degree murder
00:20:17
and rape i don't remember much of the
00:20:19
incident
00:20:20
other than i pushed him against the
00:20:23
one of the walls and
00:20:27
i i didn't see it until i was told
00:20:30
last year i didn't know how many times i
00:20:32
had stabbed him
00:20:34
graham had no way of knowing that 20
00:20:37
years later
00:20:38
technology would eventually catch up
00:20:42
with him
00:20:43
the forensic science behind this
00:20:45
investigation is what sealed jonathan
00:20:47
graham's guilt
00:20:49
even without ever stepping a foot in
00:20:50
court over my career i've seen some
00:20:52
amazing things and
00:20:53
that coupled with good detective work
00:20:56
there's just
00:20:57
no end to what we can do we here in
00:21:00
science
00:21:01
in forensics we're here for the truth
00:21:04
we're not here for the prosecution we're
00:21:05
not here for the defense we're here for
00:21:06
the truth
00:21:07
he will spend the rest of his life in
00:21:09
the state penitentiary
