Forensic Files - Season 9, Episode 3 - In Harm's Way - Full Episode

January 01, 2022 / 21:42

This episode covers the murder of Katherine Harms, the forensic investigation, and the trial of Maureen Malloy. Key topics include DNA evidence, toxicology, and tool mark analysis.

On November 9, 1995, police discovered Katherine Harms' body in Anchorage, Alaska. The autopsy revealed she died from a stab wound, and investigators faced challenges due to a lack of witnesses and evidence.

As the investigation progressed, police learned about Katherine's troubled lifestyle, including drug use and transient living arrangements. A package sent from Maureen Malloy contained items linked to Katherine, including a knife and a note instructing the recipient to destroy the contents.

Forensic experts matched the knife to the stab wound on Katherine's rib cage, providing compelling evidence against Maureen Malloy, who was arrested and charged with first-degree murder. The trial revealed motives related to jealousy and fear of exposure.

Ultimately, Maureen Malloy was found guilty and sentenced to 159 years in prison. The episode highlights the importance of forensic science in solving crimes without eyewitnesses.

TL;DR

Katherine Harms was murdered; Maureen Malloy was convicted based on forensic evidence linking her to the crime.

00:00:56
on november 9 1995 dawn broke crisp and
00:01:01
cold over anchorage alaska
00:01:04
the temperature was around zero degrees
00:01:07
when a policeman on routine patrol
00:01:09
discovered a body in a public park
00:01:15
we didn't have anything we had no
00:01:17
witnesses
00:01:18
nothing but the body as far as evidence
00:01:20
goes
00:01:21
no tracks as far as a vehicle or person
00:01:24
or footprints anything like that so we
00:01:25
had very very little and we were very
00:01:27
concerned about it
00:01:29
police took her fingerprints and ran
00:01:31
them through aphis the automated
00:01:33
fingerprint identification system which
00:01:36
compared them to millions of prints in a
00:01:38
nationwide database
00:01:41
the victim was identified as 34-year-old
00:01:44
katherine harms
00:01:47
a background check indicated catherine
00:01:49
harms known as cat had recently moved to
00:01:52
anchorage from juneau the state capitol
00:01:55
where she was employed by the tangus
00:01:57
national park service
00:02:00
catherine told friend she moved to
00:02:02
anchorage to be closer to her
00:02:04
seven-year-old son
00:02:06
we not only just barely identified her
00:02:08
but we had no idea where she was living
00:02:12
no idea what lifestyle she had except
00:02:14
from the background in
00:02:15
in juneau
00:02:16
uh we had no idea who would want to hurt
00:02:18
her like that
00:02:19
catherine harms had been staying with
00:02:22
friends moving from place to place with
00:02:24
no steady address in the months
00:02:26
prior to her murder
00:02:28
when informed of her death
00:02:30
catherine's parents told police about a
00:02:32
chilling phone message they received
00:02:34
from her two nights before the murder
00:02:50
autopsy revealed the cause of death was
00:02:52
a stab wound to the chest
00:02:54
there was no blood around the wound
00:02:56
which told the medical examiner her
00:02:58
position when attacked
00:03:00
she was probably in a prone position or
00:03:03
she was laying on her back at the time
00:03:05
she was stabbed
00:03:07
surprisingly she had no defensive wounds
00:03:11
an individual who is being attacked with
00:03:14
a knife will attempt to fend off that
00:03:16
knife it may cause cuts in the hands or
00:03:18
on the forearms and we didn't find any
00:03:20
of those kinds of defensive wounds on
00:03:23
the hands or forearms of the decedent
00:03:26
she had also been beaten before her
00:03:28
death an indication catherine knew her
00:03:31
attacker
00:03:33
it was overkill really
00:03:35
and subsequently we it looked like a
00:03:38
body that
00:03:39
that was done out of anger
00:03:41
not just for the purpose of killing her
00:03:43
and we suspected that the victim knew
00:03:46
the person who did it because of that
00:03:49
investigators learned that catherine's
00:03:52
ex-husband was not in alaska when she
00:03:54
was murdered and was ruled out as a
00:03:56
suspect
00:03:58
two days later the anchorage daily news
00:04:01
printed a story asking anyone with
00:04:04
information about the victim to come
00:04:06
forward
00:04:08
and several did including one person
00:04:11
living over two thousand miles away
00:04:19
when news of katherine harm's murder was
00:04:22
released to the public
00:04:23
a man called police with some important
00:04:26
information
00:04:28
he said
00:04:29
catherine came over to his apartment a
00:04:31
few nights earlier
00:04:33
he said she was high on drugs and spent
00:04:36
the night and left the next morning in a
00:04:38
taxi although he didn't know where she
00:04:41
lived
00:04:42
with this information
00:04:44
police called the alaska cap company to
00:04:46
find out where catherine went
00:04:50
the cab driver said he picked up the
00:04:52
victim and transported her back to the
00:04:54
bernard hotel room 31
00:04:58
where
00:04:59
a female came out and
00:05:01
took her into room 31.
00:05:05
room 31 was occupied by a woman named
00:05:08
maureen malloy who lived there with her
00:05:11
two children
00:05:13
when interviewed by police malloy said
00:05:15
catherine was a friend who had been
00:05:17
staying with her until she found a place
00:05:19
of her own
00:05:21
she says oh yes catherine harms was
00:05:22
living with her but she was causing a
00:05:24
lot of trouble she was using drugs and
00:05:26
actually engaging in prostitution in her
00:05:28
room and she had children there and and
00:05:31
marine couldn't have that
00:05:33
and so
00:05:34
she told her she had to leave
00:05:36
malloy said a hotel clerk helped carry
00:05:39
catherine to her car
00:05:41
she said catherine was high on drugs but
00:05:44
other than that was fine
00:05:46
her skin was clammy and cold but i mean
00:05:49
she was she was definitely alive the
00:05:51
clerks agreed that the woman was not
00:05:54
stabbed
00:05:55
there was no blood on her body
00:05:58
she was definitely passed out there was
00:06:00
no way she was going to get up and walk
00:06:02
away
00:06:03
malloy planned to take catherine to
00:06:06
another friend's home
00:06:07
but they never got there
00:06:09
at tudor and arctic major intersection
00:06:12
several miles away from the spinard
00:06:13
hotel catherine harms had gotten up
00:06:16
jumped out of the car and ran away into
00:06:17
the night
00:06:18
[Music]
00:06:21
police searched maureen molloy's hotel
00:06:24
room and found no evidence of a struggle
00:06:27
there were no bloody clothes towels
00:06:30
sheets or anything else to indicate
00:06:32
someone had been stabbed
00:06:34
[Music]
00:06:35
all they found
00:06:37
were two tiny specks of blood
00:06:39
near the floorboard on the living room
00:06:41
wall
00:06:42
[Music]
00:06:43
dna testing matched the blood
00:06:46
to katherine harms
00:06:48
but it didn't help the case
00:06:51
she was living in the apartment she
00:06:53
could have cut herself and spot a blood
00:06:55
got on the wall that way there are lots
00:06:56
of different ways somebody can can bleed
00:07:00
so it does not prove that she was beat
00:07:02
in that apartment
00:07:04
toxicology tests from katherine harm's
00:07:07
autopsy revealed no alcohol or street
00:07:10
drugs in her system
00:07:12
but the medical examiner found
00:07:14
something very suspicious
00:07:16
we found very high levels of flexural in
00:07:19
the gastric contents indicating that she
00:07:21
had been given a dose or an overdose of
00:07:23
flux rule in the recent past
00:07:26
flexural is a prescription drug used to
00:07:29
relieve muscle spasms
00:07:31
but when taken in excess it can have the
00:07:34
opposite effect
00:07:36
one of the unusual side effects would be
00:07:39
a rigidity of the muscles in a sense as
00:07:42
if every muscle in the body was was
00:07:44
tensed up or held rigid
00:07:47
this explains why
00:07:49
catherine harms was cold and somewhat
00:07:51
rigid when the hotel clerk carried her
00:07:54
out to marine malloy's car
00:07:57
without additional evidence the case was
00:08:00
turning cold
00:08:01
until police got a break
00:08:03
from an unlikely place
00:08:07
a woman living two thousand miles away
00:08:09
in seattle washington called police
00:08:11
because she had seen the article about
00:08:14
the murder in the anchorage newspaper
00:08:17
it was one of a number of items in a
00:08:19
package mailed to her from a friend in
00:08:22
anchorage she said she had received a
00:08:24
box of cardboard box from
00:08:27
marine malloy
00:08:29
[Music]
00:08:30
inside the box
00:08:32
were katherine harm's driver's license
00:08:36
the newspaper article some jewelry
00:08:39
a knife
00:08:40
and this handwritten note
00:08:42
hey woman
00:08:44
please burn all the contents of this box
00:08:46
this is very important many lives are on
00:08:48
the line
00:08:50
this would be a great favor and in all
00:08:52
the world i trust only you
00:08:54
the woman from seattle told me
00:08:56
she wanted nothing to do with this but
00:08:58
she didn't feel right about it and so
00:08:59
she thought she better call the police
00:09:02
the knife appeared to be clean
00:09:07
investigators wanted to know
00:09:09
whether this was the weapon used to kill
00:09:12
katherine harms
00:09:16
[Music]
00:09:19
the package of items marine malloy
00:09:21
mailed to seattle
00:09:23
was sent to the forensic lab for testing
00:09:27
malloy's note asked her friend to
00:09:29
destroy
00:09:31
all of the contents
00:09:33
forensic experts confirmed that
00:09:36
maureen's fingerprints were on the
00:09:38
document
00:09:40
what we were interested in was the knife
00:09:42
it was a folding buck type knife
00:09:44
and we knew from the autopsy that the
00:09:47
injuries would be consistent with the
00:09:49
knife
00:09:51
to see if the knife blade contained
00:09:53
anything of evidentiary value
00:09:56
investigators sent it to a forensic tool
00:09:59
mark analyst
00:10:00
the microscopic fine marks on each knife
00:10:03
blade are random in nature they're a
00:10:05
function of when the last time the knife
00:10:07
blade was sharpened the irregularities
00:10:09
in a knife blade are going to be
00:10:11
different in this knife even compared to
00:10:13
the next knife blade that was made at
00:10:15
the factory on the assembly line
00:10:18
robert shem was confident he could find
00:10:21
unique marks on the knife but
00:10:23
he had nothing to compare it to
00:10:27
then shem learned that the medical
00:10:29
examiner dr thompson had done something
00:10:32
unusual during the autopsy
00:10:36
instead of documenting the fatal wound
00:10:38
by photography
00:10:40
dr thompson actually excised the section
00:10:43
of the rib cage where the wound occurred
00:10:47
well i believe dr thompson went beyond
00:10:49
the call of duty i think it's because as
00:10:52
a younger newer pathologist in the field
00:10:55
he's much more progressive and much more
00:10:56
open to new ideas
00:10:59
the costal cartilage at the end of one
00:11:01
rib
00:11:02
clearly showed the stab wound
00:11:05
the costal cartilage is very much like a
00:11:08
low density plastic in that it cuts
00:11:12
readily and when it cuts it has the
00:11:14
consistency such that it can take the
00:11:15
tool marks quite well surprisingly well
00:11:18
shem used a substance called microsill a
00:11:22
rubbery material that takes the shape of
00:11:25
anything to which it's applied
00:11:27
used by toolbox examiners to preserve
00:11:29
the very fine details that you'll see
00:11:31
impressed and striated tool marks so
00:11:34
what we need is a material that will
00:11:35
flow very well into the tool mark and
00:11:37
then harden in a short period of time so
00:11:39
that we can do comparisons of these very
00:11:40
fine marks
00:11:42
after the microcell hardened shem peeled
00:11:46
it from the rib
00:11:47
[Music]
00:11:48
the question now was whether these marks
00:11:50
were good enough to match the suspected
00:11:52
murder weapon
00:11:54
to find out
00:11:55
shem took the knife and pressed it down
00:11:58
into a hard piece of plastic
00:12:00
this transferred the tool marks from the
00:12:02
suspected murder weapon to the plastic
00:12:05
surface
00:12:06
in this case here it was important to
00:12:07
find the exact angle at which the knife
00:12:10
was used and then to replicate that
00:12:11
angle into plastic and then do that
00:12:13
comparison
00:12:15
the process with the microsill was
00:12:17
repeated
00:12:18
this time along the newly cut surface of
00:12:21
the plastic block
00:12:24
when the mold was peeled away
00:12:26
shem wanted to see if it could be
00:12:28
matched to the marks taken from the
00:12:30
wound
00:12:32
so he placed both of the microsill molds
00:12:35
under a comparison microscope
00:12:39
at 50 times magnification
00:12:42
he was able to look at them side by side
00:12:46
the tool marks from the wound and marine
00:12:48
malloy's knife
00:12:50
were identical in this particular case
00:12:53
the identification was pretty compelling
00:12:55
plus
00:12:56
being a born skeptic i find the concept
00:12:59
of matching a tool that is a knife back
00:13:02
to a piece of the human body to be
00:13:05
pretty incredible bob shem gave me a
00:13:07
photograph
00:13:08
of what he saw in his comparison
00:13:10
microscope and that was probably
00:13:12
one of the most powerful pieces of
00:13:15
evidence i've ever presented in a
00:13:16
courtroom
00:13:18
investigators found even more evidence
00:13:21
inside maureen malloy's car
00:13:24
they saw a very small smear of dried
00:13:28
blood near the ignition switch area of
00:13:30
course that was swabbed and those swabs
00:13:33
were sent to the state crime lab for dna
00:13:35
analysis those tests revealed that the
00:13:37
blood on the ignition switch in molay's
00:13:39
car was in fact catherine harm's blood
00:13:43
and they also found evidence in one of
00:13:46
marines jackets
00:13:48
inside right puck there was
00:13:50
blood stains that blood turned out to be
00:13:53
catherine harm's blood the stains
00:13:57
were comparable to the dimensions of the
00:14:00
knife that we seized in the box
00:14:03
maureen malloy was arrested and charged
00:14:06
with first degree murder
00:14:09
the question haunting prosecutors now
00:14:11
was
00:14:12
what was the motive
00:14:15
[Music]
00:14:20
denied any involvement in catherine
00:14:22
harm's murder
00:14:23
[Music]
00:14:27
there's nothing about a knife in the
00:14:29
note i didn't know about any knife
00:14:32
she refused to talk about the knife
00:14:35
she wouldn't say she owned it she didn't
00:14:37
own it she wouldn't say anything you
00:14:39
could look a lot better than you doing
00:14:40
she was baiting you she was [ __ ] with
00:14:43
you for days and days and days and
00:14:44
you've got your kids
00:14:46
you've got people to think about
00:14:48
and you just lost it
00:14:52
that's what happened
00:14:54
i mean we're all we're all adults here
00:14:56
we can read the writing on the wall
00:14:58
that's what's happened louise
00:15:00
now let's just stand tall let's just
00:15:02
tell it how it happened
00:15:04
let's don't come across like the
00:15:05
cold-blooded [ __ ] that you look like
00:15:07
you are now but uh i know you're not
00:15:10
don't tell me i don't care about my kids
00:15:12
without i just care about myself just
00:15:14
tell me what happened tell me why you
00:15:16
did what you did
00:15:17
they go back and forth and back and
00:15:19
forth and it turns out that moy never
00:15:21
comes off her story finally
00:15:24
i asked her about the knife
00:15:26
and the tool marks on the knife
00:15:28
exactly matching the bone in the chest
00:15:31
of my victim
00:15:32
and at that time she said she didn't
00:15:33
want to talk anymore
00:15:35
she wanted to see a lawyer
00:15:38
but prosecutors wondered
00:15:40
why malloy would kill katherine harms
00:15:45
carrie rundle who was at one time
00:15:47
malloy's roommate told police that
00:15:49
maureen had stolen a sizeable gun
00:15:52
collection and planned to sell it and
00:15:54
live off of the proceeds
00:15:57
she also said that malloy feared
00:15:59
catherine would expose her plans to the
00:16:01
police
00:16:06
rundle said
00:16:07
she saw malloy put the drug flexoril in
00:16:11
katherine's food
00:16:12
thinking it would relax catherine and
00:16:14
get her to talk
00:16:18
maureen malloy thought she was a stitch
00:16:21
i believe the violence occurred when she
00:16:23
was trying to get catherine harms to
00:16:25
tell her who she had told and what she
00:16:27
had told me
00:16:31
i think at a certain point though the
00:16:32
violence had been so excessive
00:16:35
that marine realized
00:16:37
she couldn't let catherine go
00:16:39
the toxicology evidence shows that
00:16:42
catherine had been given an excessive
00:16:44
amount of flexural which stiffened her
00:16:47
muscles and caused the rigidity
00:16:50
described by the hotel clerk
00:16:55
prosecutors believe
00:16:56
malloy drove catherine to the park
00:16:59
dumped her body
00:17:01
then stabbed her to death while she was
00:17:03
unconscious
00:17:07
malloy then put the bloody knife in her
00:17:10
coat pocket
00:17:11
leaving both katherine's dna
00:17:14
and the impression of the murder weapon
00:17:18
malloy also left a tiny spot of
00:17:20
catherine's blood inside her car
00:17:22
[Music]
00:17:27
the forensic evidence proved
00:17:29
that it was malloy's knife and no other
00:17:33
that left the distinctive tool marks on
00:17:36
katherine's rib
00:17:38
i really don't believe that maureen
00:17:39
malloy thought that the police
00:17:41
department the crime lab the medical
00:17:43
examiner's office would join together to
00:17:45
create a team that would solve this
00:17:46
crime i think that marine malloy figured
00:17:48
nobody would spend this kind of effort
00:17:50
you told him
00:17:52
maureen malloy denied everything
00:17:55
and took the stand in her own
00:17:57
[Music]
00:17:59
i defense there
00:18:00
who killed kathryn hart
00:18:04
she claimed that members of the local
00:18:06
hells angels motorcycle gang killed
00:18:08
catherine and planted the evidence to
00:18:10
frame her
00:18:12
and i did not do that to her and they
00:18:14
would do and say anything to discredit
00:18:16
me to cover for what they did in that
00:18:19
room in closing argument in front of the
00:18:21
jury i took the knife the murder one
00:18:24
i took maureen molloy's leather jacket
00:18:27
and i pulled out the pocket lining
00:18:29
i took the knife and put it right on top
00:18:32
of the area where the crime lab had
00:18:35
snipped the two fabric areas and the
00:18:37
knife fit right between those two areas
00:18:41
like a glove
00:18:43
i argued that the murder weapon was in
00:18:45
her pocket when it had liquid blood on
00:18:47
it
00:18:49
the forensic science in this case
00:18:52
was unique
00:18:54
only once or twice before
00:18:56
had scientists been able to match the
00:18:58
stab wound to the specific knife with
00:19:01
this type of analysis
00:19:04
looking at ribcages and for tulmar
00:19:06
comparison is is a pretty rare
00:19:08
examination for the examiner in the
00:19:10
laboratory because it's rare that we're
00:19:11
going to have the conditions where we
00:19:13
have
00:19:14
both the ribs that are cut that have a
00:19:16
decent tool mark on them and have a need
00:19:18
to compare a knife to it
00:19:20
maureen malloy was found guilty
00:19:23
and sentenced to 159 years in prison
00:19:28
i absolutely hate you
00:19:30
you worthless piece of flesh if you ever
00:19:32
try to get out i will be there as your
00:19:34
constant reminder and i will remind the
00:19:37
state of alaska the atrocities that you
00:19:39
have committed against my sister
00:19:41
i covered a lot of murder trials and
00:19:44
this one stuck with me for a long time
00:19:46
because
00:19:46
it just never made any sense and
00:19:49
at the end of it i felt that i didn't
00:19:52
know the whole story and i clearly
00:19:53
remember the judge at sentencing saying
00:19:55
that she did not feel that she could
00:19:58
understand
00:19:59
the motive for
00:20:01
for the murder
00:20:04
jurors later told reporters that the
00:20:06
tool mark comparison was exceptionally
00:20:09
compelling
00:20:11
knowledge is power forensic science puts
00:20:15
power in the hands of the investigators
00:20:17
and it gives them the power to know the
00:20:20
difference between what is definitely
00:20:22
true and what they only think is true
00:20:26
the forensic science
00:20:28
in this case
00:20:29
specifically
00:20:32
the matching of the tool marks between
00:20:34
the knife blade
00:20:35
and the chest sternum bone of the victim
00:20:39
is invaluable that made the case
00:20:42
well in this case forensic science was
00:20:44
absolutely key again this is a case with
00:20:46
no eye witnesses and yet
00:20:50
a prosecutor can go to the jury and say
00:20:52
listen ladies and gentlemen
00:20:54
witnesses
00:20:55
people lie
00:20:57
science doesn't
00:20:59
and in this case the scientific evidence
00:21:01
was irrefutable
