Unsolved Mysteries with Robert Stack - Season 8, Episode 19 - Full Episode

May 23, 2019 / 46:09

This episode of Unsolved Mysteries covers the mysterious death of Shelley Malone, the lightning strike survival of Robert Davidson, and the assassination of Senator Robert Kennedy.

In the case of Shelley Malone, her family believes she was murdered after a riding accident, while authorities ruled it an accident. Witnesses, including her boyfriend and friends, provided conflicting accounts of the incident, raising suspicions about foul play.

Robert Davidson's story involves a lightning strike while riding his motorcycle. He survived against all odds, with some attributing his recovery to a mysterious woman in black who appeared during the incident. Eyewitnesses reported strange occurrences, including the ambulance losing power, which some believe indicates a miraculous intervention.

The episode also revisits the assassination of Senator Robert Kennedy, featuring Scott Enya, a young photographer who claims to have taken photos during the shooting. His negatives mysteriously disappeared, leading to speculation about a cover-up and conspiracy theories surrounding the event.

Throughout the episode, viewers are encouraged to consider the unresolved questions surrounding these cases, including the possibility of murder in Malone's death and the truth behind Davidson's miraculous survival.

TL;DR

which many believe is still unsolved a

00:02:29

00:02:30
swept away in a hail of gunfire
00:02:33
the accused assassin was a young
00:02:35
Palestinian national named Sirhan Sirhan
00:02:38
[Music]
00:02:41
the years since had been marked by
00:02:43
heated controversy many people question
00:02:46
whether Sirhan acted alone whether a
00:02:48
second gunman was involved the debate
00:02:52
has been fueled by the belief that there
00:02:53
was no visual record of the precise
00:02:55
moment the senator was gunned down now
00:02:58
that assumption has been shattered
00:03:00
there's no film of it there's no
00:03:03
videotape of it there is an audio
00:03:05
recording from a radio reporter and
00:03:06
there are my black-and-white photographs
00:03:08
and that's it
00:03:11
Scott inn-yard says this is a photograph
00:03:14
of him taken in the pantry of the
00:03:15
Ambassador Hotel Scott claims that if
00:03:18
the instant senator Kennedy was shot he
00:03:21
was taking pictures
00:03:24
or as most puzzling a bus gotten yards a
00:03:27
remarkable story that no one can find
00:03:29
the bulk of his photographs or any of
00:03:31
the negatives any art claims he shot
00:03:34
three rolls of film that night the
00:03:36
authorities however maintained the two
00:03:38
of those rolls never existed when
00:03:44
Senator Kennedy gave his victory speech
00:03:46
fifteen-year-old Scott in yarn was just
00:03:49
a few feet from the stage shooting
00:03:51
photographs for his high school
00:03:52
newspaper these are summer scott's
00:03:55
pictures he took his first roller film
00:03:57
before kennedy mounted the podium Scott
00:04:00
says he loaded a second roll just as a
00:04:02
senator began to speak as a speech
00:04:10
concluded Scott says he joined those who
00:04:12
followed Kennedy from the stage after
00:04:16
leaving the bone senator Kennedy headed
00:04:19
down a coder which led to the pantry
00:04:21
there he stopped to shake hands with the
00:04:24
kitchen workers when he stopped I was
00:04:27
about 10 12 feet behind him there was an
00:04:30
open wedge which had been made by the
00:04:31
two people on either side of him so I
00:04:33
had a clear view of him it's at this
00:04:35
point that I brought my camera up and
00:04:37
started taking pictures suddenly
00:04:39
gunshots regular now I was behind Robert
00:04:43
F Kennedy Sirhan Sirhan was in front of
00:04:46
Kennedy so I did not see Sirhan all I
00:04:48
saw was Kennedy twist and fall
00:04:53
I moved back and jumped up on a steam
00:04:56
table and I took some pictures over
00:04:59
where the dog pile on Sirhan was taking
00:05:01
place his hand was sticking out with the
00:05:03
gun in it but I couldn't really see what
00:05:05
was taking place there because so many
00:05:07
people that crowded in at that point a
00:05:14
few moments later Scott Ian York
00:05:17
returned to the ballroom where
00:05:18
pandemonium had broken out at that time
00:05:21
Scott says he loaded and clicked off his
00:05:23
third roll of film
00:05:31
I noticed two men in suits they were
00:05:35
looking at me rather strangely and I
00:05:38
moved a few steps and they moved a few
00:05:39
steps not knowing who's a terrorist
00:05:42
who's an assassin and who's the police I
00:05:45
took off
00:05:49
[Applause]
00:05:51
[Music]
00:06:02
they went through my pockets and took
00:06:04
all three rolls of the film they took
00:06:07
camera of course and it's at that point
00:06:10
I realized these are detectives and I'm
00:06:13
with the good guys at around 3 a.m.
00:06:16
Scott was taken to rampart station in
00:06:18
downtown Los Angeles well I'm not
00:06:26
exactly sure
00:06:30
Scott was questioned for about 20
00:06:32
minutes this was an actual recording of
00:06:34
the interrogation so the table here
00:06:37
about three 1/2 feet tall so I got up on
00:06:40
it so I was above everyone and I and the
00:06:43
takers and then this shot started
00:06:44
b5 I took pictures and kept taking
00:06:47
pictures I shot for him for all the
00:06:49
shots with in fact maybe a little
00:06:52
afterwards I'm not exactly sure I could
00:06:55
tell I can only tell by the pictures
00:06:58
Scotland Yard had become a small part of
00:07:00
history
00:07:01
six months later Sirhan Sirhan was
00:07:04
sentenced to life in prison for the
00:07:05
murder of Robert Kennedy a court order
00:07:08
that all files from the case including
00:07:10
Scott's photographs be sealed for 20
00:07:12
years
00:07:15
Scott waited by 1988 he was an
00:07:18
established photographer Scott wrote to
00:07:21
the LAPD requesting that they return his
00:07:23
film five months later Scott received a
00:07:27
letter from the California State
00:07:28
Archives which stated that his
00:07:30
photographs could not be found the
00:07:33
conclusion was that the pictures had
00:07:35
been quote destroyed by LAPD in August
00:07:38
1968 Scott immediately filed a lawsuit
00:07:42
against the police
00:07:43
this time he waited eight years top LAPD
00:07:47
detectives who were assigned to work
00:07:49
with our attorneys in preparation for
00:07:52
this lawsuit naturally if we could find
00:07:54
what Scott was looking for we thought
00:07:56
that that would make the lawsuit go away
00:07:57
and it was just some good detective work
00:08:00
and looking in places where people
00:08:02
hadn't looked before that found up in
00:08:05
Sacramento found that booked under a
00:08:07
different name was a was a sheet of
00:08:10
negatives
00:08:11
that had already been cut and put into
00:08:14
plastic sleeves a few weeks later the
00:08:18
city attorneys presented Scot with a
00:08:19
proof sheet made from those negatives
00:08:21
Scot immediately became suspicious the
00:08:25
proof showed only one roll of film the
00:08:27
stock was Ilford a SI 125 Scott claims
00:08:31
he shot three wrongs that were Triax a
00:08:33
SI 400 manufactured by Kodak basically
00:08:38
what I believe the police did was they
00:08:40
took roll number two which showed the
00:08:42
speech and they used part of that in
00:08:45
this proof sheet and then they use roll
00:08:46
number three which was once I returned
00:08:48
to the ballroom afterward where you see
00:08:51
the aftermath and some of the victims
00:08:52
and things and they just put them
00:08:54
together as a proof sheet and expected
00:08:58
that they could pass that office being
00:09:00
all the film that I shot that role is a
00:09:03
continuous roll of film shows pictures
00:09:05
before mr. Kennedy speaks pictures of
00:09:09
Robert F Kennedy speaking to the
00:09:11
audience and then pictures of the
00:09:13
aftermath of the shooting there are no
00:09:16
photographs in the pantry our position
00:09:18
is that mr. Angier did not make it into
00:09:21
the pantry and did not take photographs
00:09:22
inside the pantry
00:09:24
then in 1991 a book came out that
00:09:28
contained a number of previously
00:09:29
unpublished photographs this one was
00:09:31
taken in the pantry a few moments after
00:09:34
senator Kennedy was gunned down Scott
00:09:37
Ian Yard swears that he is the young man
00:09:39
standing on a table with camera in hand
00:09:41
just as he told detectives on the night
00:09:43
of his interrogation
00:09:48
I don't know who that person is for sure
00:09:50
but we don't believe that that's Scott
00:09:52
in here I I think it's just a
00:09:54
coincidence that he you know says that
00:09:56
he was standing on a table and there's
00:09:58
somebody standing on a table in the
00:09:59
picture we don't think that's him Scott
00:10:03
in York continued to press his case
00:10:05
against the LAPD in January of 1996 a
00:10:09
City Attorney's Office hired a private
00:10:11
courier to transport the negatives in
00:10:13
question from the archives in Sacramento
00:10:15
to Los Angeles once there the courier
00:10:22
rented a car to drive from the airport
00:10:24
to the downtown courthouse about 20
00:10:26
miles away
00:10:30
[Music]
00:10:37
soon after leaving the airport the
00:10:39
courier was forced to pull into a
00:10:41
service station his right rear tire was
00:10:43
flat
00:10:44
apparently slashed by a knife sometime
00:10:53
during the next ten minutes the
00:10:55
briefcase containing the negatives was
00:10:57
stolen I was with my attorneys when we
00:11:01
when we learned this and we were just
00:11:03
absolutely shocked I mean we were for
00:11:07
some reason we weren't surprised but we
00:11:09
were just truly shocked I couldn't
00:11:12
believe it happened it but if I was a
00:11:15
conspiracy theorist
00:11:17
I'd say see there's further proof now
00:11:20
we'll never know the entered photos if
00:11:23
he captured the actual shooting would be
00:11:26
the only photographic record that we
00:11:27
have if those any encana Diaz he was
00:11:32
falling it could be the whole case it
00:11:34
could tell us everything we want to know
00:11:36
about what happened
00:11:37
[Music]
00:12:00
next in the aftermath of a violent storm
00:12:04
a young man finds himself in desperate
00:12:06
need of a miracle and later but an
00:12:10
experienced horsewoman dies in a freak
00:12:12
riding accident
00:12:13
her family suspicions lead them to a
00:12:16
stunning conclusion
00:12:19
[Music]
00:12:25
[Music]
00:12:32
good fortune can quickly turn back
00:12:35
swiftest thunderclouds can sweep a
00:12:37
summer sky no one knows this better than
00:12:40
Robert Davidson 16 years ago in June of
00:12:43
1980 Davison was barreling down AI 74
00:12:47
near Acton Indiana as a rain storm
00:12:49
whipped up around me
00:12:51
Davidson's luck suddenly changed for the
00:12:53
worse when you're driving 60 65 mile an
00:12:57
hour on a motorcycle and raindrops hit
00:13:00
you it's really pretty
00:13:03
stinging it hurts and I thought I better
00:13:08
pull over and get my rain jacket out of
00:13:10
the trunk I had one foot on the ground
00:13:12
and that's the last thing I can remember
00:13:18
[Music]
00:13:23
it was a direct hit more than 200,000
00:13:27
volts of electricity 38 year old Robert
00:13:30
Davison should have died right then and
00:13:31
there yet Davison is still very much
00:13:34
with us today at the age of 54 some say
00:13:37
his survival was just another shift in
00:13:39
the winds of fortune nothing more than a
00:13:41
stroke of luck
00:13:42
but others including Davis and himself
00:13:45
called it a miracle personally delivered
00:13:48
by a Messenger of God within minutes of
00:13:54
the lightning strike emergency crews
00:13:56
were on the scene from the start it
00:13:59
appeared their efforts would be in vain
00:14:02
clinically he should have been dead by
00:14:05
the color of his skin and when we
00:14:07
arrived there was no blood pressure no
00:14:09
pulse basically he had no chance at all
00:14:17
according to several witnesses events at
00:14:20
the scene suddenly swerved towards a
00:14:22
supernatural first every power circuit
00:14:25
and the ambulance inexplicably failed
00:14:34
and the engine shut down the lights
00:14:36
turned off and it was without power
00:14:38
completely we got dual batteries one
00:14:43
battery would go down everyone take over
00:14:44
and there's no way they could have both
00:14:48
gone down at the same time it was an
00:14:50
eerie feeling I mean you could just it
00:14:53
felt strange and as they were doing the
00:14:55
CPR you heard this woman coming up
00:14:58
yelling I need to touch him I need to
00:15:00
touch and just let me touch him nobody
00:15:06
knew her name or where she came from
00:15:08
later they would refer to her reverently
00:15:10
as the lady in black she just kept again
00:15:16
and again again you know I can save his
00:15:18
life of course you know at that point in
00:15:19
time I kind of thought well maybe this
00:15:21
is just one of the people so to speak
00:15:23
left over from the 70s you know but I
00:15:27
said you don't let her do what she needs
00:15:29
to do you know what can it hurt
00:15:40
[Music]
00:15:41
she was dressed in the late 1800 dress
00:15:45
your basic black dress very very old
00:15:49
fashioned
00:15:49
she had the old-fashioned black shoes
00:15:52
that went with it and carried her little
00:15:55
black Bible then she raised the Bible to
00:15:58
the sky and started speaking in tongue
00:16:01
which was something I didn't understand
00:16:04
but I'm sure somebody out there did we
00:16:13
could just feel all the time that she
00:16:15
was saying it's just chills from head to
00:16:18
toe it was like just a tremendous amount
00:16:20
of energy
00:16:25
[Music]
00:16:28
when she was finished she looked at me
00:16:31
smiled and got up walked away probably
00:16:35
five seconds had passed by in a turn to
00:16:38
look the direction where she had left
00:16:40
and there was nobody to be found
00:16:43
accounts from that day couldn't be more
00:16:45
contradictory some eyewitnesses
00:16:48
including two of the paramedics insist
00:16:50
that the mysterious woman was never
00:16:52
there I don't know why they couldn't see
00:16:55
her really because it was plain as day
00:16:57
to me as plain as day to Randy you know
00:17:00
why couldn't anyone else see her or hear
00:17:01
her there is no doubt in my mind that
00:17:04
she was there I believe there was a
00:17:08
power they actually shut the vehicle
00:17:10
down a surge which just obliterated the
00:17:14
vehicles power supply and shut it down
00:17:16
when this woman walked by according to
00:17:20
those who saw the lady in black her
00:17:22
departure triggered another chain of
00:17:24
uncanny events first the ambulance came
00:17:27
back to life then I've got it I've got a
00:17:31
pulse
00:17:31
it almost bursts my eardrums but it was
00:17:34
a welcome to hear that first heartbeat
00:17:37
and I yelled again I think everybody
00:17:40
could have heard me down the interstate
00:17:42
because I was so happy that we was
00:17:44
getting some vital signs
00:17:45
[Music]
00:17:47
Davison had a heartbeat but his life was
00:17:50
still hanging by a thread
00:17:51
the ER physician was not optimistic my
00:17:56
prognosis was that he would not come out
00:17:58
of his coma and I expected him to remain
00:18:02
in permanent coma and ultimately suffer
00:18:05
complications and ultimately die for
00:18:09
nearly two months Robert Davidson was
00:18:11
more dead than alive then one day he
00:18:14
simply woke up and presumed his length
00:18:17
when I came out of the coma I looked
00:18:20
around and I couldn't figure out what I
00:18:23
was doing in the hospital because I had
00:18:28
no memory of anything happening to me
00:18:30
that would put me in the hospital when
00:18:34
it became apparent that he indeed woke
00:18:37
up and not only woke up but was talking
00:18:42
and walking it I was utterly amazed
00:18:49
Davidson's astounding recovery has
00:18:51
prompted speculation that the woman in
00:18:53
black was far more than a simple
00:18:54
passerby some believed her to be a
00:18:57
divine spirit that rose up from
00:18:59
Indiana's fervid religious past just
00:19:06
down the road from her Davison was
00:19:08
struck by lightning lies this quiet
00:19:09
meadow it is a site of a 19th century
00:19:12
spiritual retreat known as Acton
00:19:15
campground more than a hundred years ago
00:19:20
this spot rang out with fiery sermons
00:19:22
gospel hymns and the strange music of
00:19:25
the faithful speaking in tongues
00:19:27
[Music]
00:19:30
most of Acton campground burned down in
00:19:33
1905 but a few artifacts castilho found
00:19:36
at a local museum there among the relics
00:19:39
of a long vanished era is a vintage
00:19:41
dress unmistakably reminiscent of the
00:19:45
lady in black I believe that this woman
00:19:50
maybe had been asked her Reverend or a
00:19:53
priestess or whatever in her life prior
00:19:57
and when she passed on she was brought
00:20:01
in to I guess guardian angel form I know
00:20:07
I witnessed a miracle there's just no
00:20:11
other words to say it it was a miracle
00:20:17
many will argue that Robert Davidson's
00:20:20
life was saved by quick treatment and a
00:20:21
measure of good luck but others believe
00:20:24
just as firmly that the spirits of Acton
00:20:27
campground were awakened that one of
00:20:29
them came to Davidson's rescue I've
00:20:33
always kind of believed in angels that
00:20:36
everybody has a guardian angel but most
00:20:40
people will never get to see em or have
00:20:43
them really do anything for them
00:20:45
I think my angel was doing her job that
00:20:49
day coming up controversy rocks a
00:20:58
wealthy enclave in Virginia after a
00:21:00
beautiful young woman dies under
00:21:02
mysterious circumstances
00:21:04
but first Timothy Combs bills himself as
00:21:08
a servant of God and a defender of
00:21:10
freedom but the police say he's a
00:21:12
dangerous criminal
00:21:13
perhaps capable of murder

00:21:30
September 16th 1994 Anderson Missouri a
00:21:34
lone hunter cautiously makes his way
00:21:37
through the woods stalking waiting for
00:21:41
just the right moment to strike
00:21:43
but his prey is not what you would
00:21:45
expect the target this night is a
00:21:48
Missouri State Highway patrolman and the
00:21:51
hunter is not your everyday outdoorsman
00:21:53
according to the police his name is
00:21:55
Timothy Collins and he calls himself a
00:21:58
free man they exist on the farthest
00:22:06
right fringe of the political spectrum
00:22:08
they believe they are the true Americans
00:22:11
but others call them domestic terrorists
00:22:13
the rallying cries are Waco Ruby Ridge
00:22:16
and now justice Township in Montana the
00:22:19
freemen are a loose knit Brotherhood
00:22:21
bound by what some say is a pathological
00:22:23
mistrust of the United States government
00:22:26
mr. Thomas in late November of last year
00:22:29
did a couple from Kansas City call on
00:22:31
you at your home or place of business
00:22:33
what was the purpose of that visit this
00:22:36
is a recreation of a so-called common
00:22:38
law court most Freeman no longer
00:22:41
acknowledged the authority of our legal
00:22:43
system and see common law courts as a
00:22:45
way to circumvent the government what
00:22:48
was it the sheriff wanted to talk to you
00:22:49
about he wanted to know if I had a tax
00:22:52
ID number how long I've been working out
00:22:55
of my home and had I paid state sales
00:22:57
tax state sales tax yes he wanted you to
00:23:00
pay state sales tax on items that you
00:23:02
made in your own home that's right
00:23:04
the common law courts now that are being
00:23:07
formed or by citizens of the counties
00:23:10
and they are tired of being jerked
00:23:11
around in the state courts and not
00:23:13
having the rights protected within these
00:23:14
courts the common law courts are
00:23:17
predicated upon freemen using their
00:23:21
right to determine issues of law Robert
00:23:24
jokes the self-styled minister is asked
00:23:26
to be filmed in silhouette due to his
00:23:28
religious convictions
00:23:30
this is a photograph of Joe's taken in
00:23:33
1995 he is one of the area's leading
00:23:36
advocates of the free man movement the
00:23:39
Freeman or super Patriots are patriots
00:23:41
or Christian patriots believe that the
00:23:45
Constitution is a divinely inspired
00:23:47
document along with the Bill of Rights
00:23:49
that gives them preeminent rights in
00:23:51
American society that they do not have
00:23:55
to do things like pay income taxes or
00:23:57
have driver's licenses and so forth
00:23:59
because that's all part of the laws that
00:24:01
were passed after the Constitution and
00:24:04
the Bill of Rights they see these as
00:24:05
man-made laws that don't apply to them
00:24:09
in the case of Robert Jo's that
00:24:11
philosophy apparently led him to issue
00:24:13
faked legal documents in 1985 he was
00:24:17
convicted of drafting a bogus court
00:24:19
order in the case of a parishioner who'd
00:24:21
been arrested for a minor traffic
00:24:23
offense for nine years
00:24:27
jost laid low on his farm while he
00:24:29
contested the conviction but in June of
00:24:32
1994 the new prosecuting attorney from
00:24:35
McDonald County Missouri ordered the
00:24:37
Highway Patrol to bring Jos in mr. Jose
00:24:44
has a history of resisting arrest and to
00:24:47
avoid an armed confrontation on his
00:24:49
property where he's believed to have a
00:24:50
large number of weapons decision was
00:24:53
made to arrest him on a county road
00:24:54
where he's by himself
00:24:58
jost drove right into a trap sergeant
00:25:02
Steve Dorsey and corporal Bob Harper
00:25:04
were waiting
00:25:07
[Applause]
00:25:15
[Applause]
00:25:18
I knew Jose from several years back and
00:25:23
he had never calls me any problems by
00:25:28
some accounts this day would be
00:25:30
different I walked up the van him
00:25:34
screaming all think you're dealing with
00:25:36
someone that had a mental problem
00:25:38
maybe screaming hollering and just
00:25:40
Tony's hands up and saying who are you
00:25:43
who are you I knew if they were gonna
00:26:01
kill me they were gonna kill me it
00:26:02
wasn't anything I could do except pray
00:26:03
to God and that's what I was doing and I
00:26:07
knew they had the rifle cause of arrest
00:26:08
and they and as it turns out they didn't
00:26:10
have any that's why they had to make up
00:26:12
the story about resisting arrest and a
00:26:13
concealed weapon after they arrest me so
00:26:15
they had some reason to hold me Smith
00:26:18
Robert Joseph was taken to McDonald
00:26:21
County Jail where he remains to this day
00:26:22
a waiting trial unable to raise bail
00:26:26
according to the authorities his
00:26:28
confinement precipitated the disturbing
00:26:30
events that followed
00:26:31
[Music]
00:26:34
three months after jos was captured one
00:26:37
of the arresting officers corporal bob
00:26:39
harper was home celebrating his 33rd
00:26:41
wedding anniversary
00:26:50
[Music]
00:26:57
I heard this loud shot and I ran up the
00:27:02
hallway and mob was laying next to the
00:27:05
cabinet and he was trying to tell me
00:27:07
that the candidate exploded and I
00:27:10
explained to him that he had been shot
00:27:12
call the sheriff it was only by a
00:27:18
miracle that Bob Harper survived the
00:27:21
bullet pierced his rib cage after missed
00:27:23
his heart by just 1/16 of an inch the
00:27:29
next day investigators clustered around
00:27:32
a grove of trees 245 feet from Harper's
00:27:35
kitchen window it wasn't long before
00:27:40
they found what they were looking for
00:27:42
looks like 70 warm 16 maybe Bob Harper
00:27:48
was not known to have any enemies and
00:27:51
because of his recent involvement in the
00:27:53
arrest of Robert Jos we felt that it was
00:27:56
probably connected a few days later
00:28:01
officers were dispatched to the Jos farm
00:28:04
to speak with Robert Josas girlfriend
00:28:07
they were confronted by an armed
00:28:09
strength we need to talk to Annie he
00:28:21
demanded that we stay where we were and
00:28:23
he said that he would go get her we felt
00:28:28
uncomfortable staying there so we
00:28:30
retreated to her patrol cars and about
00:28:32
ten minutes later he returned and
00:28:33
started shouting at us and we
00:28:36
subsequently had a about a 30-minute
00:28:37
conversationally right here with the
00:28:40
citizens of kingdom oppressed we got our
00:28:41
elders the man identified himself as
00:28:44
James Wilson according to the police he
00:28:47
began to spot wild religious rhetoric
00:28:49
unlike anything they had ever heard
00:28:52
metallus you say that the state elders
00:28:55
are training people to carry out violent
00:28:57
acts for violations against the church
00:28:58
well sure we've got snipers right now
00:29:01
being trained by the state elders to to
00:29:03
help us you know it's it's the law it
00:29:05
says it in the Bible
00:29:06
it's God's law right here in Colossians
00:29:08
1:13 you can read about it for yourself
00:29:10
how many
00:29:10
in that violent faction we didn't feel
00:29:13
comfortable with what we had heard from
00:29:15
him so the following morning calls were
00:29:17
made to Arkansas and we received a large
00:29:21
amount of information about James Wilson
00:29:22
found out at that time that his real
00:29:24
name was Timothy Combs Timothy Combs had
00:29:28
served time in prison on various weapons
00:29:30
charges by the time police secured a
00:29:33
search warrant for the Jos farm
00:29:35
combs had vanished however investigators
00:29:39
did uncover an impressive arsenal
00:29:41
pistols rifles and more than 40 sticks
00:29:45
of dynamite that same day in Arkansas
00:29:50
Combs's next-door neighbor gave
00:29:52
investigators a bullet that had struck
00:29:54
his horses rear flank can you show me
00:29:56
the location of the shooter sure is my
00:29:58
neighbor he's up this direction a man
00:29:59
suspected it had been fired by cones who
00:30:02
often took target practice nearby you
00:30:05
see the machine shed there and in the
00:30:06
tree to the right he's about midway in
00:30:08
between back in that brush according to
00:30:10
the authorities a thorough search of
00:30:12
Combs's property turned up the
00:30:14
incriminating evidence shell casings
00:30:21
that reportedly matched the casing found
00:30:23
outside of Bob Harper's kitchen window
00:30:27
police suspect the trail leads not just
00:30:30
to Timothy combs at the Robert Jo's we
00:30:34
believe that there is collaboration
00:30:36
between Jos and Timothy combs we believe
00:30:41
that the weapon used to see Bob Harper
00:30:43
was actually an SKS rifle that had been
00:30:46
purchased by Robert Joseph at the Greeks
00:30:48
prior to his arrest for resisting arrest
00:30:51
he will now not talk about that weapon
00:30:55
Robert Joseph ain't Eanes that he had
00:30:57
nothing to do with the attack on Bob
00:30:59
Harper yeah they're trying to claim I
00:31:02
was involved in a conspiracy to shoot
00:31:04
Harper I had nothing to do with it
00:31:05
didn't know anything about it until
00:31:07
after it happened still don't know that
00:31:09
he's actually shot I've never seen
00:31:10
medical evidence never heard doctor
00:31:11
testified a man was shot far as I know
00:31:13
he had another heart attack and I had to
00:31:15
crack his chest to emerge the open heart
00:31:16
on him I mean from what I've experienced
00:31:19
with these cops here they'll lie about
00:31:20
anything and everything to try to frame
00:31:21
somebody and the people that are helping
00:31:24
to date only Timothy Combs has been
00:31:27
charged in the shooting of Bob Harper
00:31:29
Combs is now 37 years old
00:31:32
authorities believe he has gone
00:31:34
underground and is probably being
00:31:36
harbored by members of a right-wing
00:31:37
militia group
00:31:40
there are people associated with this
00:31:42
movement who are threats because they
00:31:45
see themselves as warriors basically
00:31:48
against American society they see
00:31:51
themselves as having a special status
00:31:53
that others are trying to they believe
00:31:55
undercut and the problem with that is
00:31:58
that one when this is increasing in
00:32:00
small communities in particular it's a
00:32:03
very very very scary thing for local
00:32:06
officials and others to have this
00:32:07
counter force there that's usually very
00:32:09
well-armed and it's implicitly a threat
00:32:15
but we were completing this story we
00:32:18
were saddened to learn that corporal Bob
00:32:19
Harper had died during surgery for a
00:32:22
pre-existing heart condition his
00:32:24
colleagues believe there could be no
00:32:25
more fitting tribute to his memory than
00:32:27
the capture of Timothy Combs
00:32:30
[Music]
00:32:42
next
00:32:43
witnesses say veteran rider Shelly
00:32:45
Malone was trampled by her own mouth
00:32:47
however expert horseman said highly
00:32:50
unlikely
00:32:51
[Music]
00:33:07
the plains virginia's thoroughbred
00:33:09
country the small wealthy community
00:33:11
where both people and horses have been
00:33:13
agrees it's not at all the kind of place
00:33:16
you would expect to find an unsolved
00:33:17
mystery much less a mystery fueled by
00:33:20
one family suspicions of foul play
00:33:25
Charlie Malone was 37 years old when she
00:33:28
died on many levels her case is one of
00:33:31
the most emotionally charged we have
00:33:33
ever profiled we have been unable to
00:33:36
obtain interviews with the local police
00:33:37
or the people who are with Shelley the
00:33:39
day she died
00:33:41
consequently this story is told almost
00:33:43
entirely from the point of view of
00:33:44
Shelley's family are the overreacting
00:33:48
out of grief hypersensitive to every
00:33:50
inconsistency or is it possible their
00:33:53
suspicions add up to a sinister truth
00:33:58
[Music]
00:34:00
October 18th 1992 paramedics were called
00:34:04
to a field in a wooded area outside the
00:34:06
plains Shelley Malone an accomplished
00:34:12
horse woman had been badly injured in a
00:34:14
riding accident as the paramedics
00:34:19
struggled to safe shouting her boyfriend
00:34:21
George Carhartt and two other friends
00:34:23
Erica stumble and Carter Wiley could
00:34:26
only stand by helplessly and watch
00:34:29
[Music]
00:34:31
according to Erica the only witness to
00:34:34
the accident Shelley's horse has stepped
00:34:36
on her and kicked her repeatedly one
00:34:39
blow was apparently powerful enough to
00:34:40
rupture her heart
00:34:42
however Shelley's family has always
00:34:44
found Erica's account highly
00:34:46
questionable I know that that accident
00:34:49
is most improbable if not impossible in
00:34:54
an open field for a horse she loved and
00:34:57
loved her to step on her squarely in on
00:35:00
the chest after he had thrown her off
00:35:03
this is impossible
00:35:09
- Shirley's family has seemed
00:35:11
particularly impossible for such an
00:35:13
experienced writer Shelley had been
00:35:15
around horses since she was a young
00:35:17
child Shelley was born loving horses
00:35:21
when she was six or seven she told me
00:35:24
she was going to marry a horse when she
00:35:25
grew up so she never ever lost her
00:35:30
interest in horses
00:35:34
it was horses have brought Shelley to
00:35:36
the plains area 1988 located an hour and
00:35:40
a half from Washington DC the plains is
00:35:42
home to many of the country's rich and
00:35:44
powerful including US Senator John
00:35:46
Warner though her own roots were modest
00:35:49
Shelley gained entry to this elite
00:35:51
Society thanks largely to a wealthy
00:35:53
older benefactor named Cecil Altmann
00:35:55
Altmann said Shelley up in business and
00:35:59
reportedly gave her an allowance of
00:36:00
$5,000 a month
00:36:04
[Music]
00:36:06
Shelley lived in a small house out in
00:36:08
the country a perfect place to stable
00:36:10
her two horses in 1990 she started
00:36:14
dating George Carhartt who lived in New
00:36:16
York and reportedly came down frequently
00:36:18
to visit however Shelley's mother claims
00:36:26
that after two years Shelley was ready
00:36:28
to move on the relationship was strained
00:36:33
she had relayed to my husband and myself
00:36:36
that she was bringing this relationship
00:36:41
to a close
00:36:45
on Friday October 16th 1992 two days
00:36:49
before she died
00:36:50
Shelly allegedly had an impromptu
00:36:52
romantic encounter with a local attorney
00:36:55
Shelly's family believes George Carhartt
00:36:57
found out about the affair when he came
00:36:59
to visit that weekend on Sunday
00:37:08
afternoon Shelly had plans to go riding
00:37:10
with Erica stumbled George Carhartt and
00:37:13
Carter Wiley Erika's boyfriend stayed
00:37:15
behind at the house Erica is issued only
00:37:19
one official statement on the day's
00:37:20
events written document she prepared and
00:37:23
delivered to the police you're about to
00:37:25
hear selected portions from that
00:37:27
statement we alternately walked trotted
00:37:32
and galloped the horses through several
00:37:34
fields and trails we were approximately
00:37:38
100 yards into a new field we had just
00:37:41
entered we were walking the horses side
00:37:44
by side to cool them down unexpectedly
00:37:46
both horses spooked or started I was
00:37:51
thrown and fell off to the left of my
00:37:53
horse
00:37:53
I was not seriously injured I cited
00:37:57
Shelly about 30 feet away the horse
00:38:01
stepped on her legs face and head
00:38:03
taking her head as he did so in an
00:38:05
apparent attempt to get away as the
00:38:08
horse moved away from her I immediately
00:38:10
ran to her Joey Joey I checked her pulse
00:38:16
and looked in her mouth to see if there
00:38:17
were any obstructions I noticed her left
00:38:19
cheek was turning purplish blue which I
00:38:22
assumed was the result of the horse
00:38:23
stepping on her face I'll be back as
00:38:26
soon as I can all right fearful of a
00:38:28
head injury as a result of seeing the
00:38:30
horse kick her in the head
00:38:31
I then concluded that the best thing to
00:38:33
do was try to seek medical help erica
00:38:38
says she got lost trying to find help it
00:38:40
would be an hour and a half before
00:38:42
paramedics reached Shelly it was George
00:38:44
Carhartt later called Shelly's mother in
00:38:47
Florida when the phone rang
00:38:51
he said jollies had an accident I
00:38:54
expected him to say she slipped and
00:38:57
broke an arm or leg or something and I
00:39:01
said what kind of an accident and he
00:39:02
said she's dead Shelly's family claims
00:39:10
they got another shock at the morgue to
00:39:12
them
00:39:13
Shelly looked like she had been involved
00:39:14
in much more than a riding accident one
00:39:19
of the clerks there showed us four
00:39:22
Polaroid of my daughter's face it was so
00:39:26
bad and so swollen her eyes were black
00:39:29
and blue that I didn't recognize her
00:39:34
according to Shelly's family subsequent
00:39:37
events made them even more suspicious
00:39:38
despite the fact that the coroner's
00:39:40
ruling was accidental death
00:39:46
two days after Shelley's funeral her
00:39:48
family claims they had an odd experience
00:39:50
at her home
00:39:51
George Carhartt was one of those present
00:39:54
there was a pickup truck backed up to
00:39:57
the front porch and there was some large
00:40:01
pieces of my sister's furniture on there
00:40:03
and they were moving stuff out and
00:40:06
loading bags up with their clothes and
00:40:09
her belongings Shelley's mother claims
00:40:13
that car horn made several insensitive
00:40:15
comments and I countered with well i'm
00:40:26
priy torch and i don't understand that
00:40:29
you're mean and he said all of her
00:40:31
clothes will go to charity and I said we
00:40:34
have made no arrangements to do anything
00:40:37
of the kind
00:40:38
and as these black garbage bags were
00:40:41
going down the stairs with her
00:40:43
belongings in them I was in pulling them
00:40:48
back up the stairs and we were like
00:40:49
having a tug-of-war with these bags
00:40:55
the next day George Carhartt took
00:40:57
Shelly's family to the local dump to
00:40:59
retrieve the clothes she was wearing
00:41:00
when she was killed they never found the
00:41:03
clothes but they say they did discover
00:41:06
more than two dozen Julie boxes from
00:41:08
Tiffany and Cartier all of them empty
00:41:12
when we questioned George about where
00:41:16
the contents were he told us that she
00:41:18
was Hawking her jewelry
00:41:21
[Music]
00:41:23
that explanation struck Shelly's family
00:41:26
as dubious at best but some find it
00:41:28
credible particularly in light of
00:41:30
questions relating to Shelly's past
00:41:32
including a drug conviction in 1979 and
00:41:36
alleged ties to a savings and loan
00:41:38
scandal in the 1980s Shelly's past
00:41:43
however does not explain the matter of
00:41:45
her truck and the family brought the
00:41:47
truck back to Florida they discovered
00:41:49
what they believed to be bloodstains a
00:41:51
local detective was asked to test them I
00:41:55
did a field test to tell whether or not
00:41:59
it was human blood and the field test
00:42:01
was positive from the angle where the
00:42:05
blood was on the passenger seat it
00:42:08
appears that it came from a head wound
00:42:13
Shelly's family took the truck back to
00:42:15
the plains and turned it over to the
00:42:17
authorities some routine blood tests
00:42:20
were performed however the [ __ ] your
00:42:22
County Sheriff's Office claimed they
00:42:24
didn't have the budget to do DNA
00:42:25
comparisons Shelly's family has taken
00:42:32
out newspaper ads written letters and
00:42:34
made numerous phone calls to local and
00:42:36
state officials all for one purpose they
00:42:39
want a full-fledged investigation an
00:42:41
investigation they believe or prove
00:42:43
Shelly was murdered I can only think
00:42:47
that an argument came about between
00:42:50
Shelly and George or Shelly and Carter
00:42:53
Wiley I don't know which of the two I
00:42:55
think wasn't a planned thing but I think
00:42:57
one of them struck her and killed her or
00:43:04
felt that they had killed her or felt
00:43:07
that they had named her in a very
00:43:10
serious way and I think the rest of the
00:43:15
scenario that we've been told is simply
00:43:19
that a scenario
00:43:25
John Strasburg a horse expert and editor
00:43:28
of a chronicle of the horse feels it is
00:43:30
highly unlikely Shelley's horse would
00:43:32
have behaved as Eric Istanbul described
00:43:36
the element of the story that that
00:43:39
raises questions in my mind are a horse
00:43:43
stepping on its rider in an open field
00:43:49
it's hard to imagine a horse
00:43:53
intentionally or accidentally stepping
00:43:56
on someone in that situation not
00:43:58
impossible but very hard to mention I've
00:44:04
talked to medical men who say a man with
00:44:07
a big fist could strike a girl laying
00:44:10
104 pounds and just with the force of
00:44:13
his hand sever that ventricle so that
00:44:18
once that had happened and she was
00:44:20
unconscious or dead what could they do
00:44:24
so you take the shoe off of the horse
00:44:28
Ram it onto a 4x4 and then with all the
00:44:32
force you have plant a hoof print over
00:44:37
the heart
00:44:41
what happened to Shelley Malone the
00:44:44
Sheriff's Department in Fauquier County
00:44:45
Virginia issued the following statement
00:44:47
in response to our story quote MS
00:44:51
Malone's death has been investigated and
00:44:53
reviewed by several agencies to include
00:44:55
the Virginia State Police all conclude
00:44:58
the death is accidental end quote
00:45:00
in addition the office of the chief
00:45:03
medical examiner in Washington DC also
00:45:06
ruled that the death was accidental
00:45:18
join me next time for another
00:45:21
fascinating edition of unsolved
