Forensic Files - Season 6, Episode 26 - Double Trouble - Full Episode

November 24, 2021 / 22:35

This episode covers the murders of Melissa Padilla and Vicki Gardner, both involving brutal assaults and bite marks. The investigation reveals a connection between the two cases, leading to the arrest of Stephen Fortin.

Melissa Padilla, a mother from Perth Amboy, New Jersey, was murdered in 1994 after leaving a convenience store. Her body was found with signs of sexual assault and bite marks, which indicated a ritualistic element to the crime.

Eight months later, in Maine, state trooper Vicki Gardner was assaulted by Stephen Fortin, who had a history of violence. The similarities between the two cases, including the bite marks, led investigators to suspect Fortin.

Forensic experts, including Dr. Lowell Levine and Roy Hazelwood, linked the two crimes through bite mark analysis and behavioral patterns. Fortin was ultimately tried and convicted for both crimes.

In 2001, Fortin was sentenced to death, providing a sense of justice for the victims' families, although the emotional impact remains profound.

TL;DR

The episode details the brutal murders of Melissa Padilla and Vicki Gardner, linking them to suspect Stephen Fortin through forensic evidence.

it eventually cost him his life

00:01:24
puerto rico she and her four brothers
00:01:27
grew up here
00:01:28
yeah she was
00:01:30
my right hand
00:01:32
she was always helping me with them she
00:01:38
she was like a second mother to them
00:01:40
they depend on her
00:01:42
i remember her
00:01:43
often helping me out with my work
00:01:46
she was a excellent speller and

been able to handle it she was always

melissa attended high school in perth

00:02:04
and later became pregnant
00:02:07
she had three more children in rapid
00:02:09
succession and in 1994 was unmarried and
00:02:13
supporting herself and the children with
00:02:15
a monthly welfare check
00:02:18
she didn't have any technical skills or
00:02:20
something that would demand a high

on the night of august 11 1994
00:02:58
melissa left the children with her
00:02:59
boyfriend and walked to a nearby
00:03:02
convenience store for some groceries
00:03:05
she went out
00:03:06
at 11 at night
00:03:08
because her kids were hungry
00:03:13
melissa left the store around 11 30 and
00:03:16
headed back to the motel
00:03:18
but she never arrived
00:03:23
her boyfriend told police he found her
00:03:26
half-naked body later that night
00:03:29
along the highway
00:03:32
melissa's mother got the word shortly
00:03:34
after the body was discovered
00:03:37
you're not supposed to bury your
00:03:38
children
00:03:42
that you're gonna die before them
00:03:45
no parents want to bury their children
00:03:48
it's hard
00:03:50
i was supposed to go before her
00:03:54
most murderers go to great lengths to
00:03:57
avoid detection
00:03:59
melissa's killer didn't seem to care
00:04:01
committing his crime along a busy
00:04:04
highway where he could have been easily
00:04:07
seen
00:04:08
it was this brazenness
00:04:11
that would eventually be
00:04:13
his downfall
00:04:17
[Music]
00:04:18
when melissa padilla left her hotel room
00:04:21
to buy food for her young children her
00:04:23
route took her along a well-traveled
00:04:25
highway to a nearby convenience store
00:04:28
melissa never returned
00:04:31
her boyfriend told police he found her
00:04:34
body in a sewer pipe near the highway
00:04:36
she was naked from the waist down
00:04:39
the autopsy revealed that she died as a
00:04:41
result of the manual fixation
00:04:44
and assault
00:04:46
there were several grocery items near
00:04:48
the body as well as melissa's
00:04:50
blood-spattered shorts found about half
00:04:52
a block away with the pocket turned out
00:04:57
but the most telling evidence came from
00:05:00
melissa's body itself
00:05:02
her eyes were
00:05:04
battered indicating that she had
00:05:06
received
00:05:07
punches from someone who was strong and
00:05:11
who subdued her in that way
00:05:14
the fact that she was naked and
00:05:17
and that her genital area was mutilated
00:05:19
obviously indicated that there was a
00:05:21
sexual assault
00:05:23
scrapings from under her fingernails
00:05:25
revealed dna that authorities hoped
00:05:28
would bring a conviction if they could
00:05:30
only find a suspect
00:05:33
melissa's autopsy revealed one other
00:05:36
detail something tom capsack had never
00:05:39
seen in his 31 years of prosecuting
00:05:42
homicides
00:05:44
she had bite marks on her chin and on
00:05:47
her left breast
00:05:48
indicating that there was probably some
00:05:50
kind of ritualistic element to the
00:05:53
killing
00:05:54
the bite mark on the chin
00:05:57
was particularly unusual
00:06:00
i've done a lot of research and i've
00:06:01
talked to a lot of people
00:06:03
bite marks usually occur to the general
00:06:05
genital areas to the breast
00:06:08
to the stomach
00:06:10
but i have never heard of one that
00:06:13
occurred to the chin before
00:06:15
armed with this evidence new jersey
00:06:18
police began their search for melissa's
00:06:20
killer
00:06:21
[Music]
00:06:22
the security video from the quick check
00:06:24
store where melissa had bought groceries
00:06:27
helped establish the time of the murder
00:06:29
shortly before midnight
00:06:32
it also showed the cashier giving her
00:06:35
change
00:06:36
but no money was found in melissa's
00:06:39
clothing indicating she had also been
00:06:42
robbed
00:06:44
police also began canvassing the area
00:06:47
looking for eyewitnesses
00:06:49
there was a witness that was identified
00:06:52
that was interviewed who indicated they
00:06:54
were traveling past the roadway and saw
00:06:56
what appeared to be two individuals in
00:06:58
some sort of
00:07:00
struggle
00:07:01
standing up near the concrete pipes
00:07:04
but the witness could provide little
00:07:07
useful information
00:07:09
the battering about melissa's face and
00:07:11
the bite marks on her breast and chin
00:07:14
led police to theorize that her killer
00:07:16
got a perverse pleasure out of
00:07:19
assaulting women and might have struck
00:07:21
before
00:07:23
just a mile from the murder scene was a
00:07:26
prison for convicted sex offenders
00:07:28
a check of prison records showed a
00:07:30
number of released prisoners living in
00:07:33
the area
00:07:34
we then pulled their files to determine
00:07:36
what their mo was and whether they were
00:07:38
involved in any kind of ritual when they
00:07:40
committed their sex crimes
00:07:42
they complied with requests for dna
00:07:45
samples
00:07:46
they complied with exemplar requests for
00:07:49
hairs
00:07:50
they also submitted to polygraph
00:07:52
examinations that were conducted by the
00:07:54
woodbridge police department
00:07:56
and they all were eliminated as suspects
00:07:59
in the crime
00:08:01
melissa's boyfriend who had stayed with
00:08:03
her children was also eliminated
00:08:05
eventually things started to
00:08:08
appear that we we have an unsolved
00:08:10
homicide with no suspect to pursue
00:08:15
eight months later
00:08:17
500 miles away in maine
00:08:22
there was another assault strikingly
00:08:24
similar to melissa padilla's
00:08:27
excuse me sir are you okay
00:08:32
this crime was bold and brazen
00:08:36
but the perpetrator made a mistake in
00:08:39
choosing his victim
00:08:41
she
00:08:42
was a state trooper
00:08:48
months after the murder of melissa
00:08:50
padilla police still didn't have a
00:08:53
suspect
00:08:56
the brutality of the assault led police
00:08:58
to believe her killer took pleasure in
00:09:00
attacking women and might strike again
00:09:04
eight months later state troopers in
00:09:07
maine reported a brazen assault on one
00:09:10
of their own
00:09:13
the assault took place on april 3rd 1995
00:09:16
at about 8 30 p.m
00:09:18
trooper vicki gardner an 11-year veteran
00:09:20
was off-duty and driving her police
00:09:23
cruiser south on interstate 95.
00:09:30
[Music]
00:09:37
she came across a vehicle
00:09:39
facing the wrong way
00:09:41
on the interstate and she stopped to
00:09:44
investigate
00:09:49
excuse me sir are you okay
00:09:54
gardner discovered that the driver
00:09:56
stephen fortin had been drinking
00:09:59
would you please get out of the car
00:10:10
since she was off duty she called for
00:10:12
another police vehicle to take thornton
00:10:14
into custody
00:10:17
when fortin heard this he exploded
00:10:21
jordan sucker-punched her
00:10:23
ripped her clothes off more less to do
00:10:26
in the process of molesting her
00:10:28
he bitter
00:10:29
when the backup cruiser arrived he
00:10:31
took off in the cruiser
00:10:39
[Music]
00:10:43
vicky gardner was unconscious still in
00:10:46
the vehicle
00:10:47
when she regained consciousness she
00:10:49
opened the passenger door and tried to
00:10:51
jump out
00:10:52
he was sort of trying to reach out and
00:10:54
grab a hold of her and pull her back in
00:10:56
and she swung herself away from him and
00:10:57
got away from him
00:11:07
vicky gardner was lucky to be alive
00:11:10
i've never seen a woman attack that way
00:11:13
damage that badly
00:11:15
we'll live to talk about it
00:11:18
after vicky jumped out of the vehicle
00:11:20
fortin lost control of the car and
00:11:23
crashed
00:11:24
he was later apprehended
00:11:27
lieutenant lancaster interviewed him in
00:11:29
prison
00:11:31
he took no responsibility he
00:11:34
was it was while we spoke
00:11:36
although we spoke of the incident it was
00:11:38
always somebody else's fault
00:11:40
um
00:11:41
he
00:11:42
i knew that i was dealing with someone
00:11:44
that was evil
00:11:46
vicky had scrapes and bruises over her
00:11:49
entire body
00:11:51
and her face was severely battered
00:11:55
fortin had not only punched and
00:11:57
assaulted her he had also left a bizarre
00:12:00
calling card
00:12:03
two bite marks one on the outer area of
00:12:06
her left breast the other on her chin
00:12:10
who attacks a trooper
00:12:13
and sexually molested in her own
00:12:16
in her own cruiser you just know from
00:12:18
the facts of this case
00:12:20
and the assault and the way in which the
00:12:22
assault took place and every aspect
00:12:24
about it you knew that you were dealing
00:12:26
with someone
00:12:28
who had done something like this before
00:12:31
in fact a check of police records in
00:12:34
fortin's home state of new jersey
00:12:36
revealed that he had a history of
00:12:38
violence
00:12:40
fortin's name was well known to
00:12:42
prosecutor capsack he had sent him to
00:12:45
prison for seven years on a manslaughter
00:12:47
charge
00:12:48
fortin got out after only two and a half
00:12:51
years
00:12:52
he had stabbed his brother in the throat
00:12:54
in 1983 in the township of carteret
00:12:58
and
00:12:59
was
00:13:00
pled guilty to that
00:13:02
when the new jersey state police heard
00:13:04
the news of steve fortin's assault in
00:13:06
maine
00:13:07
they naturally wanted to find out if
00:13:09
fortin was in new jersey on the night
00:13:11
melissa padilla was killed
00:13:14
an interview with thornton's former
00:13:16
girlfriend provided the answer
00:13:20
and she told us that in august of 1994
00:13:24
stephen fortin did in fact live in
00:13:26
avondale new jersey in fact he lived in
00:13:28
an apartment with her
00:13:30
and on the very night in question
00:13:33
he assaulted her
00:13:35
in the parking lot of a restaurant
00:13:38
and she called the police and he ran
00:13:41
that restaurant bud's hut was a short
00:13:44
walk from the gem motel where melissa
00:13:46
was living the police report listed the
00:13:49
time of the assault on dawn archer as 10
00:13:52
30 p.m an hour before melissa was
00:13:55
murdered
00:13:56
at last
00:13:57
authorities had a suspect
00:14:00
melissa's brother got the word
00:14:02
a day after his birthday
00:14:04
i didn't consider it a birthday gift but
00:14:06
i was glad that
00:14:09
they did fine
00:14:10
and i was praying that they would find
00:14:12
him before he could ever do that to
00:14:14
someone else they found him
00:14:17
but now
00:14:18
they had to prove him guilty
00:14:21
prosecutors hoped the dna evidence taken
00:14:24
from under melissa's fingernails would
00:14:26
incriminate fortin but it didn't when it
00:14:29
was compared
00:14:30
to stephen fortin
00:14:32
from maine's evidence that we obtained
00:14:34
from them
00:14:36
the dna lab could not
00:14:39
include him or exclude him as a source
00:14:43
with the dna results inconclusive the
00:14:46
bite marks on the two victims seem to be
00:14:49
prosecutors best chance of linking
00:14:52
fortin to melissa padilla's murder
00:14:56
a plaster impression was therefore made
00:14:59
on fortin's teeth
00:15:00
the impression along with photographs of
00:15:03
the bite marks were sent to dr lowe
00:15:05
levine a respected forensic odontologist
00:15:09
who worked for the new york state police
00:15:12
these are mr forten's teeth they're
00:15:13
actually models of them and they're made
00:15:16
the same way as the orthodontist would
00:15:18
take models or the dentist takes models
00:15:20
to do prosthetic devices if you take a
00:15:23
look at the upper teeth he's got a space
00:15:26
between his two middle front ones
00:15:29
and the one on the right
00:15:30
is bigger than the one on the left
00:15:33
because it's a cap and in fact the
00:15:35
biting surface is slightly
00:15:38
wider also
00:15:40
from front to back if you look at the
00:15:42
models of lower teeth they're very very
00:15:45
straight across the bottom of them he's
00:15:48
got almost no wear on the incisal edges
00:15:51
so they leave linear markings rather
00:15:54
than rectangles and they're very very
00:15:56
straight across he's got the slightly
00:15:59
pointed canine so he doesn't have a
00:16:01
whole lot of wear
00:16:03
levine compared forton's teeth to the
00:16:06
bite marks on vicki gardner and melissa
00:16:08
padilla
00:16:09
he found them to be a match
00:16:14
leaving nothing to chance prosecutors
00:16:17
also brought in roy hazelwood a former
00:16:20
fbi profiler and an expert on criminal
00:16:24
behavior
00:16:25
he was interested in my studying the
00:16:27
crimes to determine whether or not i
00:16:29
could do a linkage analysis
00:16:31
in the two crimes a linkage analysis is
00:16:33
an in-depth study of two or more crimes
00:16:37
with
00:16:38
the idea of attempting to determine
00:16:40
whether or not they were committed by
00:16:42
the same person
00:16:44
hazelwood concluded that the same man
00:16:47
had indeed committed both crimes
00:16:52
the trial of stephen fortin began on
00:16:54
october 31st 2000
00:16:57
a trial with no eyewitnesses
00:17:00
circumstantial evidence and inconclusive
00:17:03
dna findings
00:17:05
the prosecutor's case rested almost
00:17:08
entirely on the opinions of two forensic
00:17:16
experts the murder of melissa padilla
00:17:19
and the assault of a maine state trooper
00:17:21
were so strikingly similar that this
00:17:24
became a critical part of the
00:17:26
prosecution's case
00:17:29
at stephen fortin's trial maine state
00:17:32
trooper vicki gardner took the stand to
00:17:34
describe how fortin had beaten and
00:17:37
sexually assaulted her
00:17:39
then we had to bring in witnesses that
00:17:42
brought the two crimes together and they
00:17:45
were hazelwood and levine
00:17:48
addressing the jury roy hazelwood
00:17:50
explained that some crimes like the
00:17:53
murder of melissa padilla and the
00:17:55
assault of trooper gardner have unique
00:17:58
patterns of behavior which he called
00:18:00
rituals the ritual
00:18:03
are those acts which are unnecessary to
00:18:06
the commission of the crime
00:18:07
and are carried out to meet the
00:18:09
emotional needs of the offender
00:18:12
in this case
00:18:13
the need for psychosexual gratification
00:18:16
[Music]
00:18:18
hazelwood identified five examples of
00:18:20
ritualistic behavior that were common to
00:18:23
both cases
00:18:26
bite mark to the chin
00:18:28
bite mark to the left breast
00:18:31
excessive battering to the upper portion
00:18:33
of the face in both instances
00:18:36
injurious anal penetration and manual
00:18:38
strangulation from the front
00:18:40
i've never seen that combination of
00:18:43
behaviors in any other crime
00:18:46
then dr levine explained to the jury
00:18:49
that no two people have teeth patterns
00:18:51
that are exactly the same
00:18:54
what i basically did was to show
00:18:57
the jurors that people
00:18:59
leave bite marks that look different
00:19:02
we used to the prosecutors myself and
00:19:05
one of the investigators
00:19:08
so that bite marks look different
00:19:13
dr levine showed the jury overlays of
00:19:16
steve fortin's teeth we were able to
00:19:19
show the jury how the overlays fit over
00:19:22
the life-sized photographs of the bite
00:19:24
mark on the victim
00:19:26
we did it by animating
00:19:29
the overlay so that it moves across the
00:19:31
screen
00:19:32
and stops exactly on the bite mark and
00:19:34
it was it was very effective and it was
00:19:36
very dramatic and i think it worked very
00:19:38
well
00:19:39
new jersey authorities are coming for
00:19:41
the jury deliberated stephen fortin's
00:19:44
fate for two days before reaching their
00:19:46
verdict
00:19:48
guilty
00:19:52
in the penalty phase
00:19:54
prosecutors asked for the death sentence
00:19:57
and concluded by explaining to the jury
00:20:00
why fortin had bitten his victims on the
00:20:04
chin
00:20:05
what we finally decided regarding the
00:20:07
bite mark to the chin
00:20:09
was that stephen fortin was biting the
00:20:11
victim on the chin while he was looking
00:20:13
in her eyes and mutilating her genitals
00:20:17
and that he was getting a perverse
00:20:20
pleasure out of that
00:20:22
on february 26 2001
00:20:25
fortin was sentenced to die
00:20:28
by lethal injection
00:20:30
it was justice but i didn't feel like a
00:20:33
vengeance that justice
00:20:35
should have been served you know
00:20:37
i was i was grateful
00:20:39
roy hazelwood and lowell levine were
00:20:41
absolutely critical to the case
00:20:44
this case like most murder cases
00:20:48
depended on circumstantial evidence on
00:20:51
forensic evidence on expert testimony
00:20:55
and the tools those experts have to draw
00:20:57
on says hazelwood are growing more and
00:21:00
more sophisticated every year
00:21:03
i'm continuously amazed at the strides
00:21:06
we've made in investigating crimes and
00:21:09
solving crimes and prosecuting crimes
00:21:12
stephen fortin is now in trenton state
00:21:14
prison awaiting execution
00:21:18
melissa padilla's sons are living with
00:21:21
their father
00:21:22
her daughters are being raised by
00:21:25
melissa's mom
00:21:28
she was a good mother
00:21:31
because she's a good friend
00:21:36
she was a wonderful daughter
00:21:39
[Music]
00:21:42
she was a good person
00:21:44
had a big heart
00:21:50
and
00:21:55
i'm sorry her kids won't
00:21:58
be able to know that
00:22:02
[Music]
00:22:12
[Music]
00:22:17
so
00:22:23
