May 23, 2019 / 42:07

This episode of Unsolved Mysteries covers the tragic murder of Jody Bordeaux, the fraudulent music school scheme by Mario Yunus and Omar Arroyo, and the mysterious case of Gilbert Ortiz.

Jody Bordeaux was murdered in her home on the Kickapoo Indian Reservation in Kansas. Her husband, Shawn, recounts the disturbing events leading up to her death, including anonymous threats and workplace conflicts. Despite extensive investigations, no one has been charged in her murder.

The episode also highlights a fraudulent music school run by Mario Yunus and Omar Arroyo in North Hollywood, California. They allegedly swindled families out of over $1.5 million through identity theft and false promises of music lessons, leading to numerous victims.

Additionally, Gilbert Ortiz shares his harrowing experience of being poisoned by his wife, Elizabeth, who then abducted their son, Jonathan. After years of searching, Gilbert was finally reunited with Jonathan, who had been living in Mexico.

These stories illustrate the complexities of crime and the impact on families, as well as the ongoing search for justice.

TL;DR

Jody Bordeaux was murdered, a music school scam unfolded, and Gilbert Ortiz was poisoned by his wife before being reunited with his son.

00:02:07
a dark November night in Powhatan Kansas
00:02:09
a small farmhouse on the edge of the
00:02:12
Kickapoo Indian Reservation Jodi
00:02:17
Bordeaux and her husband Sean have lived
00:02:19
here for over a year for weeks he have
00:02:22
been receiving disturbing anonymous
00:02:23
phone calls but on this night they
00:02:29
weren't just calls Jodi was sure someone
00:02:32
was in their yard
00:02:35
one night she had heard noises outside
00:02:38
of the house and I tried to convince her
00:02:41
that it was probably a raccoon or a
00:02:42
coyote or something and as she really
00:02:45
didn't have nothing to be a work to be
00:02:47
afraid of but Shaun was wrong the danger
00:02:51
Jodi proceeded was very real and would
00:02:54
ultimately lead to her murder Shaun and
00:03:01
Jodi worked at the Golden Eagle it was a
00:03:03
first Indian owned casino in the area it
00:03:06
held great potential for the Kickapoo
00:03:08
tribe with an annual revenue stream in
00:03:10
the millions and job opportunities for
00:03:13
the local tribes people Shawn who is
00:03:17
part Lakota Indian and Jodi were part of
00:03:19
the management team hired to run the
00:03:21
casino
00:03:22
although the Kickapoo tribal council
00:03:25
retained the final word in all decisions
00:03:29
Shawn and Jodi were also trying to start
00:03:32
a family after several miscarriages Jodi
00:03:35
sought out a fertility expert and within
00:03:37
a few months the couple's dream had come
00:03:39
true Jodi was pregnant with a baby girl
00:03:43
she was absolutely ecstatic over this
00:03:47
pregnancy and that her happiness was
00:03:51
something that spilled over into her
00:03:53
friends and her acquaintances and
00:03:55
everybody were just pretty much felt
00:03:57
happy for her and with her everything
00:04:02
seemed to be going Jodi's way soon her
00:04:04
take-charge personality got her promoted
00:04:06
to staff supervisor of the [ __ ] machine
00:04:09
department so he was a little fireball
00:04:11
she put a lot of energy a lot of effort
00:04:14
into everything she did so to see her in
00:04:17
the casino you
00:04:20
would think she was running most things
00:04:21
and even that perception in and of
00:04:24
itself is kind of a little bit it can
00:04:28
draw jealousy and envy some from some of
00:04:31
the people who may be in the same
00:04:32
position saying how does she get all the
00:04:35
attention
00:04:37
judi believe the some of the staff were
00:04:39
resentful over a new position her
00:04:43
grandmother died
00:04:44
for instance one employee a slot
00:04:46
technician accused her of fabricating
00:04:48
excuses to get extra time off our
00:04:50
busiest weekend good time to have to go
00:04:53
out to a funeral
00:04:57
there's some competitiveness when it
00:04:59
comes to these jobs and having two
00:05:02
people coming from other tree no one
00:05:04
from another tribe and one from no tribe
00:05:05
at all and going into high positions in
00:05:07
the casino I'm sure rubbed a lot of
00:05:10
people on the Kickapoo reservation the
00:05:11
wrong way to complicate things as a
00:05:15
department supervisor Jody's position
00:05:18
required her to oversee job performance
00:05:20
according to Shawn
00:05:22
Jody often had to report the slot Tech's
00:05:24
bad attitude and tardiness he kept
00:05:27
coming back with more problems for her
00:05:30
and eventually you know she had to take
00:05:33
a little bit more of a hard line on him
00:05:36
and start writing him up and holding him
00:05:39
to the letter of the law as our policies
00:05:41
and procedures mandated we're here to
00:05:44
talk about some reports we have about
00:05:46
you being late for work when things
00:05:49
didn't improve the employee was brought
00:05:51
before the casino management board for
00:05:53
review I don't even know why some of
00:05:55
those reports are even written it's like
00:05:57
everybody else gets away with everything
00:05:58
he was reprimanded and put on probation
00:06:03
but the problems persisted and the slot
00:06:06
tech was eventually fired it was just
00:06:11
weeks later when Shawn believes out of
00:06:13
vengeance the slot tech brought a
00:06:15
grievance against Jody directly to the
00:06:17
Tribal Council
00:06:23
the complaint ultimately led to Jody
00:06:26
losing her job so judy spent the next
00:06:32
month petitioning to get it back she
00:06:34
hoped the tribal council would
00:06:37
reconsider Jody was hoping that she
00:06:44
would be rehired at the golden eagle and
00:06:46
that was discussion that her and I had
00:06:50
participated in and there was a
00:06:53
possibility that she would have come
00:06:56
back to work after golden eagle when the
00:07:00
news spread that Jody might return to
00:07:01
the casino the anonymous phone calls
00:07:04
began never in my wildest dreams did I
00:07:10
think they had anything to do with
00:07:11
having to worry for our lives I had no
00:07:15
idea that we were being threatened
00:07:20
[Music]
00:07:29
late on November 21st Shawn and Jody was
00:07:32
spending a quiet night at home on a
00:07:39
strange noise startled the Bordeaux's
00:07:40
dog Shawn followed him to the back porch
00:07:46
the next thing I hears a popping noise
00:07:49
kind of over and behind my head and then
00:07:54
it was like somebody lit a 20 pack of
00:07:56
firecrackers Jody got to the bedroom and
00:08:03
she turned to see if I was okay and one
00:08:09
bullet went into the bedroom Jody Jody
00:08:14
and that one bullet struck her in the
00:08:19
head
00:08:20
[Music]
00:08:23
Shawn could see that Jodi was dead
00:08:26
he quickly dialed 911 to save his unborn
00:08:30
baby and as I pick up the phone and I
00:08:35
look up at the wall I notice that it's
00:08:38
riddled with bullets
00:08:42
Jody didn't suffer and that she died
00:08:44
instantly
00:08:45
my baby suffered you know here's my
00:08:49
little baby in there and she's relying
00:08:51
on mom and next thing you know there's
00:08:53
no mom and she dies too slow death
00:08:56
that really hurts so I think when I
00:09:01
kissed her I think it was her calling me
00:09:04
in a spiritual way is to say I have to
00:09:07
go now and that was goodbye
00:09:15
that night Shawn lost both Jodi and the
00:09:18
baby and despite an exhaustive
00:09:20
investigation four years later no one
00:09:23
has been charged with the murder
00:09:24
the Bordeaux's home was so isolated
00:09:27
there were no witnesses no weapon was
00:09:29
found today a killer is still on the
00:09:32
loose
00:09:35
Kevin Hill is a County Attorney assigned
00:09:38
to the bordeaux murder he has been
00:09:40
working with local estate authorities on
00:09:43
the investigation gone from a point
00:09:46
where just about everyone was the
00:09:48
possible suspect to a point where we're
00:09:50
focusing on an individual or group of
00:09:53
individuals that may have been
00:09:55
responsible for this these individuals
00:09:57
were not strangers to Jodi Bordeaux
00:09:59
individuals knew her and they would have
00:10:03
had an axe to grind with her due to
00:10:05
employment issues but there are a few
00:10:09
key roadblocks to capturing anyone
00:10:11
involved I believe that part of the
00:10:15
problem is just that there's not a lot
00:10:17
of trust with Indian people and
00:10:19
non-indian law enforcement and that's
00:10:23
probably part of the problem with with
00:10:25
the Inquisition and any other
00:10:27
investigations that are taking place
00:10:29
there's been serious question about
00:10:31
retribution of anybody coming forward
00:10:36
if there are members of the Kickapoo
00:10:40
tribe that have any information that
00:10:42
would help us solve this they have a
00:10:45
responsibility to their fellow tribal
00:10:47
members to their fellow community
00:10:49
members to come forward this is an
00:10:52
unsolved crime here on our lands let's
00:10:54
do something about it I I go through
00:11:00
each day thinking of my family thinking
00:11:04
of what could be thinking of my little
00:11:08
girl and so the most difficult thing is
00:11:11
just watching my life go by without a
00:11:15
family since the murders Shawn has left
00:11:20
Kansas but he still holds out hope that
00:11:23
someday there will be justice for Jody
00:11:26
despite Shawn's belief that a casino
00:11:29
employee was somehow involved in his
00:11:31
wife's murder
00:11:32
authorities at this time have not
00:11:34
released a list of official suspects
00:11:36
they seek your help in providing new
00:11:39
information necessary for an arrest in
00:11:41
this case
00:11:52
in a mostly working-class Hispanic
00:11:55
neighborhood in North Hollywood
00:11:56
California something extraordinary was
00:11:58
going on
00:12:01
[Music]
00:12:05
a new music school had opened and
00:12:08
hundreds of pairs eagerly signed up
00:12:09
their children for low-cost lessons the
00:12:15
school was owned by Mario Yunus and Omar
00:12:17
Arroyo who hired veteran instructors
00:12:20
that teach students a lost art of
00:12:21
playing the accordion I knew they had
00:12:25
hold of something big and I knew it was
00:12:28
gonna be a lot of money I just knew it
00:12:30
and I wanted it to work
00:12:36
Mario unis and Omar OTO Leah were an odd
00:12:39
couple Eunice was a studio musician
00:12:41
flute in several languages
00:12:43
Arroyo an aspiring salsa singer and
00:12:46
used-car salesman however there was
00:12:50
nothing unusual about their carefully
00:12:52
crafted sales pitch their enthusiasm hit
00:12:55
all the right notes Wow
00:12:57
that was excellent I'm very very proud
00:12:59
of you and I I think it's time for you
00:13:01
to move up to the next level they said
00:13:06
that my daughter had won a scholarship
00:13:08
to learn piano accordion in Oregon I
00:13:12
thought oh great you know this is the
00:13:14
perfect opportunity for my daughter to
00:13:15
to get some lessons what I need for you
00:13:18
to do is to choose one of those I'm
00:13:20
gonna recommend that Vaudrey take the
00:13:21
Mercedes back
00:13:22
Mario unis acted as a frontman charming
00:13:25
and persuasive he often met with parents
00:13:27
about his partner work behind the scene
00:13:29
was the Mercedes package is 2500 and the
00:13:32
Toyota package is 1,800
00:13:35
see I think I'll take that to you in a
00:13:36
package the package was that it was the
00:13:40
accordion that you were fine but they
00:13:42
were gonna teach three different
00:13:44
instruments by the end of the three
00:13:45
years $32 increments every month that's
00:13:48
okay and part of it would be also taking
00:13:50
them on field trips like Disneyland
00:13:56
however the ink was barely dry on the
00:13:58
contract when everything fell apart
00:14:00
early one morning Martha Guyardo dropped
00:14:03
off Vaudrey for her weekly lesson it was
00:14:06
a day mother and daughter would never
00:14:07
forget she said nobody's there they're
00:14:14
gone and I first like the oho don't be
00:14:17
silly you know but then he just like hit
00:14:19
me and I said oh my god fraud that's the
00:14:22
first thing that came into my mind
00:14:24
because I knew I had given them my
00:14:26
credit card
00:14:28
according to police Martha's instincts
00:14:30
were right
00:14:31
she had been targeted for fraud
00:14:33
reportedly arroyo and Eunice even duped
00:14:36
their own employees lying about the
00:14:38
credit card scheme and paying them with
00:14:40
bogus checks that tired of getting bad
00:14:45
checks I don't know how many bad checks
00:14:47
I got from how many different banks and
00:14:49
they said well we got another class for
00:14:51
it it's a job I gotta be paid and they
00:14:54
said well after you do this class we'll
00:14:58
pay you
00:14:59
John : well taught the class but he says
00:15:02
he never saw the money and let Martha
00:15:06
gang out he'll receive her credit card
00:15:08
bill she found a single charge for the
00:15:10
entire cost of the accordion more than
00:15:12
eighteen hundred dollars allegedly it
00:15:17
was a cheap import worth about $300
00:15:21
however many other unsuspecting families
00:15:24
unaware of laws designed to protect
00:15:26
consumers from credit card fraud were
00:15:29
reportedly hit much harder
00:15:32
the parents were mad they were angry
00:15:35
they were hurt because you know they
00:15:38
felt like okay wait a minute we have no
00:15:40
money and what are we gonna do these
00:15:42
people the credit cards were up to like
00:15:45
10,000 20,000 one particular guy was
00:15:48
39,000 according to police Omar or you
00:15:54
and Mario Yunus had swindled the money
00:15:55
through identity theft by using personal
00:15:58
information lifted from music school
00:16:00
applications Arroyo on you know cerebral
00:16:03
open fraudulent credit card accounts
00:16:05
some with substantial lines of credit in
00:16:10
just over a year
00:16:11
authorities say their take was an
00:16:13
incredible one-and-a-half million
00:16:14
dollars but these alleged con men also
00:16:17
had another trick up their sleeves one
00:16:20
that would surprise and shock everyone
00:16:25
the alleged scheme began two one rival
00:16:28
when Martha Guyardo and some of the
00:16:29
other parents found out the music school
00:16:31
had reopened at a new location a
00:16:36
confrontation with a school's director
00:16:38
the police believe was also a part of
00:16:41
our oil and unis quickly became heated
00:16:43
especially when a TV reporter shoulder
00:16:52
leave right now I'm calling the police
00:16:55
moments later officers arrived on the
00:16:58
scene unaware that the school was
00:17:00
allegedly a front for fraud the irate
00:17:07
parents were immediately escorted from
00:17:08
the building and told to take their
00:17:09
grievances to civil court however many
00:17:12
families chose to file criminal
00:17:14
complaints including Martha and her
00:17:16
husband do you have a copy of the
00:17:20
contract with you I've seasoned some
00:17:24
real unique case but I've never handled
00:17:27
a case as this were you know it has so
00:17:31
many victims
00:17:34
we have over I could say 200 victims and
00:17:38
it involves a large amount of monies
00:17:40
have you seen any two males that might
00:17:43
have looked like the owners of the place
00:17:44
detected by your quickly discovered that
00:17:47
the two alleged swindlers ran a number
00:17:49
of music schools under a variety of
00:17:50
aliases and cash is OK
00:17:53
yes meanwhile according to police homer
00:17:56
Arroyo and Mario Yunus went on separate
00:17:59
spending sprees with some of the stolen
00:18:00
cash Royer reportedly spent more than
00:18:04
$100,000 to cut a salsa CD under the
00:18:07
name Luis Omar
00:18:09
Yunus had also crafted a new identity
00:18:11
but he was playing a very different tune
00:18:16
I am his twin sister she's from Israel
00:18:19
are all yours real estate Asian did a
00:18:22
double-take and with good reason
00:18:24
Mario Yunus had undergone much more than
00:18:26
a makeover
00:18:27
he was now a she using the name Delia
00:18:31
Leon placed on take a look at ya
00:18:36
Mario Yunus had undergone a sex change
00:18:41
operation up in San Francisco and paid
00:18:45
for this operation with one of the kids
00:18:47
parents credit card charges amounted to
00:18:51
over $33,000 and that was only a portion
00:18:58
of the cost the rest was also reportedly
00:19:01
charged to various credit cards then
00:19:03
according to police Omar Arroyo and
00:19:06
Delia Leone became lovers the couple
00:19:09
lived like royalty running a luxurious
00:19:11
home in LA's Woodland Hills they give
00:19:14
the impression they were a family
00:19:15
Arroyo brought his two daughters from a
00:19:18
former marriage over from Puerto Rico
00:19:22
however life in shangri-la soon hit a
00:19:25
sour note when a new office assistant
00:19:27
reportedly received by complaints from
00:19:29
angry parents decided to go to the
00:19:31
police so why are you working I'm
00:19:36
working at kids music and that's in
00:19:39
Mission Hills it was a break detective
00:19:41
Bao needed but with only a dia sister
00:19:44
gone he would need to conduct a stakeout
00:19:46
to nail the alleged con artists we
00:19:51
conducted a surveillance in order to try
00:19:54
to identify the true identity of our
00:19:57
suspects we were able to come up with
00:20:02
their true names
00:20:03
[Music]
00:20:05
detective bio then followed the suspects
00:20:07
to their upscale neighborhood a few days
00:20:13
later armed with a search warrant police
00:20:15
raided the home reportedly Delia Leon
00:20:24
attempted to escape through the backyard
00:20:26
but was quickly apprehended she denied
00:20:32
any involvement in the credit-card scam
00:20:37
police weren't so lucky with her alleged
00:20:39
partner in crime
00:20:40
Omer Arroyo had left town just hours
00:20:43
before the raid I was surprised I'm not
00:20:49
finding Omar and I later learned that he
00:20:54
had left to Puerto Rico the night before
00:20:56
Omar was in the process of doing
00:21:00
promotions on his CD thanks to some
00:21:05
parents who refused to be victims
00:21:06
skillful police work by Detective by old
00:21:09
Delia Leon aka Mario Yunus was in
00:21:12
custody and the music schools were
00:21:14
closed down
00:21:15
fortunately Martha Garda was able to
00:21:17
clear the excessive charges from her
00:21:19
credit card but many families paid a
00:21:22
heavy price

00:21:43
on a previous broadcast we presented the
00:21:46
puzzling case of Sandra Oriana she
00:21:48
plummeted ten stories to her death from
00:21:50
this hotel balcony in Southern
00:21:52
California investigators run certain if
00:21:55
it was an accident suicide or murder
00:21:59
Sandra had come to California on a
00:22:01
business trip with her boss Robert
00:22:03
Salazar they checked into adjacent rooms
00:22:07
on the eighth floor
00:22:09
the next morning Sandra's body was found
00:22:12
sprawled on the ground below police
00:22:16
interviewed Robert Salazar he said he
00:22:19
had escorted Sandra to her room around
00:22:21
midnight he left her alive and well but
00:22:24
suspicions arose and detectives found
00:22:26
articles of his clothing in her room
00:22:28
when questioned again he offered a very
00:22:31
different story he said that he had in
00:22:35
fact gone into the room with Sandra and
00:22:38
that they had engaged in sex and that at
00:22:42
one point they were on the balcony
00:22:44
Sandra had positioned herself on the
00:22:47
railing of the balcony in such a way
00:22:49
that she threw one of her legs over the
00:22:52
top of the balcony and lost her balance
00:22:55
and had fallen
00:22:57
[Music]
00:22:59
Sandra's family was outraged by
00:23:01
Salazar's allegations they asserted she
00:23:04
would never have consensual sex with him
00:23:06
that she was devoted to her fiance
00:23:10
police used a dummy to test Salazar's
00:23:13
account of what happened we tried it
00:23:19
several times and we actually ended up
00:23:21
trying to make it land where she landed
00:23:24
and we had to basically throw the dummy
00:23:27
in that direction to make it land there
00:23:32
despite the suspicions of the police
00:23:34
Robert Salazar was not charged with any
00:23:37
crime until now on March 2nd 2001 nearly
00:23:43
five years after Sandra's death Robert
00:23:46
Salazar was arrested for her murder on
00:23:48
May 30 if he appeared at a preliminary
00:23:51
hearing in West Covina California
00:23:57
investigators said a reevaluation of
00:23:59
evidence as well as DNA tests led to the
00:24:02
district attorney finally charging
00:24:04
Salazar
00:24:07
[Music]
00:24:26
one Friday afternoon
00:24:29
Kim Schwartz was preparing dinner when
00:24:31
her seven-year-old daughter Amber asked
00:24:33
permission to play in front of the panel
00:24:34
california home but our friends are
00:24:37
gonna be here in five minutes me
00:24:40
no amber asked if she used to jump rope
00:24:43
in the hall closet and jump rope outside
00:24:46
so I walked with her over the closet
00:24:48
open up the door and she grabbed the
00:24:50
jump rope and on her way out the door
00:24:54
she just stopped and turned said I love
00:24:57
you mommy and then out the door she went
00:25:02
Amber planted jump rope until Kim's
00:25:05
friend Debbie and her daughter Marissa
00:25:07
came by
00:25:11
[Music]
00:25:16
they walk in the door and you know
00:25:19
Maurice instantly asks where amber was
00:25:21
and I said she was outside jumping rope
00:25:23
and so both of them at that point said
00:25:25
we didn't see her out there so I said
00:25:28
well maybe she was over in the vacant
00:25:30
lot she's out there it's a Marie so
00:25:33
quickly ran right up back outside
00:25:34
looking for amber she came running back
00:25:39
inside saying she didn't see her so at
00:25:42
that point I went outside I started
00:25:45
hollering Amber's name and she wasn't
00:25:52
there so I would called the only two
00:25:55
people that I thought that amber may
00:25:57
have wandered off to
00:25:58
and I got answering machines so
00:26:02
obviously they weren't there I couldn't
00:26:11
find amber it was afraid I didn't want
00:26:16
anything to be wrong I wanted her to be
00:26:19
home Kim Schwarz would never see her
00:26:25
only daughter again
00:26:28
the disappearance of amber was a second
00:26:31
devastating tragedy Kim Schwartz was
00:26:33
forced to endure her husband Bernie a
00:26:36
Pinole police officer was killed in the
00:26:38
line of duty when Kim was pregnant with
00:26:40
amber this latest tragedy would
00:26:43
transform the widowed mother of three
00:26:45
into an activist following hours of
00:26:48
searching investigators concluded amber
00:26:51
Schwartz had been abducted the morning
00:26:53
after she disappeared a pair of pink
00:26:56
socks was discovered in a park a short
00:26:58
distance from Amber's home when the park
00:27:00
had been searched the previous night the
00:27:02
socks were not there to come back the
00:27:06
next morning and find these socks in a
00:27:08
place that had already been searched
00:27:10
certainly sent up a lot of red flags
00:27:12
they were just like the socks at amber
00:27:14
had on her feet I could say that because
00:27:16
I had helped amber put her new shoes on
00:27:19
the we had just bought we knew fairly
00:27:21
quickly that this was going beyond our
00:27:23
resources and we reached out to the FBI
00:27:26
and to the neighboring agencies and
00:27:28
pulled in other resources so that we
00:27:30
could conduct a proper investigation
00:27:33
mrs. Swartz I just have a few more
00:27:35
questions that I'd like to ask you okay
00:27:36
okay okay
00:27:37
when FBI agents visited her home Kim was
00:27:40
struck by the unusual questions they
00:27:42
asked and even is social security in the
00:27:44
last two or three days no questions like
00:27:47
had I or amber received anything in the
00:27:50
mail there's someone that we didn't know
00:27:52
she had amber come home with anything
00:27:55
she couldn't really explain who it came
00:27:57
from to me had I received phone calls
00:28:00
from anyone I didn't know it just really
00:28:03
bizarre questions but the way they were
00:28:05
being asked kind of led me to believe
00:28:09
they were so specific that they had to
00:28:11
be about somebody in the days following
00:28:15
Amber's disappearance many strangers
00:28:17
offered to help but three days after her
00:28:20
daughter vanished
00:28:21
Kim was visited by a man she will never
00:28:23
forget
00:28:24
his name was Tim bindler my name's
00:28:27
Timothy
00:28:28
I'm with the search for amber for your
00:28:31
dear amber he looked like he'd been up
00:28:34
all night basically was saying how he
00:28:37
wanted to be the one to save places her
00:28:39
he wouldn't be the one to bring her home
00:28:41
to me I've been searching in a lot of
00:28:43
places that and I think some of the
00:28:45
authorities might not be searching for
00:28:46
because I know kids I'd been nurse Val
00:28:49
it's also caught Kim's attention she
00:28:51
didn't almost have like a van that he
00:28:53
painted himself he's got these plates
00:28:55
that say love you he's got that posters
00:28:59
on the outside of the van I said want
00:29:02
you to know want to be the one to find
00:29:06
her according to Kim bender became
00:29:09
extremely emotional as he talked to
00:29:11
members to be the one is safer and bring
00:29:13
her back to you thank you see amber
00:29:18
sports on June 3rd no Tim bender was
00:29:23
questioned extensively by the FBI
00:29:24
following Amber Swartz's abduction
00:29:27
according to authorities the results of
00:29:30
his polygraph were inconclusive did you
00:29:34
speak to Amber Sports on June 3rd no Tim
00:29:39
bender is a very bright man he's he's
00:29:42
very intelligent man he's a Berkeley
00:29:44
grad right up John Phil pin is a trained
00:29:47
forensic psychologist he spent more than
00:29:50
1,000 hours interviewing Tim bindler for
00:29:53
his book stalemate there are law
00:29:56
enforcement agencies which consider him
00:29:58
a suspect there's also the perception
00:30:02
shared by a number of people that Tim
00:30:06
has done absolutely nothing wrong
00:30:08
and and that he is a misunderstood good
00:30:11
Samaritan
00:30:14
to vendors attorney John Burroughs
00:30:16
maintains that benders actions should
00:30:17
not be viewed with suspicion point of
00:30:21
fact is he is trying to be helpful he
00:30:24
does that voluntarily it is a sense that
00:30:26
he has that he has an obligation and a
00:30:29
duty to go out and try to find missing
00:30:32
children according to John Filton Tim
00:30:35
bender seemed to have a particular
00:30:37
interest in the grave of a girl named
00:30:39
Angela boug a five year old Angela
00:30:42
disappeared four and a half years before
00:30:44
amber and was later found sexually
00:30:46
assaulted and strangled the FBI placed
00:30:51
Tim bender under surveillance his
00:30:53
alleged habit of visiting Angela bougas
00:30:55
grave site up to 90 times a year had
00:30:58
caught their attention to have been to
00:31:03
this little girl's grave this little
00:31:05
girl that he never knew I just can't
00:31:07
imagine anybody going to somebody's
00:31:09
grave that many times in a that period
00:31:11
of time unless there's something else
00:31:13
going on in that person's mind according
00:31:19
to John Burroughs the fact that Ben
00:31:21
their business grave sites should not
00:31:23
cast suspicion on his client
00:31:26
for him it has a special kind of
00:31:29
significance that is personal to him but
00:31:32
certainly not an indication that he's
00:31:34
putting by in that graveyard 11 days
00:31:40
after amber vanished a bloodhound from
00:31:42
the Contra Costa County Sheriff's
00:31:44
Department tractors sent to Angela's
00:31:46
gravesite police say the dog also picked
00:31:51
up amber sent in benders van however
00:31:54
California courts are often leery about
00:31:56
the reliability of bloodhound evidence
00:32:01
[Music]
00:32:03
sadly five months after Amber's
00:32:05
disappearance the East Bay Area was shot
00:32:07
by the abduction of another young girl
00:32:09
nine year-old Michaela Garrett outside a
00:32:12
hayward market as Michaela went to
00:32:16
retrieve her scooter a man forced her
00:32:18
into his car
00:32:25
by now parents and the surrounding
00:32:28
communities were living in fear then two
00:32:30
months later and nearby Dublin
00:32:32
thirteen-year-old Eileen Mitchell off
00:32:34
disappeared despite the fact that some
00:32:38
suspicions had been directed at him Tim
00:32:40
bender helps search for Eileen a few
00:32:46
years later a mother in the town of
00:32:48
Fairfield informed the police that her
00:32:50
daughter had begun receiving mail from a
00:32:52
man they didn't know one young girl was
00:32:56
getting letters from Tim oddly enough
00:33:00
these letters were written backwards and
00:33:02
had to be held up to a mirror to read
00:33:05
which I'm sure would set any parent on
00:33:07
edge you know to have your kid all of a
00:33:10
sudden get this really weird letter just
00:33:18
a few blocks from where the letter was
00:33:19
received another young girl disappeared
00:33:22
four-year-old Nicky Campbell was playing
00:33:25
in her driveway
00:33:27
Nicky lived on Salisbury Drive in
00:33:29
Fairfield and she had been out playing
00:33:31
with her brother in the afternoon mom
00:33:36
came home from work mass where's Nicky
00:33:38
while she's out playing they couldn't
00:33:40
find her four days after Nicky's
00:33:43
disappearance her scent like amber
00:33:45
Swartz's before her was allegedly
00:33:47
tracked by bloodhounds to angela Bugis
00:33:49
grave
00:33:51
the gray that Tim Binda reportedly
00:33:53
visited so regularly you put all of
00:34:02
these coincidences together you see them
00:34:04
pile up the dogs the cemetery the the
00:34:07
various sense in the various places and
00:34:09
and you really have to question which is
00:34:13
what I believe law enforcement was doing
00:34:15
and I think it's their role to do it you
00:34:18
you really have to question you know is
00:34:20
this a coincidence or is there something
00:34:21
to it if there was something more to it
00:34:23
then you would think after all this time
00:34:26
there's been some more evidence that was
00:34:27
more definitive and there hasn't been
00:34:29
any following a Nicky Campbell
00:34:32
disappearance the Fairfield Police
00:34:34
Department searched Tim benders home and
00:34:36
found nothing believing that his
00:34:38
reputation had been unfairly tarnished
00:34:40
by the Fairfield Police Department's
00:34:42
handling of the Nicky Campbell
00:34:43
investigation Tim bender brought a
00:34:46
defamation lawsuit against the city of
00:34:48
Fairfield the city settled out of court
00:34:51
for $90,000 citing the advice of his
00:34:56
attorney Tim bender turned down our
00:34:57
request for an interview although he has
00:35:00
been questioned by police it's important
00:35:02
to note that bender has not been charged
00:35:04
with any crime relating to the
00:35:05
disappearances of these girls and he has
00:35:08
consistently claimed he is innocent
00:35:10
Kim Schwartz refuses to give up even
00:35:13
though amber would today be in her 20s
00:35:16
Kim will not rest until she finds out
00:35:18
what happened to her daughter within
00:35:22
weeks of Amber's disappearance
00:35:24
Kim Schwartz created the amber
00:35:25
foundation for missing children the
00:35:28
Foundation's goals continue to be
00:35:30
educating parents on ways to prevent
00:35:32
child abductions so that what happened
00:35:34
to Kim Schwarz may never happen to them
00:35:37
[Music]
00:36:06
[Applause]
00:36:09
the previous broadcast we brought you
00:36:11
the story of Gilbert Ortiz who was
00:36:13
looking for his young son Jonathan
00:36:15
authorities suspected that Gilbert's
00:36:17
wife had taken Jonathan after she'd been
00:36:19
accused of committing a heinous crime
00:36:22
after eight years Gilbert and his son
00:36:25
had finally been reunited after serving
00:36:31
in the military
00:36:32
gilbert ortiz moved with his wife and
00:36:34
child to Redwood City California though
00:36:38
they were happy at first gilbert and
00:36:40
elizabeth fought frequently over money
00:36:42
and gilbert received a promotion at work
00:36:45
he thought that his future suddenly
00:36:47
seemed brighter but within a week
00:36:49
gilbert ortiz was in a hospital
00:36:51
suffering from cardiac arrest kidney
00:36:54
failure and pneumonia and fighting for
00:36:56
his life doctors worked feverishly to
00:36:59
determine what had caused him to become
00:37:01
so violently ill after lapsing in and
00:37:04
out of consciousness for two weeks
00:37:06
Gilbert told police he thought he might
00:37:08
have been poisoned I lift weights and of
00:37:11
it I I I could never get picked that's
00:37:17
the kind of guy she likes Gilbert said
00:37:20
Elizabeth met him in a store parking lot
00:37:22
to give him a special bodybuilding drink
00:37:24
which had already been mixed in a
00:37:26
plastic sports bottle he looked like a
00:37:28
real shake I mean like a chocolate shake
00:37:31
and then I want to try to sort of like
00:37:34
burn my throat and then my throat really
00:37:36
really burning you know and I was all
00:37:38
shaky and then I feel like getting sick
00:37:44
paramedics came and washed we'll go to
00:37:46
the hospital
00:37:47
Elizabeth Ortiz met them in the
00:37:49
emergency room doctors hoped that she
00:37:51
could provide an explanation for
00:37:53
Gilbert's sudden mystery illness
00:37:57
we needed to know where that sports
00:37:59
bottle came from if it was something
00:38:02
that was purchased from a fast-food
00:38:04
store and it was really a bad mixture
00:38:08
that really made him sick or whether it
00:38:09
was a deliberate mix after he had had
00:38:16
been determined that the shake had been
00:38:17
tainted with a common insecticide police
00:38:20
obtained a search warrant to see if they
00:38:22
could trace it or the plastic bottle to
00:38:24
Elizabeth but when they arrived at the
00:38:26
Ortiz apartment they discovered that
00:38:28
Elizabeth Ortiz had vanished along with
00:38:31
Jonathan then that's when it hit me she
00:38:35
did want to tell me so where's the baby
00:38:38
sure he's gone that's that's the main
00:38:41
point that when he got me with the
00:38:45
evidence they gathered police are able
00:38:47
to make a case against Elizabeth went is
00:38:49
Ortiz accusing her of attempted murder
00:38:52
with special circumstances for torture
00:38:58
after following thousands of tips with
00:39:01
possible sightings of Elizabeth Ortiz
00:39:03
sergeant Catherine Anderson finally
00:39:05
received a phone call from an FBI agent
00:39:11
basically March 14th of 2000 - call from
00:39:16
the FBI telling me that they had
00:39:18
Elizabeth Ortiz in custody in Mexico
00:39:20
when Elizabeth was arrested in Mexico
00:39:23
she was by herself
00:39:24
the FBI gave me their word that they
00:39:26
