Forensic Files (HD) - Season 13, Episode 23 - Drowning Sorrows - Full Episode

March 05, 2021 / 21:16

This episode covers the tragic death of Florence Unger, the investigation into her drowning, and the subsequent murder trial of her husband Mark Unger.

The Unger family vacation in Watervale, Michigan, turned into a nightmare when Florence's body was discovered in the lake. Initial investigations suggested an accident due to a broken railing, but experts disagreed on the circumstances of her death.

Mark Unger, a mortgage broker and radio personality, was the last person to see Florence alive. After her death, he maintained it was an accident, but evidence began to suggest otherwise, including his gambling issues and Florence's recent plans for divorce.

Forensic analysis revealed that Florence suffered severe head trauma and was alive for a significant time after her fall. Mark's shoes were found to have paint matching the broken railing, leading investigators to suspect foul play.

Ultimately, Mark Unger was convicted of first-degree murder and sentenced to life without parole, with forensic evidence playing a crucial role in the case.

TL;DR

Florence Unger's drowning was ruled a murder, leading to her husband Mark's conviction after forensic evidence revealed foul play.

up next a family vacation turns into a
00:00:07
nightmare that's when i see the body of
00:00:10
a female lying face down in the water
00:00:12
and possible clues provide more
00:00:14
questions than answers either it was an
00:00:17
accident someone caused her death or she
00:00:20
killed herself experts can't seem to
00:00:22
agree on exactly what happened there is
00:00:25
not one single eyewitness to anything
00:00:27
there are no confessions there are no

every year the younger family spent
00:00:52
their vacation on the western shore of
00:00:54
lake michigan in a place called
00:00:56
watervale
00:00:58
it's almost a sanctuary for them to go
00:01:00
somewhere else in the state where they
00:01:02
can just forget about the rest of the
00:01:04
world and reconnect with her with
00:01:06
themselves and their families and their
00:01:08
loved ones
00:01:09
florence worked as a bank loan officer
00:01:12
her husband mark a mortgage broker was
00:01:15
also a well-known radio personality
00:01:18
mark unger had a sports radio show and
00:01:20
made him somewhat of a celebrity within
00:01:23
a circle of friends
00:01:25
their vacation in 2003 was like most
00:01:28
others the youngers checked into their
00:01:30
cabin had dinner and mark spent time
00:01:33
with their two sons while florence was
00:01:36
outside for some fresh air
00:01:38
i read a story to the boys
00:01:40
sang a song put them to bed kiss them
00:01:42
good night
00:01:44
and came back out to the deck and that
00:01:47
florence was not on the deck
00:01:49
mock assumed florence went next door to
00:01:52
their friend's cabin since their lights
00:01:54
were on
00:01:57
not wanting to leave the children alone
00:01:59

00:02:03
when he awoke just after dawn
00:02:05
florence still wasn't there
00:02:08
he called the resort owners
00:02:10
approximately 7 30 in the morning
00:02:12
asking them if they had seen florence
00:02:15
they said they had not
00:02:17
the resort owners went looking for her
00:02:19
and found florence's body in the lake
00:02:22
and called 911.
00:02:25
there was a guest at waterdale there was
00:02:27
an acquaintance of it and i believe this
00:02:30
suicider is drowning what is her name
00:02:34
when police arrived
00:02:36
they noticed florence's body was in the
00:02:39
lake next to a boat launch
00:02:41
12 feet above was the deck outside the
00:02:45
unger's cabin
00:02:46
when i looked up there was a deck
00:02:48
railing from the boathouse and i noticed
00:02:50
the deck railing was broke and fractured
00:02:53
out
00:02:55
it looked as if florence had been
00:02:56
sitting on the railing and it gave way
00:03:00
investigators measured the height of the
00:03:03
railing and discovered that it was 10
00:03:06
inches below the state building code
00:03:09
you look at that rail and it's low
00:03:11
enough that you think if somebody had
00:03:12
been sitting on it they could lose their
00:03:14
balance and fall over the edge i know
00:03:16
that i personally didn't want to sit on
00:03:18
it
00:03:19
the splintered railing led to suspicions
00:03:22
it was structurally unsound
00:03:24
they referred to it as a death trap and
00:03:26
that it was an accident waiting to
00:03:28
happen a person could reasonably
00:03:31
pieced together
00:03:32
someone fell through a railing hit the
00:03:35
ground and ended up perhaps in the lake
00:03:37
there
00:03:39
florence's body was transported to the
00:03:41
medical examiner for an autopsy
00:03:44
the medical examiner found no drugs or
00:03:47
alcohol in her system
00:03:49
he did find evidence of severe head
00:03:53
trauma
00:03:54
but the cause of death
00:03:56
wasn't the head trauma
00:03:58
it was drowning there was plenty of
00:04:02
fluid and
00:04:04
that was the result of her active
00:04:08
inhalation
00:04:09
of the water from the lake because she
00:04:11
was submerged
00:04:13
but what caused florence to fall to her
00:04:16
death
00:04:17
was it suicide an accident
00:04:20
or something more sinister
00:04:24
this is flo unger and she was a student
00:04:27
from
00:04:28
1975 to 1978.
00:04:31
the tragic death of florence unger the
00:04:34
mother of two young children was a shock
00:04:36
to co-workers friends and family
00:04:39
unless you've lived through it it's very
00:04:41
difficult to explain you're you feel
00:04:43
like your head's going to explode it's
00:04:45
totally complete devastation there's
00:04:47
nothing like it it's unimaginable
00:04:50
police at the scene had to consider
00:04:52
every possibility
00:04:54
what do you have you know do you have a
00:04:56
suicide do you have an accident
00:04:58
or or do you have a homicide
00:05:00
florence's family ruled out suicide as a
00:05:03
possibility
00:05:05
there's no way that she could have
00:05:07
contemplated suicide for a number of
00:05:09
reasons number one she would never have
00:05:11
left her children
00:05:14
parentless
00:05:15
an accident seemed like a distinct
00:05:17
possibility the railing on the deck
00:05:20
outside the younger's cabin was freshly
00:05:22
broken
00:05:24
it looked as if she were sitting or
00:05:26
leaning on it and it gave way
00:05:29
causing her to fall to the boat launch
00:05:31
below
00:05:32
but how did the body get into the water
00:05:36
mark unger hired a private independent
00:05:39
forensic firm to find out why
00:05:42
they concluded
00:05:43
that with florence falling 12 feet from
00:05:46
the deck the momentum of the fall
00:05:48
carried her forward from the point of
00:05:51
impact they produced five different
00:05:54
scenarios computer animations that
00:05:56
showed different ways
00:05:58
that florence could have possibly ended
00:06:00
up in the water
00:06:02
the forensic firm concluded that
00:06:04
florence's death was an accident
00:06:08
but the medical examiner completely
00:06:11
disagreed
00:06:12
bodies do not bounce that's number one
00:06:15
she would have been rendered unconscious
00:06:17
upon contact an unconscious person
00:06:20
unconscious individual cannot just
00:06:23
walk into the water
00:06:26
and dr dragovich noticed that the blood
00:06:28
stain on the boat launch was nearly a
00:06:31
foot in
00:06:32
diameter for blood to go to that size to
00:06:37
the diameter that we're talking on the
00:06:39
cement platform
00:06:41
the body would have had to bend there
00:06:42
for a period of time
00:06:44
to find out how long florence would have
00:06:46
laid their bleeding dr dragovich
00:06:48
examined slides of her brain tissue
00:06:52
he focused on the neurons
00:06:55
a cellular communication system that
00:06:57
controls movement memory and emotion
00:07:02
dr dragovich discovered
00:07:04
repair proteins in florence's brain that
00:07:07
were released after her head injury
00:07:11
this showed that florence's brain was
00:07:14
struggling to survive long after she hit
00:07:17
her head
00:07:18
and before she drowned
00:07:20
these neurons are suffering from lack of
00:07:23
oxygen
00:07:24
they are damaged and there some of them
00:07:27
are already dead but some of them are
00:07:30
trying to repair themselves it was a
00:07:32
long period of time
00:07:34
she was alive unconscious but alive
00:07:36
still alive still breathing
00:07:40
dr dragovich estimated that florence was
00:07:43
lying on the cement for at least 90
00:07:46
minutes possibly for as long as two
00:07:48
hours before she was in the water
00:07:52
and there was other conflicting evidence
00:07:56
the blood stain on the boat launch and
00:07:58
the broken railing above
00:08:00
did not line up
00:08:02
the trajectory
00:08:04
of where she wound up on the deck was
00:08:07
not in line with where the break in the
00:08:10
railing occurred
00:08:12
to see whether the deck railing was
00:08:14
structurally unsound analysts tested an
00:08:17
unbroken section of the deck railing
00:08:20
using what's called
00:08:21
a load cell
00:08:23
the load cell
00:08:25
is more or less a scale it's a series of
00:08:28
springs and sensors and it measures
00:08:30
compression and tension
00:08:32
florence weighed 110 pounds
00:08:35
to simulate her sitting on the railing
00:08:38
analysts attached a bicycle seat to one
00:08:41
end of the load cell
00:08:43
to the other end they attached a t-bar
00:08:46
to which they applied
00:08:48
200 pounds of pressure the railing
00:08:51
didn't buckle
00:08:52
or break
00:08:54
somebody from the lab made the comment
00:08:56
wow 200 pounds so we knew right then and
00:08:58
there that
00:09:00
any any
00:09:01
plan to paint the rail is is rotting and
00:09:04
dilapidated weren't going to work
00:09:06
it was beginning to look like the scene
00:09:09
had been staged to look like an accident
00:09:14
it was a charge florence's husband mark
00:09:16
adamantly denied
00:09:18
people that knew mark said mark was not
00:09:20
a killer
00:09:21
mark would not do that
00:09:23
that he loved flo that he loved his
00:09:25
family that
00:09:27
that he would not do anything like that
00:09:29
mark had no criminal history
00:09:32
and his children said they heard nothing
00:09:34
suspicious on the night of the incident
00:09:36
no argument or fight between their
00:09:38
mother and father
00:09:40
mark continued to maintain his wife's
00:09:42
death was a tragic accident
00:09:45
he told the police she had been a little
00:09:46
depressed but he later went
00:09:49
on to tell the police flo would have
00:09:51
never committed suicide he was adamant
00:09:53
about that
00:09:54
but florence's family believed
00:09:57
this was murder
00:09:59
and that mark was her killer
00:10:02
method
00:10:03
opportunity motive
00:10:05
no alibi and last person to see them
00:10:08
alive classic reasons for murder
00:10:10
he had them all
00:10:16
mark and florence unger appeared to have
00:10:18
an ideal marriage
00:10:20
on the surface they would appear to be
00:10:22
the perfect couple living in an affluent
00:10:25
community with two beautiful children a
00:10:26
beautiful house but to those who were in
00:10:29
their inner circle they knew that there
00:10:30
were many many problems
00:10:33
mark unger's issues with drugs and
00:10:35
gambling had cost him his job
00:10:38
he was a pathological gambler mark was a
00:10:41
an alcoholic he was a drug addict and
00:10:44
this this was affecting his uh his
00:10:46
personality
00:10:47
he spent as much as six months at a time
00:10:49
in rehab
00:10:51
florence actually said at one point it
00:10:53
almost seemed like rehabilitation had
00:10:55
become his job
00:10:56
police also learned that florence had
00:10:59
filed for divorce two months before her
00:11:01
death and had moved on to another
00:11:03
relationship
00:11:04
there was evidence of a relationship
00:11:06
that flo had become involved in and this
00:11:09
individual was a close friend of marx as
00:11:11
well so it was a
00:11:15
difficult circumstance at best
00:11:18
investigators discovered that florence
00:11:20
had seen this man just a few days before
00:11:22
her death and that mark might have known
00:11:26
about it
00:11:27
i believe on that deck that it's a very
00:11:28
real possibility that something about
00:11:30
florence's relationship came out
00:11:34
and now
00:11:35
yet another potential motive emerged
00:11:38
florence had two life insurance policies
00:11:41
with a combined value of three-quarters
00:11:44
of a million dollars and mark
00:11:46
was the sole beneficiary
00:11:49
there's no question that flo was worth
00:11:51
more debt to mark than she was alive
00:11:54
even stranger just five days before his
00:11:57
wife's death mark had a run of bad luck
00:11:59
at a local casino
00:12:01
we understand that he lost about seven
00:12:03
thousand dollars
00:12:05
shortly before
00:12:06
a fateful trip
00:12:09
and i mean within within days of that
00:12:11
fateful trip
00:12:13
and friends told investigators
00:12:16
florence didn't want to take the trip to
00:12:18
the lake in fact
00:12:20
she was afraid to go
00:12:22
clo's friends were all apprehensive
00:12:24
several of her friends asked her why are
00:12:26
you doing this why are you going up
00:12:28
there she did not want to go but she was
00:12:30
afraid to go and she admitted that to a
00:12:32
neighbor
00:12:34
and if that weren't enough
00:12:36
the resort owner gave police even more
00:12:38
evidence also circumstantial
00:12:43
he said when he told mark he had found
00:12:46
florence's body
00:12:48
mark didn't ask him where it was
00:12:51
the resort owner absolutely positively
00:12:54
testified
00:12:56
that he did not tell mark where flo was
00:12:59
florence was
00:13:00
but mark appeared to know
00:13:03
exactly where to go mark ran right to
00:13:07
florence's body lying in the water
00:13:09
without being told where she was at and
00:13:12
without being able to observe her from
00:13:14
his vantage point
00:13:16
to prove this
00:13:17
investigators placed a mannequin in the
00:13:19
water exactly where florence's body was
00:13:22
found
00:13:24
then an investigator with a video camera
00:13:26
stood at the exact spot where the resort
00:13:30
owner told mark his wife was dead
00:13:33
in this videotape
00:13:35
it's clear the body can't be seen until
00:13:38
the viewer is virtually on top of it
00:13:41
he knew exactly where the body was at
00:13:44
but none of this proved murder
00:13:47
in fact
00:13:48
investigators had no direct evidence
00:13:51
linking mark
00:13:52
to florence's death
00:13:55
that is
00:13:56
until they looked at mark unger's shoes
00:14:00
and found
00:14:01
a white smear the state police crime lab
00:14:05
found a white
00:14:07
speck of what they
00:14:09
uh
00:14:10
believed was paint
00:14:12
investigators sent mark's shoe along
00:14:15
with six different paint samples
00:14:17
collected from the resort to forensic
00:14:19
scientist keith lamont
00:14:22
i received several known samples from
00:14:24
various locations from the vacation home
00:14:26
and boathouse area
00:14:28
he bombarded the sample with infrared
00:14:31
light which identifies the chemical
00:14:34
makeup of the samples in ways that can
00:14:36
then be measured
00:14:38
paints composition basically consists of
00:14:41
a solvent which is a liquid
00:14:44
a pigment which is the color
00:14:46
and a binder and the binder you can
00:14:48
think of as glue
00:14:49
lamont found that the paint on mark
00:14:52
unger's shoe was virtually identical to
00:14:55
the paint on the railing and the post
00:14:58
holding the railing
00:15:00
the question paint sample from the
00:15:01
stronger shoe was consistent chemically
00:15:04
with the known paint from the rail
00:15:10
to investigators
00:15:12
this pointed to only one logical
00:15:15
conclusion
00:15:16
we believe mark kicked that railing and
00:15:18
the paint stuff on the shoe certainly
00:15:20
would suggest that
00:15:22
but
00:15:23
was this enough
00:15:24
to get a conviction
00:15:30
investigators knew two important details
00:15:32
about the death of florence unger
00:15:35
first
00:15:36
tests showed a 110 pound woman sitting
00:15:40
or leaning against the deck railing
00:15:42
could not have caused it to splinter
00:15:45
second
00:15:46
forensic tests identified repair
00:15:49
proteins in florence's brain
00:15:52
scientific proof that she lay bleeding
00:15:55
on the cement boat launch for about 90
00:15:58
minutes before she drowned in the lake
00:16:02
this made forensic history
00:16:05
it was the first time
00:16:08
immunohistochemistry was used in a
00:16:10
criminal case
00:16:12
it's an advantage of being a forensic
00:16:15
pathologist at the same time a
00:16:17
neuropathologist and being a general
00:16:19
pathologist that i started with in the
00:16:21
first place
00:16:23
the best advice in police work is
00:16:26
consider every
00:16:28
death scene as a homicide scene
00:16:31
seven months after florence's death
00:16:34
mark unger was charged with first-degree
00:16:37
murder there's no question if you look
00:16:39
at the evidence in its totality um that
00:16:42
mark unger made a calculated decision to
00:16:44
take another person's life
00:16:46
his lawyer said there was no case
00:16:48
against him
00:16:49
there is not one single eyewitness to
00:16:51
anything there are no confessions there
00:16:54
are no fingerprints
00:16:58
prosecutors believe mark hoped to
00:17:00
salvage their marriage
00:17:02
but they think florence said no
00:17:05
mark became violent and pushed her over
00:17:08
the railing
00:17:11
she hit her head on the boat launch 12
00:17:13
feet below
00:17:15
the evidence indicates she lay there
00:17:17
bleeding for at least 90 minutes
00:17:22
mark went back to their cabin and put
00:17:25
the boys to bed
00:17:29
when he returned to the boat launch
00:17:31
he was probably surprised to learn that
00:17:33
florence was still alive
00:17:36
[Music]
00:17:40
so he pushed her into the lake
00:17:42
where she drowned
00:17:44
but he didn't realize the size of the
00:17:47
blood stain on the boat launch
00:17:49
and the repair neurons in florence's
00:17:52
brain
00:17:54
both
00:17:55
told a story
00:17:57
in an attempt to make it look like an
00:17:59
accident mark kicked the railing with
00:18:01
his right foot transferring paint to the
00:18:05
tip of his shoe
00:18:07
and where he kicked the railing was
00:18:09
inconsistent with the location of the
00:18:12
body
00:18:13
mark
00:18:14
either
00:18:16
found out about the relationship that
00:18:17
florence was having with another man or
00:18:20
else he if not found out she made it
00:18:23
clear to him that you know that's only
00:18:25
one of the things going on but this
00:18:27
marriage is finished what mark did is he
00:18:29
went out there
00:18:30
and he put her in the water
00:18:34
while she was still alive he had every
00:18:36
opportunity to call for help he never
00:18:38
did he let her lay there
00:18:40
and after thinking about what to do
00:18:42
after some time he premeditated it went
00:18:44
back and put her in the water and let
00:18:46
her drown
00:18:48
three years after florence's death
00:18:51
mark unger was convicted of first-degree
00:18:54
murder and sentenced to life without
00:18:56
parole
00:18:58
his head snapped back
00:19:00
when the verdict was read he was shocked
00:19:03
at the verdict he anticipated going home
00:19:05
that day
00:19:07
i was wrongfully convicted of this crime
00:19:11
i am innocent
00:19:13
florence's parents say her death should
00:19:17
never have happened
00:19:18
while my daughter's death was a tragic
00:19:21
and unnecessary event i think there's a
00:19:23
lesson to be learned from it
00:19:24
and that is
00:19:26
that a woman who is going through a
00:19:28
divorce
00:19:29
should avoid contact
00:19:31
with her estranged husband
00:19:33
unless it's absolutely necessary
00:19:35
and then with witnesses present and even
00:19:38
though it might be contrary to the
00:19:40
advice of her lawyer
00:19:42
and even
00:19:44
if there's no history
00:19:46
of
00:19:48
mental or physical abuse
00:19:51
divorce is a very volatile situation
00:19:55
and it is better to er on the side of
00:19:57
caution
00:19:58
because
00:20:00
even casual contact
00:20:02
could result in a
00:20:05
dangerous or life-threatening event
00:20:09
florence's parents are raising her
00:20:11
children
00:20:12
and keep a small garden in her memory
00:20:16
although the grief
00:20:17
is permanent
00:20:19
i miss her every single minute
00:20:21
of every single day
00:20:26
and i hope he thinks about what he's
00:20:28
done
00:20:29
for the rest of his miserable life
00:20:33
mark unger
00:20:35
almost got away with murder
00:20:38
only scientific analysis of brain tissue
00:20:41
and his shoes
00:20:43
ensured he didn't
00:20:46
how he could think that he was going to
00:20:47
get away with it i can't imagine being
00:20:49
able to establish that
00:20:51
that florence was alive for an extended
00:20:54
period of time
00:20:55
before she was placed in the water was
00:20:57
was crucial
00:20:59
very important
00:21:00
it was a great
00:21:02
you know reminder that you know things
00:21:05
aren't always as what they seem they're
00:21:07
not always what people try to portray
00:21:09
them to be
00:21:12
