Forensic Files - Season 6, Episode 18 - Bad Blood - Full Episode

November 24, 2021 / 22:37

This episode covers the alleged rape case of Candy by Dr. John Schneeberger in Kipling, Saskatchewan, and the ensuing legal battles over DNA evidence.

Candy, a gas station employee, claims she was raped by her doctor after receiving a sedative. Despite her accusations, Dr. Schneeberger maintained his innocence, and DNA tests initially cleared him.

The case took a turn when Candy discovered DNA evidence on a lip balm linked to Dr. Schneeberger, but it could not be used in court due to illegal acquisition. The investigation faced challenges, including community skepticism and conflicting evidence.

Years later, new allegations against Dr. Schneeberger from his stepdaughter emerged, leading to further DNA tests that ultimately matched him to the crime. He was found guilty of sexual assault and drugging Candy.

Candy's relentless pursuit of justice is highlighted, showcasing the complexities of the case and the eventual conviction of Dr. Schneeberger.

TL;DR

Candy accuses Dr. Schneeberger of rape; DNA tests initially clear him, but new evidence leads to his conviction years later.

nestled along canada's beautiful

00:01:01
the population is so sparse the farm
00:01:04
animals outnumbered the residents
00:01:08
in a town this size everyone knows one
00:01:11
another
00:01:13
it's a fairly quiet farming community
00:01:15
with a little crime we may have
00:01:18
up to five or six sexual assaults a year
00:01:21

00:01:28
this is the story of one of those
00:01:30
alleged sexual assault cases
00:01:33
it took place on halloween night in
00:01:35
1992.
00:01:38
depending on whose story you believe
00:01:41
it was either a night of lies and
00:01:44
trickery or an unfortunate
00:01:46
misunderstanding
00:01:48
a woman we'll call candy was working at
00:01:51
this gas station her boyfriend stopped
00:01:54
by
00:01:55
they got into an argument i am not
00:01:57
dealing with you anymore i can't even
00:01:59
stand to look at you

[Music]
00:02:05
candy drove to see her girlfriend who
00:02:08
worked at the kipling memorial union
00:02:10
hospital
00:02:11
she wasn't there
00:02:13
candy appeared upset
00:02:15
a nurse suggested she see a doctor
00:02:19
dr john schneeberger was on call that
00:02:22
night he was also candy's doctor and had
00:02:25
even delivered her baby
00:02:28
candy says dr schneeberger recommended a
00:02:31
sedative
00:02:32
i wasn't really hysterical anymore but
00:02:36
what i told him was that i was so mad at
00:02:38
danny that
00:02:39
that i felt like killing him
00:02:42
but i didn't actually mean that i was
00:02:44
going to go out and kill him i was just
00:02:45
describing the
00:02:47
how angry i was
00:02:49
i had just expected that he would give
00:02:51
me a couple pills or something
00:02:53
just to relax my muscles calm me down
00:02:57
instead
00:02:58
dr schneeberger gave candy a shot
00:03:01
she says she went numb almost
00:03:04
immediately
00:03:06
i had no control over my muscles it's
00:03:08
like all my muscles left and i was just
00:03:11
this piece of jelly falling over
00:03:14
i tried to scream
00:03:16
as i was falling over nothing would come
00:03:19
out except for
00:03:20
like a croaking noise that a frog would
00:03:22
make it was just it was so scary
00:03:25
candy isn't exactly sure what happened
00:03:28
next but believes
00:03:30
she was raped when a dentist freezes
00:03:34
your gums
00:03:35
you can't and he's pulling pulling your
00:03:38
tooth out
00:03:39
you can't feel
00:03:41
the the pain from the tooth but what you
00:03:44
can feel is pressure of the tooth moving
00:03:47
back and forth and
00:03:49
and that's that's the only way i can
00:03:51
describe it
00:03:53
when she regained consciousness alone in
00:03:56
the exam room candy had the presence of
00:03:58
mind to place her underwear in an
00:04:01
air-tight bag
00:04:04
candy was too dizzy to leave the
00:04:07
hospital
00:04:08
the nurses insisted she spend the night
00:04:11
she said nothing of the alleged rape the
00:04:14
next day
00:04:15
she confronted dr schneeberger
00:04:19
i said
00:04:21
the hell was that drug you gave me last
00:04:22
night
00:04:25
and he asked me why did it give you wild
00:04:27
dreams
00:04:29
and then
00:04:31
and then i knew that oh my god i was
00:04:34
gonna have a hell of a fight on my hands
00:04:37
because here now he's already
00:04:40
already covering up eh
00:04:43
when candy was released from the
00:04:45
hospital she spoke briefly with her
00:04:46
parents and told them of her suspicions
00:04:50
you could tell by the look on her face
00:04:52
that
00:04:53
that something terrible had happened to
00:04:55
her
00:04:57
i was really hoping that wasn't true eh
00:04:59
but
00:05:00
when we saw her we knew it was
00:05:03
she then drove to regina a town two
00:05:06
hours drive away
00:05:08
and went to a rape clinic for testing
00:05:12
there they found evidence of semen on
00:05:15
her panties jeans and on a vaginal swab
00:05:20
that was part of my reasoning for going
00:05:22
for the rape kit
00:05:24
to find out if this really did happen or
00:05:27
is am i going nuts did my mind play some
00:05:30
tricks on me or what the hell is going
00:05:31
on here blood tests also revealed an
00:05:35
unusual drug in candy's system a drug
00:05:38
called versed
00:05:40
they use it as a pre-anaesthetic agent
00:05:42
to induce
00:05:44
anesthesia you start to
00:05:46
go numb and not feel the power of your
00:05:48
muscles you're able to
00:05:50
use your muscles and then you become
00:05:52
very tired and then asleep
00:05:54
when candy formally accused dr
00:05:56
schneeberger of rape
00:05:58
many residents of kipling believed candy
00:06:01
was lying
00:06:03
dr schneeberger was a respected member
00:06:06
of the community he had never been
00:06:08
accused of anything like this before
00:06:12
some believed candy as a single mother
00:06:14
was either romantically interested in
00:06:17
the married doctor or her motive was to
00:06:19
get some sort of financial settlement to
00:06:22
end the controversy
00:06:24
the town looked up to the doctor he was
00:06:26
a good doctor
00:06:28
and
00:06:29
he would never do anything like that it
00:06:31
was impossible
00:06:33
also suspicious was the fact that candy
00:06:36
had said nothing to hospital nurses on
00:06:39
the night of the alleged rape
00:06:41
there were two nurses on shift that
00:06:44
night
00:06:45
in fact both of them were in that room
00:06:47
the room that the
00:06:48
the rape allegedly occurred in very
00:06:51
shortly after
00:06:53
they saw nothing amiss
00:06:57
to end the controversy dr schneeberger
00:06:59
willingly agreed to give blood for a dna
00:07:02
test
00:07:03
the dna in the blood drawn from dr
00:07:06
schneeberger did not match the
00:07:07
biological material from candy's rape
00:07:10
test kit
00:07:12
and i was in shock again
00:07:15
and i said no that's impossible
00:07:17
that's impossible how can this be
00:07:22
seven more years would go by
00:07:25
before that question was finally
00:07:27
answered
00:07:32
when dna tests showed that dr
00:07:34
schneeberger was innocent of the sexual
00:07:36
assault on his 20 year old patient most
00:07:39
people in kipling tried to put the whole
00:07:42
thing behind them
00:07:45
but candy the alleged victim would not
00:07:48
let the issue die
00:07:50
all during the next year she insisted
00:07:53
that someone somehow had tampered with
00:07:57
the first dna test at the hospital
00:08:00
[Music]
00:08:02
so dr schneeberger agreed to a second
00:08:05
dna test in august of 1993.
00:08:10
his blood was drawn by a registered
00:08:12
nurse
00:08:13
the test was monitored by the police
00:08:16
and the vials were taken directly to the
00:08:18
forensic laboratory at police
00:08:20
headquarters
00:08:23
they watched the needle actually
00:08:25
penetrate the doctor's arm
00:08:27
once again
00:08:28
dr schneeberger's dna did not match the
00:08:31
dna on candy's clothing or the rape test
00:08:34
kit
00:08:36
of course i didn't believe them
00:08:38
a lot of other people did believe them
00:08:41
and i guess it's hard you know how
00:08:43
you've got
00:08:44
dna is the new thing and it's supposed
00:08:46
to be so right and so perfect
00:08:49
we knew there was something
00:08:51
something wrong that
00:08:53
like we totally believed her right
00:08:56
and
00:08:57
we knew he was up to something
00:08:59
dr schneeberger defended himself by
00:09:02
saying the drug he injected into candy
00:09:04
that night in the hospital versed can
00:09:07
cause
00:09:08
erotic hallucinations
00:09:11
versa can account for all sorts of
00:09:13
hallucinations possibly but it can't
00:09:16
produce semen
00:09:17
and according to the complainant
00:09:20
the last time she had had intercourse
00:09:22
was
00:09:23
uh weeks before
00:09:25
this this incident
00:09:28
with no other evidence in 1994 the
00:09:32
police closed their investigation into
00:09:34
this matter
00:09:36
the doctor has already given two samples
00:09:39
and those two samples were
00:09:42
tested and they came up as being
00:09:45
having a dna profile and the profile
00:09:47
didn't match the
00:09:49
semen that was left at the scene so now
00:09:52
we're stuck
00:09:53
we really can't do anything
00:09:57
the town of kipling
00:09:59
was not kind at all to candy
00:10:04
she hired a private investigator who
00:10:07
broke into dr schneeberger's car
00:10:09
[Music]
00:10:14
on the headrest
00:10:15
he found strands of hair
00:10:18
but there were no roots attached so they
00:10:21
couldn't be used for dna testing
00:10:24
also in the car was a tube of lip balm
00:10:27
presumably used by dr schneeberger
00:10:32
at her own expense candy asked a private
00:10:34
lab to test the epithelial cells on the
00:10:37
end of the lip balm
00:10:40
those epithelial cells would contain
00:10:42
enough dna for testing and when they did
00:10:48
candy finally got her first piece of
00:10:50
positive news
00:10:53
the dna from the lip balm matched the
00:10:55
dna from candy's rape test kit
00:10:59
i knew it all along it wasn't a shock
00:11:01
that something was going to match but
00:11:04
it was a it was a bit of relief because
00:11:06
at least we had that
00:11:08
to prove to the police
00:11:10
but there were two problems first there
00:11:13
was no proof that the cells were dr
00:11:15
schneeberger's second
00:11:17
the evidence couldn't be used in court
00:11:19
since the investigator broke into the
00:11:21
car without a warrant
00:11:25
but if the cells on the lip balm were
00:11:27
those of dr schneeberger
00:11:30
why did the dna from his lips differ
00:11:33
from his blood sample
00:11:36
to find out
00:11:38
candy filed a civil suit against dr
00:11:40
schneeberger and brought charges against
00:11:43
him with the local medical society
00:11:46
at the hearing
00:11:48
candy sat directly across from dr
00:11:51
schneeberger's wife
00:11:53
if looks could kill i would have been
00:11:55
dead lisa was sitting
00:11:57
across the table from me
00:11:59
and she just sat there with her arms
00:12:01
crossed just glaring at me like you
00:12:04
little [ __ ] you are ruining our lives
00:12:08
and i just sat in my chair thinking oh
00:12:11
my god you're so stupid you know
00:12:15
you are so stupid and if you don't watch
00:12:17
it it's gonna happen to your kids too
00:12:20
all of this pressure prompted dr
00:12:23
schneeberger to agree to yet another dna
00:12:26
test
00:12:27
this time the procedure was videotaped
00:12:30
by police and performed at their
00:12:32
forensics lab
00:12:34
the doctor appears friendly and helpful
00:12:38
the technician wants to take blood from
00:12:40
his finger
00:12:41
but the doctor politely refuses saying
00:12:44
he has a disease that would cause his
00:12:46
hands to bruise
00:12:49
that's how we usually take the sample we
00:12:50
don't need much blood
00:12:52
since this is a voluntary test
00:12:55
the doctor can't be forced to do
00:12:57
anything against his will
00:13:00
so the technician inserts a needle into
00:13:02
his left arm
00:13:04
instead nothing comes out
00:13:08
the vein was larger
00:13:10
or appeared much larger than i would
00:13:12
have expected
00:13:14
and i thought that was a little unusual
00:13:17
she tries another tube but still has
00:13:20
trouble
00:13:22
sometimes the vacuum is poor in them and
00:13:24
would not pull the blood out of the
00:13:26
individual's arm
00:13:28
eventually she was able to extract a
00:13:30
sample
00:13:32
afterwards
00:13:33
the nurse was puzzled
00:13:39
[Applause]
00:13:44
and the lab determined that the sample
00:13:46
was too degraded for dna testing
00:13:49
police broke the news to candy
00:13:52
and i'm like oh my god
00:13:54
whatever like
00:13:55
that's [ __ ] this is our last chance
00:13:58
to get blood from him
00:14:00
and you guys screwed up again
00:14:05
even the police were suspicious when dna
00:14:08
from dr schneeberger's lip balm matched
00:14:11
the dna from candy's rape test kit
00:14:14
but since dr schneeberger had passed two
00:14:17
prior blood dna tests officials were
00:14:19
hesitant to charge him
00:14:22
because of his submitting voluntarily
00:14:25
to a dna sample
00:14:27
it gave him
00:14:28
the out that it wasn't me there's a dna
00:14:31
sample showing it is not
00:14:33
the
00:14:34
only person who had an opportunity
00:14:37
limited as it was
00:14:39
was her doctor
00:14:43
but we believed in the dna
00:14:46
testing i mean we we believed in the
00:14:49
science of dna they had to follow the
00:14:51
rules of the canadian justice system i
00:14:55
call it the canadian criminal system
00:14:58
because that's basically what it is
00:15:00
it's the criminals that have all the
00:15:01
rights
00:15:04
on april 25th
00:15:06
1997
00:15:07
five years after the alleged rape police
00:15:10
got a break startling new information
00:15:13
was discovered inside the doctor's own
00:15:16
home
00:15:20
schneeberger's step-daughter his wife's
00:15:22
biological child claimed that the doctor
00:15:25
assaulted her too
00:15:29
for several years
00:15:30
the youngster says her stepfather had
00:15:32
been coming into her room at night
00:15:35
and giving her injections
00:15:37
[Music]
00:15:40
his wife discovered a box full of
00:15:43
condoms needles and drugs including
00:15:46
verse ed in the doctor's home office
00:15:50
i blame myself i still blame myself i
00:15:54
screamed i bawled i
00:15:56
i was pretty disgusted because all of
00:15:59
these years i mean i'm fighting to get
00:16:00
the truth out but also to make sure that
00:16:03
it didn't happen anybody else
00:16:07
dr john schneeberger was arrested and
00:16:09
ordered to undergo yet another dna test
00:16:14
again
00:16:15
the procedure was videotaped
00:16:18
i also advise you that we have a warrant
00:16:20
to obtain
00:16:22
bodily substances
00:16:24
the doctor was withdrawn and silent
00:16:28
police took several samples hair saliva
00:16:31
then
00:16:32
blood
00:16:34
taken from his finger
00:16:36
not his arm
00:16:38
and this time a surprise
00:16:42
dna from all three samples matched dna
00:16:45
found on candy's vaginal
00:16:48
swab oh that was wonderful that was what
00:16:52
i had wanted all along i mean i had even
00:16:55
offered to go chop an arm off i would
00:16:57
have stalked him one in the nose to get
00:16:58
that blood no problem
00:17:00
it was uh quite a happy day because we
00:17:02
knew we had him that candy was right and
00:17:06
everybody else
00:17:07
that didn't believe was wrong
00:17:09
but a big question remained unanswered
00:17:13
how did dr schneeberger fool the
00:17:16
previous blood dna tests
00:17:19
it was a puzzle
00:17:21
how those samples had come to be
00:17:23
different
00:17:24
than the last finger
00:17:26
even if we knew there was something
00:17:27
different there was no way that we could
00:17:28
prove anything
00:17:30
especially since the nurses and police
00:17:33
all witnessed the needle being inserted
00:17:36
into dr schneeberger's arm while the
00:17:38
blood was drawn
00:17:41
on the stand
00:17:42
dr schneeberger would reveal
00:17:45
his secret
00:17:50
in november of 1999
00:17:53
dr john schneeberger went on trial in
00:17:55
saskatchewan for the rape of his patient
00:17:58
candy and his own stepdaughter
00:18:03
on the witness stand
00:18:06
he said he surgically inserted a plastic
00:18:08
tube under the skin into his left arm
00:18:11
filled with blood from one of his
00:18:13
patients
00:18:15
this is why he insisted that the blood
00:18:18
be drawn from his left arm rather than
00:18:21
anywhere else
00:18:22
[Music]
00:18:24
if you look closely at the videotape of
00:18:26
that blood test
00:18:28
you'll see that the doctor is careful to
00:18:31
pull his sleeve only so high so as not
00:18:34
to reveal the incision where he inserted
00:18:37
the tube
00:18:39
and for a brief moment you can see the
00:18:42
tube protruding from his arm
00:18:46
but by the time the third test was done
00:18:49
five years after the rape accusation the
00:18:52
blood in the tube was old and dark
00:18:56
which explains why the technician was
00:18:58
suspicious
00:19:00
dr schneeberger however denied raping
00:19:03
candy he claims candy broke into his
00:19:06
home stole a used condom and used that
00:19:09
biological sample to frame him
00:19:14
he said he used his patients blood for
00:19:16
the dna test because he had no other way
00:19:19
to defend himself
00:19:21
when that
00:19:22
came up at trial that he thought candy
00:19:25
broke into his house and
00:19:27
stole samples or whatever it was
00:19:29
laughable it was absolutely laughable
00:19:31
that he was had to grasp it straws like
00:19:33
that it was just laughable i was a
00:19:35
bulldog on the stand
00:19:37
i kicked his lawyer's ass and he's
00:19:39
supposed to be the best lawyer in
00:19:41
southern saskatchewan best defense
00:19:43
lawyer wow i showed him who his boss
00:19:47
you run across strong-willed individuals
00:19:49
sometimes the strong-willed individuals
00:19:51
are right and sometimes they're wrong
00:19:53
and this particular strong-willed person
00:19:57
was right and she was right all along
00:19:59
and she was determined
00:20:01
to see that
00:20:03
what happened to her didn't happen to
00:20:04
anyone else this would be right up
00:20:07
around the top as far as being the most
00:20:09
bizarre
00:20:10
the most involved and involving all the
00:20:13
forensic evidence here
00:20:16
of any case that i had
00:20:19
dr schneeberger was found guilty of
00:20:22
sexually assaulting candy as well as
00:20:25
drugging her and obstructing justice
00:20:29
he was also convicted of sexually
00:20:32
assaulting his stepdaughter and was
00:20:35
sentenced to six years in prison
00:20:40
i'm so proud of candy
00:20:42
if it was me i don't know if i could
00:20:43
handle the whole
00:20:45
everything that she went through it was
00:20:46
just
00:20:47
when the test came back negative and she
00:20:49
had to fight and it was just a constant
00:20:51
battle
00:20:52
while taping this interview
00:20:55
candy received a telephone call in which
00:20:57
she learned
00:20:58
dr schneeberger had been denied parole
00:21:02
i won again
00:21:05
that's so exciting
00:21:06
ah he lost he lost both both of his
00:21:10
chances to get out for day parole and
00:21:12
vulper all oh my god is that great
00:21:17
anyway
00:21:18
i was so worried that he was gonna get
00:21:20
out and everybody was gonna fall for his
00:21:22
lies and [ __ ] again but they didn't
00:21:25
they didn't they're smarter than the
00:21:26
rest
00:21:28
oh my god do you guys know how exciting
00:21:30
this is for me
00:21:31
it's like celebration
00:21:33
you have to remember that
00:21:35
the dna also led us off the path
00:21:39
so
00:21:40
my when i lecture on this particular
00:21:42
case to younger police officers i say to
00:21:45
them remember the dna does give you
00:21:48
something but it has to be
00:21:50
supported with cooperative evidence
00:21:53
it was very frustrating not being able
00:21:55
to have all the answers but
00:21:57
it finally did come together after 7
00:21:59
years and 24 days
