attended here was a man who'd clearly

killed his wife and wasn't denying it

quite the opposite he was rushing to

admit it he'd called the police it

looked like a slam dunk case

however in every murder inquiry you have
00:30:29
to cover every single aspect off but
00:30:32
just because he's killed his wife it
00:30:33
doesn't mean that he may be found guilty
00:30:35
of murder it could be manslaughter scene
00:30:37
of crime officers scoured the house for
00:30:39
clues about what had happened
00:30:42
so when they did the search they were
00:30:43
looking for weapons
00:30:45
blood
00:30:46
computers telephones all the things that
00:30:48
are going to give you evidence in a
00:30:49
trial now when the officers went there
00:30:51
they did not immediately find the tape
00:30:53
recording machine that was hidden under
00:30:55
the bed i mean who would expect to find

an electronic recording device under a
00:31:00
double bed in a normal family home some
00:31:03
days later

parson's sister at his request had

returned to the house to collect some

and i think he told her they were

and the question for the jury was

is a recognized uh partial defense to

murder it changes murder to manslaughter

used to be called provocation but we now

which led to him losing control and

would have led to someone in the same

position as him losing control that was

andrew parsons claim the prosecution

refused to accept his plea you obviously

have to look very fairly and carefully

at any plea you're offered to see

whether it suits the circumstances but

we rejected it because there was nothing

and we know what she said or did because

were sure this wasn't a loss of control

legal wranglings over whether or not a

jury should be allowed to hear the tape

recording of the attack

it's never easy to get every piece of
00:32:52
evidence that you've got before the jury
00:32:55
you need somebody who's got a good legal
00:32:56
background has done a lot of these sorts
00:32:59
of cases knows how to phrase an argument
00:33:01
and knows how to persuade a judge to
00:33:04
allow you to let the jury hear what you
00:33:06
want the jury to hear andrew's defense
00:33:08
believed it would be hard for him to get
00:33:10
a third trial once the jury had heard
00:33:12

they heard that recording more than once

and the impact upon them

was considerable

i think it

went from shock

to horror

and

certainly i recall a number of

um the jurors
00:34:24
are crying

as the tape unfolded

um i i think from memory it was
00:34:33
seven eight minutes long

and six minutes of that
00:34:37
was the
00:34:39
knife
00:34:40
attack
00:34:42
so the horror was
00:34:44
extraordinary
00:34:46
i personally in 20 years have never
00:34:49
conducted a trial with anything close to
00:34:51
this kind of harrowing
00:34:53
direct primary material
00:34:55
it's almost unheard of to have this
00:34:58
material to be able to listen to what
00:35:00
happened
00:35:01
i'm aware that during the trial several
00:35:03
jurors broke down
00:35:05
several police officers broke down
00:35:08
members of court staff had to leave the
00:35:09
room then afterwards one of the ushers
00:35:11
said to me goodness miss moore one of
00:35:13
the jurors was sick
00:35:15
and two or three of them were obviously
00:35:17
very distressed as with the court staff
00:35:19
in the face of this andrew's defence
00:35:21
team worked hard to paint a different
00:35:23
picture he took the stand to claim that
00:35:25
he had loved his wife but that her
00:35:27
infidelity and her abuse had pushed him
00:35:30
to the brink barrister david hislop had
00:35:33
first met andrew when he was on remand
00:35:35
awaiting trial he was devoted he adored
00:35:39
his children
00:35:40
and adored his wife
00:35:42
good father good

good husband as as best as he was able

at trial mr hislop used andrew's own

testimony as well as the evidence of

text messages and the conversations that

andrew had covertly recorded to show how

he'd felt betrayed by the wife that once

he had loved

she wanted a better life and the better

life didn't include him in the weeks

leading up to janie's death

it was clear that

andrew had lapsed

into

considerable depression

he was

extremely vulnerable

he had started to hear

of her relationship with daniel he'd

started to hear because it was the

recordings under the bed of what she was

a lot of those things weren't very nice

all sorts of reasons his will was

overborn

he had no control

he lost total control on the morning of

the 1st of december andrew said he had

been defending himself from further

attack

this time not verbal but physical
00:36:58
what we do know is that they quarreled
00:37:01
badly
00:37:02
on the 1st december about the fact that
00:37:05
she was going up to london and
00:37:09
it was during that quarrel
00:37:11
that
00:37:12
on andrew's account she attacked him and
00:37:15
hit him in the face with a mobile
00:37:17
telephone
00:37:19
and
00:37:20
that ignited
00:37:23
i think the violence
00:37:25
that followed and caused him the loss of
00:37:28
control
00:37:29
andrew said that it was at this point he
00:37:31
saw red
00:37:33
they grappled on the ground
00:37:36
he hit her
00:37:37
as she bled
00:37:41
he said he was going downstairs to get a
00:37:44
towel and when he returned
00:37:48
there was
00:37:49
janie crouched with a knife ready to
00:37:52
attack him and
00:37:54
he always maintained that she did attack
00:37:56
him and indeed he had a
00:38:00
a wound to
00:38:02
the outside of his left hand

and

we called a

pathologist to give evidence that

this was what's known as a defensive

wound as this happened according to the

defense a switch flipped in andrew's
00:38:18
head he took the knife and stabbed his

wife to death

miranda moore and her team argued in
00:38:25
court that this version of events was a

complete fabrication

andrew parsons claimed that the violence

started after he opened the bedroom door

when she'd shut him out and that she

threw the phone at his face

to have this evidence

and to have somebody fight a case in the

face of this evidence to have a

defendant

try to say they're not guilty of this

in the face of this evidence

it's hard to understand
