May 22, 2019 / 51:51

This episode covers the unsolved cases of Eliot Ness and Michael Frankie, along with the controversial murder case of Patty Stallings.

In the first segment, the episode discusses Eliot Ness, known for his role in taking down Al Capone in Chicago. After his success, Ness faced a serial killer in Cleveland during the 1930s, dubbed the "Butcher of Kingsbury Run." The investigation revealed a series of gruesome murders, with victims primarily being society's outcasts. Despite Ness's efforts, he could not solve the case, which haunted him for years.

The second segment focuses on Patty Stallings, who was convicted of murdering her infant son, Ryan, in 1989. Initially thought to be a poisoning case, it was later revealed that Ryan suffered from a rare genetic disorder. The episode details the legal battles Patty faced and the eventual exoneration after new evidence emerged.

The final segment highlights the murder of Michael Frankie, a prison reformer in Oregon, who was killed in 1989. His family believes he was assassinated to silence his investigation into corruption within the prison system. The episode discusses the discrepancies in the investigation and the potential cover-up involving high-ranking officials.

Throughout the episode, the themes of justice, corruption, and the impact of unsolved crimes are prevalent, leaving viewers with lingering questions about these historical cases.

TL;DR

Eliot Ness's unsolved serial killer case, Patty Stallings's wrongful conviction, and Michael Frankie's murder investigation reveal systemic corruption and injustice.

00:02:58
after crushing Capone in Chicago Eliot
00:03:01
Ness became one of the most respected
00:03:02
lawmen in the country but I portrayed
00:03:05
Ness on television I learned that like
00:03:07
many well-known figures it was a secret

00:03:11
those who knew him agreed that his iron

00:03:15

00:03:18
he is also a man who was not above

00:03:33
September 1934
00:03:35
Eliot Ness came to Cleveland Ohio it was
00:03:38
public safety position comparable to a
00:03:41
modern day police commission treatment
00:03:43

00:03:46
was a known safe haven for gangsters and

00:03:51

00:03:54

00:03:57
city which would soon overshadow neces
00:03:59
primary mandate
00:04:01
to boys playing in Kingsbury run come
00:04:03
across these two bodies both decapitated
00:04:06
in September of 1935 the mutilated
00:04:09
bodies of two men were found in
00:04:11
Kingsbury run a slum district swarming
00:04:14
with hobos prostitutes and street toughs
00:04:16
each person will give at the time the
00:04:18
case was dismissed as a vicious but
00:04:20
routine double homicide
00:04:24
by the summer of 1936 three more parties
00:04:28
had been found the discovery of a sixth
00:04:31
victim that form through Cleveland into
00:04:34
an uproar mr. Ness boy's been found
00:04:37
under the bridge two kids found it
00:04:39
runners been here nothing's been moved
00:04:40
it's been here about five hours when
00:04:43
number six turned up it was like a
00:04:45
bombshell going on the city really
00:04:47
exploded the press and and the public
00:04:51
now had no doubts that there was a
00:04:54
serial killer out there that this
00:04:57
individual was gonna keep killing and
00:04:58
they wanted it stopped
00:05:01
the body count in the king is very run
00:05:04
area would eventually reach 12 as many
00:05:07
as 18 other murderers in Greater
00:05:09
Cleveland were thought to be connected
00:05:10
to the case
00:05:12
the killer primarily stalked society's
00:05:14
outcasts and Vegas men as well as men
00:05:17
and fell prey only two of the victims
00:05:20
rather positively identified Edward and
00:05:23
racy a small-time hood and Florence
00:05:26
Palillo a 41 year old prostitute
00:05:29
all the victims had been decapitated in
00:05:32
some cases while they were still alive
00:05:35
five were found floating in water the
00:05:37
blood drained completely out of their
00:05:39
bodies the tabloids dubbed the killer
00:05:42
the butcher of Kings Barry run and the
00:05:45
torso Slayer
00:05:47
[Music]
00:05:51
found a body here late this morning the
00:05:55
arms and legs haven't cut off scene of
00:05:56
the crime the minister looking into
00:06:00
capital yes sir took the same killer how
00:06:03
we keeping the crowd back
00:06:07
Ness got into the case quite extensively
00:06:10
in fact he devoted almost full time to
00:06:13
it but at the same time there's also
00:06:15
sort of an uneasiness with Ness about
00:06:18
this he didn't know quite how to proceed
00:06:20
with this case it wasn't a matter of
00:06:23
like finding out where the breweries got
00:06:25
was and where the mobsters were hiding
00:06:27
and go and smash your way into the end
00:06:31
of the place area this was a different
00:06:33
type of criminal that Eliot Ness was
00:06:36
facing the bodies would kept for about
00:06:39
oh I'd say six months we have no idea
00:06:42
who they are but it certainly was a
00:06:45
skillful dissection the murderer was
00:06:47
probably Eliot had made a profile that
00:06:50
he figured the killer might be thank you
00:06:53
and he determined that it would had to
00:06:54
be somebody from the way these bodies
00:06:56
were cut up somebody with a certain
00:06:58
amount of medical knowledge
00:07:00
plus the fact had to be a very strong
00:07:03
man to carry these bodies all over in
00:07:05
Dublin where he did and
00:07:08
so we had this profile it has to be a
00:07:11
big man strong an expert with a scalpel
00:07:16
[Music]
00:07:18
nests had reached an impasse he was
00:07:22
determined to search every dwelling in
00:07:23
Kingsbury run but had no legal grounds
00:07:26
to spare out search warrants
00:07:28
the solution was vintage Eliot Ness
00:07:34
[Music]
00:07:39
he cleverly squirted the need for
00:07:41
warrants by pairing detectives with fire
00:07:43
officials and ordering widespread safety
00:07:46
inspections
00:07:47
[Music]
00:07:49
there was a thought yes and other police
00:07:54
officers that they were gonna find this
00:07:55
laboratory that was going to have blood
00:07:57
splattered walls and have arms and waves
00:08:00
lying over in a corner and maybe a catch
00:08:03
of heads in another corner that's what
00:08:06
they were looking for and NASA's men
00:08:08
spent almost a full week searching
00:08:11
almost every place almost every
00:08:14
apartment every dwelling they could find
00:08:16
in in that area and they weren't able to
00:08:19
turn up a thing
00:08:20
[Music]
00:08:22
less next pinpointed every doctor and
00:08:25
hospital worker in Cleveland there has
00:08:28
its call even the County caller was not
00:08:30
above suspicion entity
00:08:32
hundreds of people were put under
00:08:34
surveillance
00:08:35
questioned hospital and detained I fell
00:08:39
asleep got a few hours oh yes are you
00:08:42
doing in Cleveland
00:08:43
and town on business
00:08:47
what
00:08:48
I'm a Salesman I sell surgical supplies
00:08:52
but the investigation still led nowhere
00:08:55
I come up to three times a month the
00:08:57
killer remained it longer any Kingsbury
00:08:59
Ron wins and the case began to consume
00:09:01
Eliot Ness he used to go out and hit a
00:09:03
couple of bars have a drink
00:09:05
[Music]
00:09:06
in august of nineteen thirty eight
00:09:09
victims number eleven and twelve were
00:09:11
found the last scattered in a rubbish
00:09:14
heap just 200 yards from Elliot meses
00:09:17
office
00:09:19
it was evident after the last two bodies
00:09:22
were found that the killer was now
00:09:24
becoming more daring by where he left
00:09:26
the bodies right really under a head
00:09:29
NASA's window and
00:09:31
it was it was almost like it was a
00:09:34
cat-and-mouse game and so sort of a
00:09:36
catch me if you can type thing they were
00:09:39
bragging Cleveland was now one of the
00:09:41
safest cities in in the United States
00:09:43
except for the killer who was built
00:09:47
chopping off heads and cutting up bodies
00:09:49
and all this kind of stuff and he knew
00:09:52
he had to do something desperately
00:09:54
because the people were clamoring and
00:09:56
all the people in town were insane about
00:09:59
this insanity that was going on and they
00:10:03
were frightened they were scared to
00:10:04
death
00:10:08
the storm of public criticism gold nest
00:10:11
to take drastic measures
00:10:13
less than 48 hours after the discovery
00:10:16
of victims number 11 and 12 the police
00:10:19
descended upon Kingsbury runs hobo
00:10:21
jungles they rounded up more than 60
00:10:24
transients hoping that the killer might
00:10:26
be among
00:10:30
this was his old untouchable style great
00:10:34
where you know where the bad guy isn't
00:10:36
going and get him he really thought that
00:10:38
this might work and at the very least he
00:10:41
could remove some of the people that the
00:10:42
killer was preying on but it completely
00:10:44
backfired for him there was a great
00:10:47
wave of public opinion that this was the
00:10:50
act of a desperate man and that his
00:10:53
tactics had been brutal and they didn't
00:10:56
really solve anything
00:10:57
[Music]
00:10:59
in a final radical attempt to stop the
00:11:02
slaughter Ness ordered the shanty town
00:11:04
burned to the ground
00:11:07
of those arrested that night none turned
00:11:10
out to be the killer
00:11:15
[Music]
00:11:17
[Applause]
00:11:22
after the shanty town was destroyed a
00:11:24
murders in Cleveland mysteriously
00:11:26
stopped but the case was not over for
00:11:29
Eliot Ness he remained bitter and
00:11:31
dissatisfied according to some experts
00:11:34
he was all the more frustrated by the
00:11:35
fact he believed he knew the killer's
00:11:37
identity but could never come up with
00:11:39
enough evidence to make an arrest
00:11:41
Nessa's suspect belonged to a prominent
00:11:44
Cleveland family in 1938 the man had
00:11:47
himself committed to a state mental
00:11:49
institution
00:11:54
ness believed that he had caught the
00:11:58
killer
00:12:00
primarily because
00:12:01
after this man committed himself to a
00:12:05
mental hospital
00:12:06
the killing stopped and
00:12:10
he said I am certain this is this is the
00:12:15
man the profiles fit fits the profile
00:12:18
and I'm sure that this is a bird who was
00:12:21
doing all these killers
00:12:24
it's pretty clear that if nested accused
00:12:27
this man whose family was socially
00:12:30
prominent
00:12:31
he
00:12:33
could have been libelous and been sued
00:12:36
and he was a very cautious guy as far as
00:12:39
covering the letter of the law
00:12:43
incredibly more than 10 years later
00:12:46
Eliot Ness received a number of
00:12:48
postcards from a patient in a mental
00:12:49
institution taunting you with references
00:12:53
to the brutal slayings
00:12:55
[Music]
00:12:56
the man who was sitting in these post
00:12:59
guard might have just been another kook
00:13:02
but he was convinced
00:13:05
that he had found a guy
00:13:08
[Music]
00:13:11
Eliot Ness never fully recovered from
00:13:14
his disappointment and being unable to
00:13:15
close the case he resigned as Public
00:13:18
Safety Director in 1942 five years later
00:13:22
he ran for mayor of Cleveland when
00:13:24
questioned about the torsos names during
00:13:26
the campaign Ness enigmatic Leigh
00:13:29
replying that case has been solved
00:13:32
Eliot Ness lost the election by a
00:13:35
landslide and left Cleveland he never
00:13:38
returned to law enforcement
00:13:39
[Music]
00:13:45
next a young mother convicted of murder
00:13:48
wins her final appeal
00:13:49
[Music]
00:14:04
July 9th 1989 st. Louis Missouri a young
00:14:08
mother rushed her critically ill son to
00:14:10
Cardinal Glennon Hospital
00:14:13
the baby was three month old Ryan
00:14:15
Stallings nearby Jefferson County since
00:14:18
birth he had suffered from chronic
00:14:20
gastric distress
00:14:24
[Music]
00:14:26
on the day Ryan was brought to the
00:14:28
emergency room his breathing had become
00:14:30
extremely labored and he was vomiting
00:14:32
uncontrollably
00:14:33
Ryan was immediately placed in the
00:14:35
pediatric intensive care unit
00:14:38
he was hooked up to a respirator and all
00:14:42
kinds of tubes going in and out of him
00:14:45
and it was awful it
00:14:48
was just a shock to see a little baby
00:14:52
incapacitated the way he was it was to
00:14:56
the point where they said whether they
00:14:57
don't know how long he's gonna be here
00:14:59
we don't know what's wrong when he met
00:15:00
so you might as well just go to the
00:15:02
waiting room and stay out there until we
00:15:04
can tell you what's wrong
00:15:07
yes sir I'm dr. Bailey chief of
00:15:10
pediatrics happy to see you this is mrs.
00:15:12
Jorgenson her family's David and Patti
00:15:14
starlings rented a room at the hospital
00:15:16
to be near their son after three
00:15:19
agonizing days the stallings learned
00:15:21
that Ryan would recover Ryan's fine
00:15:23
there are no problems in the diagnosis
00:15:26
however was stunning Ryan had apparently
00:15:29
been poisoned when the lab tests came
00:15:31
back we found a couple of substances
00:15:33
those substances are ethyl glycol and
00:15:36
acetone ethyl glycol is the substance
00:15:40
that you'll find in radiator antifreeze
00:15:42
and acetone is in fingernail polish
00:15:46
remover for exams yes do you have any
00:15:48
analysis yeah Patti uses it on her
00:15:51
friend Hills to remove her old fairy
00:15:52
nail polish because well that's got
00:15:55
acetone in it so okay so do you have any
00:15:58
phrase that said yes I have any fries I
00:15:59
just rebuilt a radiator on my vehicle
00:16:02
and I had a partial gallon left in the
00:16:04
basement he says well that's what we're
00:16:07
saying he may have gotten do you happen
00:16:09
to know how he could have gotten it they
00:16:11
were very polite yet suspicious
00:16:14
they would not allow us to see Ryan
00:16:16
alone there would have to be at least
00:16:19
two nurses or a doctor present and we
00:16:21
were never allowed to be on his bedside
00:16:23
alone you know that bothered me but I
00:16:25
still didn't understand because I wasn't
00:16:27
looking at it the way they were I guess
00:16:30
just have to ask you a few questions if
00:16:32
you could come in for a moment
00:16:34
David did you ever see they'll come
00:16:36
catch any man that same day the police
00:16:38
were brought in to investigate
00:16:40
we were split up and talked to by
00:16:43
detectives and then that's when I knew
00:16:46
because they immediately started asking
00:16:50
me well is there a problem at home are
00:16:52
you and David fighting they were saying
00:16:55
that they knew that that baby had been
00:16:57
poisoned by either me or my husband and
00:17:00
infuriated me and I was just I was
00:17:04
devastated I was blown away I just could
00:17:08
not believe that they could even think I
00:17:10
mean Ryan was my world you know I'm
00:17:13
right he was so beautiful
00:17:15
it was perfect
00:17:18
Ryan's condition improved after 12 days
00:17:21
he was released from the hospital but
00:17:23
not to the custody of his parents
00:17:25
a social worker come up to us and told
00:17:28
us that they were taking custody of ryan
00:17:31
from us and at that point I became very
00:17:34
angry why are you doing this to us is
00:17:37
what I told her and
00:17:38
she said well this is policy when
00:17:42
there's a suspected poisoning we take
00:17:45
children from the parents and put him in
00:17:47
foster care
00:17:51
Patti and Davis contact with Ryan was
00:17:54
severely restricted they were allowed
00:17:56
only a one-hour visit each week on
00:17:58
Thursdays
00:18:00
Ryan knew when we've met him the first
00:18:02
time he was so happy to see both of us
00:18:05
again he just smiled the biggest smile
00:18:09
you could ever possibly see on a baby's
00:18:11
face and it was we were just totally in
00:18:16
love with our child that was so glad
00:18:18
that we finally was able to see him
00:18:20
again I just could not wait till
00:18:23
Thursday you know I would just my whole
00:18:25
week I would tell everybody over / know
00:18:27
how last Thursday went and that was my
00:18:30
life Thursday Thursday morning
00:18:34
for five weeks the parental visits
00:18:36
continued during the sixth visit Patti
00:18:39
was left alone with Ryan for a short
00:18:41
time three days later Ryan would suffer
00:18:44
another severe attack of vomiting once
00:18:47
again he would be rushed to the hospital
00:18:49
once again the diagnosis would be
00:18:51
poisoning I
00:18:53
[Music]
00:19:00
have a warrant for your arrest
00:19:04
the car and they said stop right there
00:19:07
and you know I turned around I was like
00:19:09
well come on into the house you know and
00:19:12
they said no you're not allowed to go
00:19:13
into the house they immediately slap
00:19:15
handcuffs on me and said you're under
00:19:17
arrest for assault
00:19:25
[Music]
00:19:40
hattie Stallings was booked on charges
00:19:42
of poisoning her infant son I
00:19:46
knew it wasn't true I don't care what
00:19:48
they thought I just thought long you
00:19:51
know I'll be home in a couple hours this
00:19:52
to be over with you know I'll get to go
00:19:54
be with Ryan
00:19:55
and then the day turned into a night and
00:20:00
then it got really serious I got really
00:20:03
scared
00:20:07
while Patti languished in jail her son
00:20:10
was dying Brian was placed on
00:20:12
life-support systems David Stallings
00:20:14
found himself trapped in a private hell
00:20:17
the doctors come up to me and tell me
00:20:20
that uh
00:20:21
they have a feeling clients not gonna
00:20:23
make it and that maybe I should get in
00:20:26
contact with the minister and have him
00:20:29
baptized in that I
00:20:31
had tried to get Patti up there and all
00:20:34
I got from the judge
00:20:36
was no absolutely not I'm not going to
00:20:40
let a baby killer up there
00:20:43
and I I said this lady did not kill this
00:20:46
baby
00:20:48
and when they finally come back to me
00:20:50
and told me that we need to know if we
00:20:53
can turn him off I
00:20:55
told him I go ahead and shut the
00:20:59
machines at home
00:21:03
but I wanted to be in there with him
00:21:08
that's what for three hours i
00:21:10
sat there with him in my arms
00:21:15
knowing that Patti couldn't be there
00:21:18
watching this meet her on this machine
00:21:21
go down each time his heart would beat
00:21:28
it was hard
00:21:31
it's something I've never asked anybody
00:21:34
ever to do
00:21:39
approximately about 6:30
00:21:43
doctor came in
00:21:47
and she shut the Machine down so I could
00:21:50
not see any more of
00:21:52
his heart rate
00:21:56
she took him from me and said it's over
00:22:01
with he's gone
00:22:05
they called me back about
00:22:08
nine o'clock that night
00:22:10
and I I went up to the phone and it was
00:22:13
David's voice and he told me he died and
00:22:17
I
00:22:19
started begging that he could come up
00:22:22
and see me and there's a deputy on duty
00:22:26
said he could so
00:22:32
[Music]
00:22:35
Brian Stallings died on September 7th
00:22:38
1989 he was not yet six months old his
00:22:42
mother Patti was now charged with
00:22:43
first-degree murder and held without
00:22:45
bail she was not allowed to attend
00:22:48
Ryan's funeral a
00:22:49
few weeks later Patti Stoney's
00:22:52
discovered she was pregnant again
00:22:55
for six months she remained incarcerated
00:22:57
subject to a battery of mental fitness
00:23:00
tests on February 27th nineteen ninety
00:23:03
david Stallings jr. was born at a
00:23:05
Madison County Hospital
00:23:10
even though Davis stalling senior was
00:23:12
not a suspect and they've been charged
00:23:14
with no crime at all he is not allowed
00:23:16
to take David jr. home with him the baby
00:23:19
became a ward of the state and was
00:23:20
placed in foster care
00:23:22
ironically this devastating blow would
00:23:24
turn out to be a stroke of good fortune
00:23:26
without it Patti and David Stallings
00:23:29
might have been accused of poisoning
00:23:30
their second son
00:23:34
when David Stallings jr. was 2 weeks old
00:23:37
he began to exhibit symptoms identical
00:23:39
to the ones that had played his brother
00:23:41
Ryan the st. Louis Children's Hospital
00:23:44
diagnosed Davis illness as a rare
00:23:46
genetic disorder
00:23:47
methylmalonic acidemia or MMA in which
00:23:50
the body produces chemical byproducts
00:23:53
that may be remarkably similar to the
00:23:55
ethylene glycol found in antifreeze
00:23:57
unsolved mysteries contacted an
00:23:59
independent medical expert about MMA
00:24:03
it would be very simple to confuse the
00:24:06
diagnosis of MMA with multiple
00:24:08
poisonings because the symptoms are very
00:24:10
similar but more importantly than that
00:24:14
MMA and other similar disorders are very
00:24:17
rare and the majority of doctors either
00:24:21
will never have seen a case or if they
00:24:24
have seen a case didn't know that they
00:24:25
saw it and actually confused it
00:24:29
while prosecutors reevaluated the
00:24:32
medical evidence Patti Stallings was
00:24:34
released from jail pending the outcome
00:24:36
of the investigation
00:24:37
Patti was denied visitation rights with
00:24:39
David jr. I
00:24:42
thought it was over you know as far as
00:24:45
the nightmare of being accused of
00:24:48
hurting Ryan I was positive that you
00:24:51
know even my lawyer said it was over you
00:24:54
know there was no way that they could
00:24:57
not see the truth right in front of
00:24:59
their eyes
00:25:01
Jefferson County officials continued to
00:25:03
pursue the case the prosecution's
00:25:06
position was that Ryan Stallings had not
00:25:08
died from MMA in the judge's chambers
00:25:11
they cited for expert witnesses
00:25:14
Patti's lawyer presented no expert
00:25:17
opinions
00:25:18
the judge agreed with a prosecution
00:25:22
neither David Stallings jr. no the
00:25:24
symptoms he shared with Ryan were
00:25:26
allowed to be presented as evidence at
00:25:28
Patty's trial
00:25:30
we were concerned that if it came out
00:25:33
that David jr. or Ryan for that matter
00:25:36
had this myth malonic acid doses
00:25:39
unless it could be shown that he
00:25:42
actually died of that or it was some
00:25:44
kind of a contributing factor to his
00:25:46
death we believe that that would not be
00:25:48
relevant and in fact might cause the
00:25:50
jury to go off on a wild goose chase and
00:25:53
make a decision based on something's
00:25:55
really not relevant first cases in the
00:25:57
family are often missed and it's only
00:26:00
when it reoccurs again that the medical
00:26:04
practitioners are tipped off to the fact
00:26:06
that this may well be a genetic disorder
00:26:08
and maybe the first child had that as
00:26:11
well without the medical testimony the
00:26:14
case against patty Stallings seemed
00:26:16
virtually airtight the prosecution
00:26:18
focused on the events of Thursday August
00:26:20
31st 1989 Patti and David's sixth
00:26:24
parental visit with Ryan
00:26:27
[Music]
00:26:30
buddy
00:26:32
on the sixth visit my parents were
00:26:36
invited for the first time
00:26:39
and then about 20 minutes into the visit
00:26:42
my mom and dad decided they were going
00:26:44
to go ahead and leave and I had the rest
00:26:47
of the time with it I'll be right back
00:26:50
so I accorded my mom and dad out of the
00:26:53
room walked down the hall I
00:26:56
was out of the room no more than 45
00:26:58
seconds at the most
00:27:01
on one visit Patricia was left alone
00:27:04
with the child and anywhere from about 3
00:27:07
minutes to about 8 minutes and during
00:27:10
that time did actually feed the child a
00:27:12
bottle
00:27:14
the child again got the same symptoms
00:27:17
had before came back into the off into
00:27:19
the hospital was diagnosed with ethylene
00:27:22
glycol poisoning at that time a number
00:27:26
of bottles were also
00:27:28
examined for possible traces and
00:27:31
while they were negative effects and in
00:27:34
all the bottles but one one bottle which
00:27:37
was identified as the bottle she had fed
00:27:39
the baby with actually contained traces
00:27:43
of ethylene glycol that bottle had
00:27:46
actually been prepared by the foster
00:27:48
mother and retrieved from the baby bag
00:27:50
during a visit but State believes and
00:27:53
certainly circumstantial evidence
00:27:56
suggests that she slipped ethylene
00:27:58
glycol or antifreeze into the bottle
00:28:00
during that feeding
00:28:01
what they were trying to say was she
00:28:04
started feeding him before anybody got
00:28:06
in there and that's wrong that's
00:28:09
incorrect
00:28:10
what happened was I walked back to the
00:28:13
cubbyhole where petit was with Ryan he
00:28:17
just started getting a little cranky and
00:28:18
so I reached into the bag and took the
00:28:21
baby bottle out and started feeding him
00:28:23
I saw the bottle I did not smell I did
00:28:28
not see any discoloration in the bottle
00:28:30
whatsoever there was nothing done to
00:28:33
that bottle absolutely nothing
00:28:36
according to Paddy's lawyers Ryan's
00:28:39
symptoms did not appear until three and
00:28:41
a half days after the visit I
00:28:44
would be amazed if something as volatile
00:28:48
and as easily diffuse' Balazs ethylene
00:28:50
glycol would require eighty hours in
00:28:53
order to cause symptoms in the young
00:28:55
child I believe it would have to happen
00:28:57
a lot faster than that and and therefore
00:29:00
it seems much less probable that this
00:29:03
was a poisoning Ryan was taken from the
00:29:06
visit by the DFS worker to the foster
00:29:10
parents home but later that day or early
00:29:14
actually early the next morning was
00:29:15
taken to what we call respite home a
00:29:18
temporary foster parents who kept him
00:29:21
just for the weekend
00:29:23
the second set of foster parents not
00:29:25
knowing what the child was like may well
00:29:29
have overlooked symptoms at the first
00:29:30
set would a sane defendant will rise and
00:29:33
face the court
00:29:37
on count one assault with a deadly
00:29:39
weapon the Court finds you guilty as
00:29:42
charged
00:29:44
on count two murder in the first degree
00:29:47
the Court finds you guilty as charged
00:29:52
on March 4th 1991 Patti Stallings was
00:29:56
sentenced to life in prison without the
00:29:57
possibility of parole her son David jr.
00:30:01
is now one year old Patti has seen him
00:30:03
only three times twice just after his
00:30:06
birth the third time when he was a week
00:30:08
old each visit was limited to one hour
00:30:11
David stalling senior is allowed to see
00:30:14
his son once a week I
00:30:16
cannot see how they can live with
00:30:18
themselves
00:30:19
knowing they sent an innocent woman to
00:30:21
jail the rest of her life
00:30:23
for something that she didn't do
00:30:26
if Bryan would have been correctly
00:30:30
diagnosed with mmm a
00:30:33
none of this would have happened
00:30:35
none of the series of events in the last
00:30:38
two years what have happened
00:30:40
it all dependent on whether he was
00:30:43
correctly diagnosed which he was not not
00:30:47
truly to believe in the system and I
00:30:49
think that when 12 people heard the
00:30:51
evidence and they returned the verdict
00:30:54
that they did that it's the right
00:30:55
verdict it's not the right verdict
00:30:58
they're already started the ball rolling
00:31:00
and the appellate
00:31:02
procedures and and if there is a problem
00:31:05
or if new evidence does come up which
00:31:07
could link Ryan's death to MMA well
00:31:10
certainly it will and should be retried
00:31:12
but in the meantime I'm comfortable with
00:31:15
it
00:31:16
I've lost
00:31:19
one child to MMA my second child is
00:31:24
striking with him MA it may not live
00:31:28
he's year old though if there was still
00:31:32
not sure how to treat him I
00:31:34
lost my freedom
00:31:39
I've lost everything
00:31:42
on the night this story aired cause some
00:31:45
physicians familiar with MMA poured into
00:31:47
our telecenter patty starlings new
00:31:50
attorneys petitioned the court to grant
00:31:52
her another trial based on the fact that
00:31:54
she had previously received ineffectual
00:31:56
counsel on July 30th 1991 patty
00:32:00
Stallings was granted a new trial and
00:32:02
released from prison
00:32:06
after the enzyme mr. is air people are
00:32:08
writing and calling and just want to
00:32:10
know how can we help and I can't think
00:32:13
those people enough because I mean
00:32:15
through all of that
00:32:18
wheels started turning and everything
00:32:20
just started pushing forward really fast
00:32:23
along with Ron's remaining serum
00:32:26
September 20th 1991 a press conference
00:32:29
was held in st. Louis dr. Pierre Ronaldo
00:32:32
of Yale University revealed an
00:32:34
independent serum tests showed Rian
00:32:36
Stallings had definitely died of MMA
00:32:40
consequently the prosecuting attorney
00:32:42
dropped all charges against Patti
00:32:44
Stallings
00:32:46
unfortunately we can't undo the
00:32:48
suffering that the stallings have
00:32:50
endured during this entire ordeal
00:32:52
and I apologize to them both personally
00:32:56
and for the state of Missouri
00:32:57
during the press conference Patti and
00:33:00
David heard for the first time the
00:33:02
custody of their son DJ had been
00:33:04
returned to thanagar
00:33:06
[Music]
00:33:10
in October of 1991 just over two years
00:33:14
after his brother's death DJ came home
00:33:17
for the first time
00:33:18
[Music]
00:33:19
just want to make up for the year and a
00:33:22
half that we didn't have him and it's
00:33:25
hard to make up that much time but I'm
00:33:27
doing the best I can
00:33:29
[Music]
00:33:31
his condition is very scary but we've
00:33:35
checked with so many hard things that
00:33:37
you know we've just kind of said we'll
00:33:40
beat this too and with that attitude I
00:33:42
know that DJ will do alright and that
00:33:45
will do okay he is a miracle child and
00:33:48
we're lucky to have DJ and we have our
00:33:51
whole life back it's like we're starting
00:33:53
over
00:33:54
it's undescribable
00:33:56
wonderful
00:33:58
[Music]
00:34:01
when we return a prison reformer is
00:34:05
murdered outside his office in Salem
00:34:07
Oregon his family believes he may have
00:34:09
been assassinated to keep him quiet
00:34:22
in February 1980 the New Mexico State
00:34:25
Penitentiary in Santa Fe was rocked by a
00:34:28
violent uprising
00:34:30
by the time order was restored 33
00:34:33
prisoners had died at the hands of
00:34:34
fellow inmates New Mexico
00:34:36
scandal-plagued penal system became
00:34:38
front-page news across America State
00:34:41
Deputy Attorney General Michael Frankie
00:34:44
was brought in to investigate the riots
00:34:46
and revamp the prison system
00:34:51
Frankie a former college football star
00:34:54
an ex Navy Commander achieved dramatic
00:34:56
results in New Mexico he was a man of
00:34:59
the hour and his reforms gained national
00:35:01
recognition
00:35:02
Mike was very much his own man not a
00:35:06
follower in any sense of the word he
00:35:08
loved making decisions he liked tackling
00:35:10
difficult problems he had a very quick
00:35:13
mind
00:35:14
Michael Frankie's growing reputation
00:35:16
soon brought him a new challenge in 1987
00:35:19
the governor of Oregon has Frankie to
00:35:22
take over his state's troubled prison
00:35:24
system Michael Frankie was the best
00:35:27
selection that the governor made and in
00:35:30
all of his new appointments and I think
00:35:32
we all felt that there was going to be
00:35:34
some very very good things happening in
00:35:38
Corrections we were all excited about
00:35:40
him and I really can't tell you just how
00:35:44
much of a shock it was when when he was
00:35:47
murdered
00:35:50
tragically on January 17th 1989 Michael
00:35:54
Frankie's distinguished career came to
00:35:56
an abrupt violent end he was found
00:35:58
stabbed at now just outside his office
00:36:01
building in Salem or
00:36:05
before he died Michael Frankie told his
00:36:08
family that he was in the midst of a
00:36:09
top-secret investigation to detail
00:36:11
corruption in the Oregon prison system
00:36:13
particularly drug trafficking he
00:36:16
apparently planned to name names and
00:36:18
implicate several highly placed
00:36:19
government officials the district
00:36:22
attorney believes Michael Frankie fell
00:36:23
victim to a robbery gone wrong but
00:36:26
Frankie's family is convinced he was
00:36:28
assassinated they think someone wanted
00:36:30
Michael Frankie silenced and his
00:36:32
findings on the Oregon prison system
00:36:34
suppressed forever
00:36:38
the three main criminal activities that
00:36:41
I observed
00:36:42
working in Corrections was the
00:36:44
introduction of drugs into the
00:36:46
institution falsifying records and
00:36:50
thefts of state property basically
00:36:54
anything that was not nailed down was
00:36:57
subject to be stolen there was a
00:36:59
constant flow of drugs being brought
00:37:02
into the institutions one of the most
00:37:04
common ways was staff bringing them in
00:37:06
in their own lunch buckets because there
00:37:08
was no searches being conducted on staff
00:37:10
as they entered or left the facility I
00:37:13
was told by my superiors to keep my
00:37:17
mouth shut and mind my own business or
00:37:19
I'd be looking for a job and Mike came
00:37:22
in he's he's got a good old boy system
00:37:24
to contend with a lot of these guys have
00:37:26
been him here for 20 or 30 years
00:37:28
the system has run the way they wanted
00:37:31
to run for that so here comes some guy
00:37:33
from out of state who has all these
00:37:35
high-minded ideas about what he's going
00:37:38
to do and it just rubbed a lot of them
00:37:40
the wrong way
00:37:42
Michael Frankie gathered was some
00:37:44
believe was concrete evidence confirming
00:37:46
that the state prison system contained
00:37:48
corrupt elements reaching all the way to
00:37:49
the top by the end of 1988 he was
00:37:53
conducting an intense personal
00:37:54
investigation Michael Frankie knew he
00:37:57
was juggling political dynamite that
00:37:59
could blow up in his face at any moment
00:38:01
he had uncovered a lot of organized
00:38:05
crime and I said you mean like the Mafia
00:38:07
and he said no an organized criminal
00:38:09
element in the system and that he was
00:38:12
going to do a thorough housecleaning
00:38:13
immediately after the first of the year
00:38:16
and that his quote was a lot of heads
00:38:18
were gonna roll and
00:38:19
he said it may cost him his job
00:38:27
yellow
00:38:29
who's this
00:38:32
okay how you doing on January 13th I
00:38:36
called Michael and he said that he was
00:38:38
going to go before the legislature and
00:38:40
clean house the following Wednesday
00:38:44
wow you did that New Mexico you cleaned
00:38:47
the house before
00:38:48
yeah I know Katie but this is different
00:38:52
seems I really ruffled some feathers it
00:38:54
was very very concerned
00:38:56
and I think he had had covered something
00:38:59
far bigger than he expected
00:39:03
four days later Michael Frankie was
00:39:06
found murdered on a side porch of his
00:39:07
office building police quickly began to
00:39:11
piece together the last hours of his
00:39:12
life
00:39:14
at 6:50 p.m. after the regular Tuesday
00:39:17
staff meeting Frankie spoke briefly with
00:39:20
one of his subordinates
00:39:21
30 minutes later two other corrections
00:39:24
employees notice that the light and
00:39:26
Michel Frankie's car was on and the
00:39:28
driver's door was standing wide open it
00:39:32
was 7:20 p.m.
00:39:39
this is this is kind of weird he never
00:39:41
leaves his car like this with the door
00:39:43
betray the two women could not find
00:39:46
Frankie or could they reach him on his
00:39:48
pager which he carried with him at all
00:39:49
times
00:39:50
they call their superiors two officials
00:39:54
arrive at 8:30 p.m. and conducted in
00:39:56
their words a meticulous search of the
00:39:58
building Frankie was nowhere to be found
00:40:03
the two men did not call the police and
00:40:06
left around 9:30 p.m.
00:40:09
[Music]
00:40:12
at 12:45 a.m. a security guard found
00:40:16
Michel Frankie's body on the side porch
00:40:19
of the building that had been so
00:40:20
thoroughly searched just four hours
00:40:21
earlier a pane of glass in the side door
00:40:25
was shattered no one knows whether or
00:40:27
not Frankie was carrying documents
00:40:29
concerning his prison investigation
00:40:30
however his briefcase appeared to be
00:40:33
missing a body here at least Frankie
00:40:35
[Applause]
00:40:37
police theorized that Frankie had been
00:40:39
murdered by someone who was trying to
00:40:41
rob him they interrogated a number of
00:40:43
known drug dealers and Street criminals
00:40:45
I need to know where you were that night
00:40:47
you told me earlier you were there at
00:40:49
9:30 and then you come back and each one
00:40:51
of them claimed that he witnessed the
00:40:53
murder and fingered an admitted drug
00:40:55
dealer named Frank gable
00:40:57
according to this witness gable was in
00:41:00
the act of burglarizing Michel Frankie's
00:41:02
car when Frankie came out of the office
00:41:04
building around 7 p.m.
00:41:08
what's going on let's go around just
00:41:11
give me your briefcase nothing are you
00:41:12
gonna get I want to know what you're
00:41:13
doing my car but do nothing your car
00:41:14
just give me the briefcase okay punk I'm
00:41:16
taking you aside Oh gave me allegedly
00:41:18
stabbed Frankie mortally wounding him
00:41:21
some believe gable also stole Frankie's
00:41:23
briefcase before fleeing
00:41:28
Michel Frankie apparently staggered up
00:41:30
the stairs of a side entrance to the
00:41:32
building he broke the glass door in a
00:41:34
desperate attempt to get back to his
00:41:36
office
00:41:37
[Music]
00:41:42
bright gable was charged with a murder
00:41:45
of Michael Frankie but for many people
00:41:47
the evidence simply did not add up
00:41:50
bruises operations and other wounds on
00:41:53
Frankie's body seemed to indicate a
00:41:55
struggle with more than one man I
00:41:57
think Frank Abel is a scapegoat because
00:42:01
I think it goes much higher up in the
00:42:04
Oregon government and
00:42:07
he's just being used to take the fall
00:42:11
from the onset of the Frankie
00:42:13
investigation it appeared that the
00:42:15
police put the blinders on as far as
00:42:19
what they were most inclined to believe
00:42:22
it seems as though there has been
00:42:24
some reluctance to really really just
00:42:29
scorched the earth to find out what
00:42:30
happened
00:42:32
Michael Frankie's family and supporters
00:42:34
found what they felt were other
00:42:36
disturbing discrepancies in the official
00:42:38
explanation of Michael's death
00:42:41
Michael had a state-of-the-art car alarm
00:42:43
system if the killer had broken into the
00:42:46
car why was the alarm not set off and of
00:42:49
why were there no signs of forced entry
00:42:53
and what's going on
00:42:56
if the killer had stabbed Michael at the
00:42:58
car puncturing his heart and lungs why
00:43:01
was there no trace of blood within 100
00:43:04
feet of the car
00:43:08
and finally if Michael Frankie was
00:43:10
killed at 7:00 p.m. as police estimating
00:43:13
why was neither his body or the book and
00:43:16
glass noticed when building was
00:43:17
meticulously searched between 8:30 and
00:43:20
9:30 p.m. a
00:43:25
number of people in orange believe that
00:43:27
Michael Frankie was the victim of a
00:43:29
premeditated murder carried out by
00:43:31
several and possibly instigated by
00:43:34
high-ranking officials who feared they
00:43:36
would be maimed and Frankie's
00:43:37
investigation and eyewitness at the
00:43:39
scene appeared to corroborate this
00:43:41
theory
00:43:42
at 10:15 10:20 on January 17th a young
00:43:46
man riding in the car looked over at
00:43:48
there where the scene of the crime was
00:43:49
it saw five to six men running toward a
00:43:52
Volkswagen van if Michael Frankie had
00:43:55
been abducted and then brought back to
00:43:57
the building where he was killed this
00:43:59
would fit in with the abduction Theory
00:44:02
the abduction theory holds it on the
00:44:05
night of his death Michael Frankie
00:44:07
unlocked his own car deactivating the
00:44:09
alarm
00:44:12
simultaneously a group of men approached
00:44:14
him
00:44:15
Oh
00:44:19
[Music]
00:44:22
Frankie did not keep regular office
00:44:24
hours except for Tuesday staff meetings
00:44:27
it would seem that the perpetrators were
00:44:29
familiar with his schedule
00:44:31
the abduction theory would have that
00:44:35
Michel Frankie was later brought back
00:44:37
perhaps going to his office to find
00:44:39
whatever paperwork or computer files or
00:44:42
his sort of things in his office
00:44:45
[Applause]
00:44:48
I don't there he gets out of the car
00:44:52
perhaps sees his only chance for getting
00:44:54
away tries to make a break for it
00:44:56
perhaps receives one or more of his
00:44:59
wounds at that time goes to the north
00:45:01
porch where he is finished off
00:45:07
[Music]
00:45:16
[Music]
00:45:18
unfortunately the impression has been
00:45:21
given that there is that things are
00:45:24
being held back that many things are
00:45:26
being stonewalled it is given the
00:45:30
impression again not saying it's the
00:45:31
fact but it's given the impression that
00:45:33
that there's some type of a cover-up on
00:45:37
the night of the murder several people
00:45:40
reported seeing a man in a pinstripe
00:45:42
suit working in the corrections building
00:45:44
after hours he was Olive complected 5
00:45:47
feet 10 inches tall and weighed
00:45:48
approximately 180 pounds a
00:45:52
composite drawing based on witness
00:45:54
descriptions was made but the DA's
00:45:56
office did not release the drawing for 5
00:45:58
months they claimed the quality was not
00:46:01
good enough for publication even though
00:46:03
the composite had been drawn by a top
00:46:06
police artist
00:46:08
[Music]
00:46:09
one other disturbing fact added to the
00:46:12
speculation about a cover-up no
00:46:14
paperwork detailing Michael Frankie's
00:46:17
investigation into the Oregon prison
00:46:18
system has ever been found
00:46:22
shortly after Michael Frankie's death
00:46:24
some people some employees some inmates
00:46:27
spotted approximately 23 bags of
00:46:30
shredded
00:46:32
papers coming out of Michael Frankie's
00:46:35
office and some surrounding offices
00:46:36
that's something you have to wonder
00:46:38
about who authorized shredding of
00:46:41
documents from a murder scene
00:46:44
the officials investigating Mike's
00:46:48
murder don't want it solved
00:46:51
because it goes much higher in the
00:46:54
Oregon government my family is dedicated
00:46:57
to bring this to a successful conclusion
00:47:00
we're gonna find out what the hell
00:47:02
happened and we're gonna see that the
00:47:05
people who are involved
00:47:06
receive their full punishment

00:47:42
diagnosed with a minor learning
00:47:44
disability at age 12 he began to
00:47:47
withdraw from his friends by the time he
00:47:49
was 18 Oded was totally withdrawn
00:47:52
unwilling to communicate with anyone a
00:47:55
dead was afraid of the responsibility of
00:47:58
growing up because he didn't have the
00:48:00
emotional wherewithal he was too anxious
00:48:02
he was too afraid he couldn't do things
00:48:05
on his own a
00:48:07
year later Oded was diagnosed as having
00:48:09
autism a neurological disorder that
00:48:12
affects physical social and language
00:48:14
skills there is no known cure for the
00:48:16
affliction and doctors had little hope
00:48:18
that Oded would ever return from his
00:48:20
dark and silent world
00:48:22
[Music]
00:48:24
Odette's mother enrolled him in a

facility in Greenfield New Hampshire
00:48:28
where young people with mental and
00:48:29
emotional disabilities participate in
00:48:32
work therapy and receive counseling Oded
00:48:35
seemed to respond to his new environment
00:48:37
and even began communicating with one
00:48:38
staff worker
00:48:40
when Odette came he spoke very little
00:48:43
but then we would hear him speak
00:48:47
occasionally and he could say things
00:48:51
when prompted and encouraged
00:48:55
approximately six weeks after he arrived
00:48:57
at the farm Oded and several other
00:48:59
residents were doing their after the
00:49:01
insurance somehow Oded managed to wander
00:49:04
away from the group an hour later he was
00:49:06
nowhere to be found
00:49:10
the dogs were brought in and originated
00:49:14
the search over by the brook area over
00:49:18
to the lower left field
00:49:19
the search dogs followed Oh dead set for
00:49:22
approximately three miles along a
00:49:25
stretch of highway 31 the set abruptly
00:49:27

00:49:30
may have been picked up by a passing
00:49:32
motorist
00:49:35
my feelings out that he will be found
00:49:38
he's out there he's out there among the
00:49:40
population wherever it may be but he's
00:49:43
out there there have been several
00:49:45
reported sightings of Oded the most
00:49:48
recent last January Oh Dead's mother
00:49:51
believes her son is still alive and
00:49:53
hopes that wherever he is he will hear
00:49:55
her appeal a
00:49:57

you're okay

Odette Gordon is five feet eight inches
00:50:27
tall weighs 140 pounds and has black
00:50:30
hair and brown eyes at the time of his
00:50:33
disappearance
00:50:34
Oded was 21 years old authorities
00:50:37
