00:03:13
estate agent receives the type of call that all Realtors dream of a motivated buyer wants to purchase a
00:03:21
home and has a large budget the buyer wants to find a place fast but things that seem too good to be true
00:03:30
are usually just that the agent met with some mysterious clients to show them a beautiful home that met
00:03:40
their specifications but once inside the agent was brutally and viciously killed
00:03:49
her attackers fled Into the Night who would want to kill this pretty and vivacious young professional
00:03:57
and why would they set up a sham real estate deal to get to her and probably the most important thing to ask is why
00:04:07
would anyone want her dead with this crime it appears that motive may be the fastest road to finding the
00:04:16
Killer this week we will be discussing the true story of the unsolved murder of Lindsey busiak
00:04:26
the investigation into her killing has been almost lost in the sheer volume of misinformation out there surrounding
00:04:35
this case it is rare to find a case that is so cluttered with false facts unfounded
00:04:42
rumors baseless allegations and downright contradictory evidence what you will hear this week is not what
00:04:52
you will hear elsewhere we will discuss the actual concrete facts as stated by police investigators
00:04:58
and sources close to the investigation all of the other stuff the rumors and unsubstantiated innuendo
00:05:07
we will get into that when necessary if you've heard of the case of Lindsay busiak or even if you have not
00:05:14
get ready for the truth surrounding this case this is true crime garage and this is
00:05:21
the case of Lindsey buziak foreign [Music] Victoria is the capital city of British
00:05:41
Columbia the Canadian province located on the southernmost tip of Vancouver Island this is close proximity to
00:05:49
Seattle on the U.S side of the border and to the large Canadian city of Vancouver across the water Victoria has
00:05:57
a large population of over 350 000 in its greater metro area but it feels smaller and more intimate
00:06:06
than its numbers suggest most people are connected somehow and no or are acquainted with many other locals in
00:06:14
other words everyone pretty much knows each other or knows of one another on February 2nd 2008
00:06:23
a 24 year old realtor named Lindsey busiak was scheduled to show a house to some potential clients Lindsay was new
00:06:31
to the business she started about a year before and at this time she had not sold
00:06:36
that many homes yet but she loved the job and she was enthusiastic about her future in the
00:06:43
residential housing business Lindsay was a very outgoing young woman who was energetic and ambitious and she
00:06:51
had a lot of friends she also had a sister named Sarah with whom she was very close and she was
00:06:58
also close with her mother Evelyn who lived in the area and she had a good relationship with her father Jeff
00:07:05
Lindsay's parents were divorced and lived hundreds of miles apart Lindsay mentioned to some colleagues and friends
00:07:13
that she was excited because she had been contacted by some very motivated potential new clients this has been
00:07:19
backed up in interviews with her close Circle Lindsay received a call on Friday February 1st the call was from a woman
00:07:27
and from Lindsay's notes in her day planner and from what friends and colleagues have related we can piece
00:07:34
together the conversations she had with this female client the woman caller spoke in a thick accent that Lindsay
00:07:41
could not specifically identify but which led her to nickname the woman and her husband the Mexicans and her cell
00:07:49
phone this woman called Lindsay out of the blue she said that she and her husband
00:07:55
were coming to the area for three days to look at houses they were beneficiaries of a corporate
00:08:01
relocation package and they had to find a house very quickly she specified that they saw a new three-bedroom three-bath
00:08:11
home which was move-in ready 15 to 20 minutes from downtown with a large master bedroom and a separate
00:08:19
space for a housekeeper what truly perked Lindsay's ears the woman said they could spend up to one million
00:08:27
dollars on a home now Lindsay did not receive this call on her business phone line at the Re Max
00:08:34
office that she worked out of she received this call on her personal cell phone her cell number was available
00:08:41
posted publicly on some of her listings Lindsay was a lesser-known junior agent so she did find it strange that the
00:08:52
woman contacted her so Lindsay asked the woman how she got her information the woman told her she was referred to her
00:09:00
by a former client of Lindsay's she told Lindsay this person's name and it has been reported that Lindsay called
00:09:07
the former client but that lady was traveling and could not be reached in any event this one million dollar deal
00:09:15
would be very big for a junior agent and Lindsay jumped at the chance to find homes that would meet the client's
00:09:23
requirements over the next 24 hours there were six calls back and forth between Lindsay and
00:09:30
the clients of course we do not know what was actually said during those calls we do know that the couple and
00:09:38
Lindsay made an appointment to see a specific house one that was listed by some other Re Max agents likely known to
00:09:47
Lindsay the appointment was set for 5 30 on Saturday February 2nd to see the home
00:09:54
at 1702 de Souza place in Saanich this is an upscale suburb of Victoria there are reports that they scheduled showings
00:10:03
at five different homes and 1702 de Souza was to be the first of these appointments now some Reports say that
00:10:13
in one of the calls the female client told Lindsay that she would be attending the showing alone as her husband was Ill
00:10:21
there are other reports that say that it was the opposite that Lindsay was told only the husband would attend the fact
00:10:29
is we don't know for sure as only Lindsay and the clients know the content of those conversations now the house on
00:10:39
De Sosa place was a new build that was sitting on the market for close to a year the asking price was 900 and sixty
00:10:48
four thousand dollars it was situated on a new subdivision on a cul-de-sac named for the developer of
00:10:56
the new Street John desosa his company owned the 1702 property he reportedly was present on a building
00:11:05
site nearby on that day and wrapped things up by 5 PM and left for the day as did the construction workers building
00:11:14
another house on the street the cul-de-sac was located off of a residential Road this is torque Drive
00:11:21
which was aligned with houses now we're going to have two eyewitnesses from the neighborhood that night
00:11:28
and what these two witnesses reported seeing was a young dark-haired woman presumably to be Lindsay greeting and
00:11:36
shaking hands with two other adults outside of the De Sosa Place property that evening yeah one male and one
00:11:44
female so one witness was driving by in a vehicle he confirmed seeing three people the other witness was a little
00:11:52
more detailed this was a woman walking her dog she was able to provide police with a description of the couple that
00:12:00
Lindsay was talking to this was a man and a woman it appeared to her that the couple did not know the young brunette
00:12:07
did not know Lindsay she also reported a car parked in the driveway so note here
00:12:14
we have one vehicle three people this car that was parked in the driveway was later confirmed to be Lindsay's vehicle
00:12:24
after shaking hands the three then walked toward the home the lock box to the De Sosa place address was accessed
00:12:33
at 5 29 pm this would be when Lindsay used the key in the lock box to enter the home with
00:12:40
the clients so no car other than Lindsay's was parked in the cul-de-sac or in the
00:12:47
driveway of the home according to these two witnesses at 5 45 PM Lindsay's boyfriend Jason
00:12:55
zalo he's a mortgage broker and a realtor at the same company as Lindsay he pulled up outside of the home
00:13:04
Jason was accompanied by a friend named Cohen Oatman Cohen worked with Jason and
00:13:10
the two were on a hockey team together and they actually had a game later that evening
00:13:16
Jason was exchanging text with Lindsay prior to his arrival but Jason not being able to reach his girlfriend eventually
00:13:25
went up to the front door of the home and tried the handle the door was locked Jason recognized that during a showing
00:13:33
the door should not be locked further he saw Lindsay's shoes black heels lying on the floor in the entryway
00:13:41
which isn't that uncommon because a lot of times when they have showings they make you remove your shoes this was a
00:13:48
bit he found it to be strange but only in combination with his inability to reach her so right you got to factor in
00:13:55
all these things he sees the shoes in the entryway the door is locked which he found odd plus she is aware that he is
00:14:03
going to meet her at this property and she's not responding to any of his tests and also
00:14:09
he's meeting her there because she feels odd about the meeting in general she feels a little suspicious of these two
00:14:16
individuals so she kind of asked him to be there something doesn't feel right to
00:14:21
her I mean that she's keep on getting a Million Dollar Listing call with being such a young agent
00:14:28
and then on top of that the accent doesn't make sense to her and then again on top of that now one of them is going
00:14:35
to be sick and so they're just going to show up as one person instead of a couple well let's go through what he
00:14:42
found because there is a good reason for debate on his motivation for meeting her at that
00:14:49
property that night so once he is kind of set on alarm here right the door's locked he's unable to reach her he is
00:14:59
then going to interrupt the showing and this is he rang the doorbell he knocked repeatedly when no one answered he
00:15:08
called 9-1-1 at 605 PM requesting police to do a welfare check on the property now not satisfied with waiting for the
00:15:18
cops Jason and Cohen circled the house and noted that the French doors facing the fenced patio on torque drive on that
00:15:28
side they were open so Cohen got over the fence and this has been reported two ways
00:15:36
some Reports say that Jason boosted Cohen over the fence others say that there was a gap in the fence where some
00:15:43
boards were missing and Cohen slipped through there while Jason was on the phone with 9-1-1 now Cohen entered the
00:15:50
home through the French doors that were already open he walked inside passing through the downstairs to the front door
00:15:58
unlocking it to let Jason inside then a second 9-1-1 call came in at 6 11 pm this time from inside the house at
00:16:09
1702 De Sosa the caller Jason reported finding Lindsay on her back lying on the floor in the corner of the master
00:16:18
bedroom seemingly dead and lots of blood in the room there was no one else in the
00:16:25
house and they had not seen anyone leave the police arrived and Jason and Cohen were taken to the police station for
00:16:33
questioning Lindsay was beyond help the CBC reported that she died of multiple stab wounds they have never confirmed
00:16:42
the extent of the injuries they are keeping this information to themselves the scene was secured crime scene tape
00:16:50
was put up around the house crime scene texts began processing the home and the detectives combed through the home and
00:16:58
canvassed the neighborhood so police have not officially confirmed that the 9-1-1 caller was Jason or Cohen
00:17:07
and they have not even officially confirmed that it was they who found Lindsay remember they're keeping a lot
00:17:13
of this stuff to themselves but we know this because Jason has given some interviews notably to Dateline and
00:17:21
participated in a police reenactment of what happened when he entered the home through the front door
00:17:28
Saanich police Sergeant Chris Horsley has also given interviews relaying Jason's movements as he arrived at the
00:17:36
house and found Lindsay so let's get into what we know about Lindsay's movements that day the text
00:17:44
between Jason and Lindsay and what was found at the murder scene so Lindsay and Jason were living
00:17:51
together they had ate lunch that day at a restaurant called sauce they paid the bill there at 4 24 pm and they left in
00:18:01
separate vehicles we aren't certain where Lindsay went directly after this lunch but some reports state that she
00:18:08
told Jason that she was going home to change her clothes before her meeting Jason left to go meet Cohen and the two
00:18:17
went to an auto shop called shc where Jason was doing a mortgage deal the two were seen on surveillance camera
00:18:27
outside of shc at 5 30 PM this is them getting into Jason's Range Rover now around this time Jason texted
00:18:37
Lindsay saying I'll come meet you and I'll be 10 to 15 minutes or so Lindsay responded okay I'll see you in a
00:18:47
bit I gotta go the Mexicans are here let's be clear we don't know if these individuals are in fact Mexican right
00:18:56
this is simply a nickname right that Lindsay gave to these potential clients I find this all very strange for a
00:19:08
multitude of reasons one we can see online her daily planner where she took notes from the call that she received
00:19:15
from the woman with the thick accent that Lindsay could not identify right what I find weird here is it doesn't
00:19:22
seem to indicate well not that it doesn't seem it does not indicate in her notes the name of these potential
00:19:30
clients right and then on top of that in her cell phone she nickname nicknames them the Mexicans this based off of what
00:19:39
she said was a weird accent right I also I think it wasn't just that it was weird
00:19:44
that it came off phony to her so at 5 38 PM Jason texted Lindsay's phone again this time saying just a
00:19:55
couple of minutes away this text was never read on Lindsay's end at 5 41 PM Lindsay's Blackberry made a
00:20:04
call to a contact in her phone this is to a friend that Lindsay had not spoken to in quite some time the friend can
00:20:14
hear some things but it is muffled and jumbled and there's really nothing clearly audible to the friend
00:20:23
police believe that this call was a butt dial that somehow during the attack a button on Lindsay's Blackberry was
00:20:31
pressed and the call went out as she was being attacked Sergeant Horsley said quote so we
00:20:39
believe that was actually at the point of attack when the couple attacked Lindsay somehow it hit buttons on the
00:20:47
BlackBerry and it sent out a phone call end quote the Blackberry was found in Lindsay's pocket after she was killed as
00:20:57
said the autopsy findings in Lindsay's case have never been released we know that she was stabbed to death a press
00:21:04
conference held by the Saanich police confirmed that Lindsay died from quote multiple stab wounds
00:21:11
but police have never explained or expanded on this information right the the rumor is what over 40 stab
00:21:19
wounds oh man okay let's get into some of these rumors and just a real quick disclaimer this is going to be one of
00:21:25
the more brutal parts of of this case but keep in mind these are not facts these are what what I'm calling
00:21:33
calculation I'm calling these internet facts where they're they're really just rumor okay so ones that I found was that
00:21:41
she was stabbed 54 times in the chest and head one stating that she was stabbed 40 times and then one that as
00:21:49
you mentioned stabbed over 40 times [Music] she was stabbed where her new breast
00:21:55
implants yeah which Lindsay had a recently got breast enhancements and and those were mutilated they said right so
00:22:05
yeah to further that rumor people say that they were deliberately or intentionally mutilated
00:22:12
and then we have the other statement of that she was nearly decapitated again to be perfectly clear these are
00:22:20
just rumors there has never been any official confirmation of the extent of her injuries or the number of times she
00:22:28
was stabbed or the bodily areas where she was stabbed there's many many cases that the person dies from knife injuries
00:22:36
that you'll hear rumors of almost decapitated yes so we have a source that is close to the
00:22:46
investigation and this is author Gary Rogers whom we were able to talk to well covering this case he's working on a
00:22:55
book about the case now Gary says that he was privy to the autopsy report and he did share some of this information
00:23:05
with us and this is information I have not heard elsewhere he says Lindsay was the victim of
00:23:12
between 10 to 15 stab wounds to be clear and to credit Gary Rogers he's being somewhat vague on that number
00:23:23
because we're not going to compromise the investigation that that has not been released to the public
00:23:29
now this quote from Sergeant Horsley provides some more information stating when they went upstairs there's a master
00:23:38
bedroom and an in-suite bathroom we know meaning law enforcement that when Lindsay turned to show the ensuite
00:23:47
bathroom she was then attacked from the rear there's no defensive wounds whatsoever we don't believe she had any
00:23:56
pre-indication that something was amiss Gary tells us that Lindsay was in fact attacked from behind almost certainly
00:24:06
with a large knife and incapacitated by severing her central nervous system this
00:24:12
means her spinal cord was severed by the knife she was then rolled over and stabbed in the chest area and down to
00:24:20
her abdomen judging by this information it seems to me that whoever did this wanted to be 100 percent certain that
00:24:29
she was dead now no weapon was found at the scene Lindsay was found on the floor of the
00:24:36
master bedroom near the bathroom her body fell so that it would have been visible to someone coming up the stairs
00:24:43
and glancing into the master bedroom so the injuries to the spine they think were done purposefully
00:24:50
that the person knew what they were doing possibly that that's certainly a possibility
00:24:57
or it could also it could also be just happenstance but what I think we can point out and say for certain given this
00:25:04
information is she was in fact attacked from behind did not know that she was about to be attacked because there was
00:25:09
no defensive wounds and I really think that there's there's multiple areas that you could have hit
00:25:16
with that first strike that would have left her incapacitated Lindsay was found lying on her back
00:25:24
there was Zero evidence of sexual assault Lindsay's wallet purse cell phone and jewelry were all found at the
00:25:33
scene undisturbed Lindsay's business suit soaked up much of the blood although there was still plenty left at
00:25:41
the scene how much blood would have been on the killers is anyone's guess foreign
00:25:50
[Music] [Music] we're back maybe you're back watch your back watch your back we will
00:26:18
be at the Ohio crime and Corruption event at the Ohio history Connection in Columbus that is this Saturday we will
00:26:27
be talking for about an hour and we are scheduled to go on at 2 30 p.m so if you
00:26:33
want more information or ticket information you can find that at our website True Crime garage.com yeah and
00:26:41
after we're done talking we'll be there for a little bit afterwards to meet with
00:26:45
anybody that shows up that's right that's right and if you still need more True Crime garage don't forget about the
00:26:51
Stitcher app and our other show on Stitcher premium the wonderful very highly touted show that everybody
00:27:01
tells everybody else about award-winning award-winning it's number one in Japan it's called off the Record right and and
00:27:10
all everything we just said is off the Record okay Captain so the choice of weapon here in this case
00:27:17
really and unfortunately makes a lot of sense right it's a knife was used in this
00:27:24
murder now unlike a gun this is going to leave little forensic evidence behind it's going to make no noise and does not
00:27:34
require a permit so less of a trail here right Canada has much stricter gun laws than the United
00:27:42
States and a knife would just simply be easier quieter and leave no Trail but the other thing that we can figure
00:27:50
out too is that this knife was brought to the house by The Killers and taken away yeah and given our source he says
00:28:00
it was a rather large knife so if in fact this was a large knife you do have to wonder how it was concealed
00:28:08
and I'm also guessing that the attack taking place upstairs rather than downstairs on the ground level
00:28:16
this was also deliberate so one you would be leaving the body left away from prying eyes the upstairs
00:28:25
in compared to in comparison to the ground level where anybody could just walk up and look through a window right
00:28:31
the other thing too is if the attack does not go as planned then there's a longer Escape Route for
00:28:39
Lindsay to get away from her attackers and again it just seems to be deliberate you know they knew that they were going
00:28:47
to be shown the house so let's wait until she takes us upstairs or let's suggest hey can we see the upstairs and
00:28:55
then when her back is turned the attack went down now Jason and Cohen as we said were
00:29:02
actually taken to into police custody yeah there were actually I believe handcuffed and taken into custody so
00:29:11
this is obviously for several different reasons right they found the body and there at the scene of the murder scene
00:29:18
now Jason probably had blood on him we do know that he attempted CPR this is in spite of him saying that he could tell
00:29:28
that Lindsay was dead now Jason's a pretty big man I think he's like six two six three two thirty two forty yeah yeah
00:29:36
and he was uh I believe an amateur hockey player or Semi-Pro yeah something something of that nature is there a
00:29:45
difference well I think you're you're partially professional much like your your conduct on this show
00:29:53
yeah um so he tells police that he arrived at the house around 5 45 p.m now I want
00:30:00
everybody to really pay attention here because we're not just we're not going back through stuff that we've already
00:30:06
discussed we're going to go into more detail about what his movements were that night in that day right so he says
00:30:15
he arrived around around 5 45 p.m at the house that she was showing he and Cohen
00:30:21
stayed in the car they parked in the cul-de-sac and they were watching the house well let's back
00:30:26
up he was running a little bit later than he would told Linds he would be but that's because when they left the car
00:30:33
dealership that they actually had to call to get directions uh they weren't really
00:30:39
familiar with how to get to that house there's some people out there that are saying hey we're missing something a big
00:30:46
part of this case which is hey Jason may or may not have seen The Killers When he
00:30:53
pulled up near the property I just want to so we can all get a clear understanding of what maybe going on
00:31:01
that we go through these items one at a time so they are part Jason and Cohen are
00:31:09
parked in the cul-de-sac and they are watching the house he says they arrived at 5 45 PM then at
00:31:17
5 55 pm he texts Lindsay saying are you okay but receives no response Jason then moved the car to an actual
00:31:27
parking spot on Torquay drive and he says he got out and he went up and looked through the front door glass
00:31:35
this is when he saw Lindsay's shoes he became concerned and made some calls these calls were him trying to gain
00:31:43
access to the home remember the door is locked at this time yeah and this is in fact backed up by cell phone records
00:31:53
when this didn't work when he couldn't gain access to the house this is when Jason made the first 9-1-1
00:32:00
call at 605 pm now crime scene investigators tracking fingerprints and Footprints they have
00:32:08
verified Jason and Cohen's stories about their travel into and throughout the house
00:32:15
the home had been thoroughly cleaned the morning before the showing and was empty
00:32:21
nobody was living in this house right so it was very easy for them to establish what took place or to verify that their
00:32:31
stories were in fact correct well let's stay on that for one one second because the house was basically empty as ready
00:32:39
to be shown and this is one of the reasons why they start rolling out the idea of a robbery because all of
00:32:48
Lindsay's belongings are still there and then there's obviously nothing to be taken in the house
00:32:54
again you gotta question the motivation right right and the while we're talking about evidence the only DNA that was
00:33:02
recovered from the house is was Lindsay's Jason and Cohen were released after this
00:33:11
initial questioning and Jason did obtain a lawyer now with his lawyer's assistance Jason cooperated with police
00:33:19
in performing the reenactment walkthrough of his actions when he entered the front door of the home he
00:33:27
says immediately he ran up the stairs calling for Lindsay and this has caused a lot of people to be suspicious of
00:33:35
Jason why is that so after this video and after the interview with Jason was aired on Dateline in 2010 people were
00:33:45
wondering how they're pointing out and thinking that he may have known in advance prior to
00:33:52
walking through the front door that Lindsay would be found upstairs here's the thing we gotta if you're
00:34:00
going to make that leap let's also keep some other possible leaps in mind as well right
00:34:07
you have to wonder it's possible since Cohen already ran through the downstairs to get to the front door that Jason may
00:34:15
have just anticipated that Lindsay was not on that ground level floor and we also have the police statements of her
00:34:24
body could be easily seen from somebody who was going up the stairs and looking in the direction of the master bedroom
00:34:31
well now in his own words it took him he said maybe two seconds from the time he
00:34:37
opened the door to get up the steps yeah and he knows that his friend by this time had already run through the
00:34:44
back door through the French doors all the way through to the front door yeah I but I could see why they're suspicious
00:34:51
of that I think that's something as far as investigators uh that they want to question and you kind of see them do
00:34:59
that during this reenactment or this walk through so one thing that I really want to dive
00:35:06
into right here before we get to all this other stuff with Jason is the whole reason for him being at the
00:35:15
property that she was showing in the first place all right this is where I'm going to try to really start to cut
00:35:20
through some of the crap that's out there and try to present what I believe is to be real okay so this is another
00:35:29
reason why people are suspicious of Jason and this stems from one narrative that has really taken over this case the
00:35:36
story is Lindsay was nervous about the showing and the prospect of meeting strangers whose accents she was was not
00:35:45
familiar with and that she in fact asked Jason to attend this showing for her protection
00:35:53
on February 4th this is two days after the murder CBC reported that Lindsay's colleagues
00:36:00
said that she had quote a bad feeling about the cell phone calls right CTV News attributes this quote to her friend
00:36:10
Vicki Mackey this is a story repeated by Lindsay's father Jeff but there is evidence that
00:36:18
this story in fact is incorrect or at the very least extremely exaggerated okay so for one thing Lindsay was a
00:36:28
smart ambitious professional young woman she knew that part of her realtor's job
00:36:34
involved showing properties to people right often people she's never met before Jason for his part he told police that
00:36:43
he arranged to meet Lindsay at 1702 De Sosa place because he was the listing agent on the shc property now remember
00:36:53
this is the property that he left with Cohen to go over to De Sosa place right the reason why he was going to meet
00:37:03
Lindsay there in Jason's words was not for her protection he was just stopping by there
00:37:10
to pick up some paperwork this was just going to be a quick stop talk with her briefly grab some paperwork
00:37:17
Lindsay the reason for this is Lindsay was representing a buyer a potential buyer who made an offer on the shc
00:37:26
property that Jason was the listing agent for okay so the shc owner made a counteroffer and Jason wanted to get
00:37:37
that to Lindsay to submit it to her client ASAP anybody that's in the real estate
00:37:44
business anybody that's in sales will tell you if you got if you got talks going on back and forth and you think
00:37:52
that you're going to be able to get a deal done you get that deal done right you don't you don't give somebody time
00:37:59
to talk themselves out of purchasing well it depends on if you're a professional or if you're
00:38:05
semi-professional so it seems like Jason would have had a different reason for being at the house
00:38:14
and this in fact does change a lot of what one could think or be suspicious of changes it drastically because my first
00:38:23
question in all this is if you're there to protect your girlfriend or even your friend or whatever you're a real estate
00:38:32
agent it's not that these are people who these are people people right they want
00:38:41
to they wouldn't feel uncomfortable pulling up in the driveway they wouldn't feel in uh uncomfortable interrupting
00:38:49
the showing because it's as simple as hey I work with Lindsay I am here um if you guys need me what a great
00:38:57
property it's you know or I'm here as part of the showing they don't need to know why you're part of the showing
00:39:03
exactly and if you are in fact there for her protection then you are there for part of the showing right and so why
00:39:09
Park and you're you're six three 240 pounds a hockey this this guy doesn't have a problem if
00:39:18
if there's going to be a fight so again the the story The Narrative has been she
00:39:24
felt uncomfortable Jason is going to go there you know for her protection again it doesn't make a lot of sense and that
00:39:34
makes you really question Jason but then when Jason says well no that's not why I
00:39:38
was going there I had to give her paperwork well if you're just giving somebody paperwork
00:39:45
you're not going to be that concerned that you're running a little bit late you're not going to be that concerned on
00:39:53
yeah because you're technically not late right right if you were there for the showing if he were to be there to be
00:40:00
part of the showing he would have been late however what he's stating is I'm there to have a quick meeting with
00:40:06
Lindsay regarding this property that I have the seller she has the potential buyer we have to do some quick paperwork
00:40:13
so in fact he is actually there for another purpose which is going to take place after the showing so he's not even
00:40:21
he's not late he's not part of the showing and therefore like you said if he was there for
00:40:28
protection he would have been late and you would have anticipated he parked the car and go into the house and say hey
00:40:35
sorry I'm late I was supposed to surprise for the show here yeah yeah I mean you'd think again yeah I I back up
00:40:42
all that stuff I I think of but then it becomes it's convoluted which story is correct
00:40:51
because what's weird too is they a little bit of both can be correct at the same time she
00:40:59
could have felt weirded out by this girl that she thinks has given put in on a fake accent that's a little strange but
00:41:07
you got a Million Dollar Listing so maybe you mentioned that to your father that seems a little strange kind of a
00:41:14
little weirded out by it but we'll see what happens and even if she mentions that to a friend okay maybe that's just
00:41:23
some conversation if that conversation didn't happen with Jason and if his reason for being there
00:41:31
wasn't for protection then his story makes sense so I'm not going to throw the father under the bus or the friend
00:41:38
under the bus to say that she didn't say those things but that didn't that doesn't mean that she went the extra
00:41:44
step to say hey Jason I want you to be there at a certain time and and to be here at the showing with me
00:41:50
the other thing too you know the Saanich police they spoke to all parties around
00:41:57
this case her colleagues her friends and their official statement on this is that they say while Lindsay felt the
00:42:07
showing was unusual because she was not the listing agent she wasn't apprehensive about it right now let's go
00:42:16
over that a little bit because the way this story kind of reads is that they were just like hey we're just looking
00:42:23
for a house I believe this first house the the murder scene house was one that they actually picked out
00:42:33
does that make sense when when the quote unquote Mexicans called her this well that's a that again that's why
00:42:41
I was quick to point out that other than Lindsay's notes and some conversations that she had with colleagues and such
00:42:50
we don't know exactly what was discussed on those phone calls right and that has been
00:42:57
something that's been hotly debated too how did they end up at this property right was it at the client's suggestion
00:43:05
was it at Lindsay's suggestion or was it somebody else well again I'm gonna go back to what I heard the logical thing
00:43:14
is at some point Lindsay was telling her friend or her father that she thought it
00:43:19
was a little strange that they called her and not the listing agent of that house
00:43:26
so to me that is that's she's gone well why are you calling me when you could have called the listing agent of that
00:43:34
house so to me they knew about that house to me that house was they brought that
00:43:41
house into the equation so I saw her notes from the initial phone call yeah there's no address
00:43:51
that she wrote down in her notes and so what that leads me to believe I'm not saying that I'm right I don't I'm not
00:43:59
going to pretend that I know but what that would lead me to believe is that that property was not discussed during
00:44:05
that phone call and was not brought up by the clients well it could have been as simple as
00:44:10
that she just Googled it and left it up and didn't put it in our notes but I I see
00:44:19
uh your logic because she wrote down like what they what they were looking for yeah she wrote down three bedroom
00:44:25
three bath space for a housekeeper separate living area for housekeeper large master bedroom I'm just saying
00:44:33
that the idea General distance from downtown right I'm just saying the idea that this rumor is out there that she's
00:44:41
saying hey it's kind of weird that they called me and not the listing agent of this house the fact that that kind of
00:44:48
rumor of that conversation is out there leads me to believe that the Mexicans knew about this property which would
00:44:56
make some sense too though because we know that they're not trying to buy a house we know we now know that they were
00:45:05
they were leading her somewhere and they were going to murder her and so why wouldn't you want to pick the location
00:45:12
well not only that why wouldn't you want to pick a vacant house you know like where I said nobody lives in I believe
00:45:20
the attack going down upstairs is deliberate that's that's for the purpose of them not finding her body
00:45:27
as quickly right which would make me somebody lived there then you're like they have to return home at some point
00:45:33
right but again her conversation about why would they call me when there's a listing agent well that was the that was
00:45:40
the police's statement right right we don't know that she actually said those words but what I'm saying is again then
00:45:46
it go another logical step is if you're the one planning this murder playing this attack why wouldn't you want to
00:45:54
know everything about the property so you're the one that found the property Jason in the Public's eye is I mean the
00:46:04
only way to look at this Captain would be to say that in the Public's eye he's likely the number one suspect according
00:46:10
to the internet and there is concern because of two variations of the story that he told to police about something
00:46:20
he saw that night this is something we touched on earlier but we have not gotten into yet okay so on Dateline on
00:46:27
the Dateline episode about this case Jason told sleepy Josh mankiewicz that he saw two shadow shadowy figures
00:46:37
through the frosted glass of the front door he assumed Jason assumed that they were the couple that Lindsay was meeting
00:46:46
but on True Crime daily Sergeant Chris Horsley said that Jason saw the killers from his car as the front door of the
00:46:56
house opened saying quote the killers were actually about to walk out the front door and leave he turned into the
00:47:03
cul-de-sac and interrupted them leaving if he meaning Jason had been five seconds later he would have driven right
00:47:11
into the suspects walking out of the house into the driveway right it's believed that he got a pretty clear look
00:47:20
at the mail but not so much the female so according to the sergeant Jason told police that the couple turned
00:47:30
around and closed the door and that he actually saw them or as you said at least the man
00:47:37
and Horsley goes on to say quote and his assumption is these are the clients and
00:47:44
the showing is just starting as the door closes quote he then Parks outside because he
00:47:51
is waiting for the showing to end but the showing didn't end Lindsay never emerged from the home and eventually
00:47:57
Jason called 9-1-1 so let's let's dive into this real quick here according to Sergeant Horsley
00:48:06
Jason interrupts these two leaving but Jason doesn't know that Lindsay has been attacked at this point he actually
00:48:14
thinks that they just turn around and that they're walking into the home and the showing is about to begin and that's
00:48:20
why he kind of just sits there and chills for a minute but then when he doesn't hear back from
00:48:25
Lindsay and when Lindsay and nobody else leaves the home then he's starting to question what's going on
00:48:32
Okay so here's a big problem with these two stories one what was said on Dateline
00:48:38
and what was said by the sergeant on on True Crime daily this looks like it's two different stories
00:48:46
right yeah so the Dateline episode made made it appear that Jason only saw people through the
00:48:54
glass of the front door when he actually said he could see two people through the
00:49:01
glass only after they went back inside the house upon seeing his car so this is this is one of those weird
00:49:10
situations where it's not two variations of of a story he's not telling two different stories it's just different
00:49:19
portions of the same story it's just people reporting the story differently right so the Dateline episode made Jason
00:49:26
come across as telling two different stories now the Saanich police and this is one thing that I think is
00:49:33
Keith Morrison on that episode um did he go aha well I know that why would Jason be telling us he was talking
00:49:41
differently to Sleepy Josh mankowitz I like Josh a lot oh I do too he's a very nice guy I do too he's a great drinking
00:49:49
partner he looks half asleep during his interviews he looks half asleep when you're sometimes fully asleep during the
00:49:55
videos so real quick here Jason pulls up to the house well real quick here's the thing that
00:50:01
that people are missing in this case and this is where you can't have you can't have this whole idea that Jason
00:50:10
told two different stories it doesn't where it gained legs and went off walking on its own it needs to we can
00:50:18
very quickly remove those legs there should not be a story here because the Saanich police held a very unusual press
00:50:27
conference this is shortly after the Dateline episode aired in this press conference the Saanich
00:50:34
police said that the episode resulted in rampant speculation that Jason and his family were responsible for Lindsay's
00:50:43
murder police reiterated in the press conference that Jason and his family are not suspects in the case
00:50:51
so what that tells me is which is I think a stupid line anyways because we know now or what we think we know is
00:51:01
that they didn't find any DNA in the house other than Lindsay's but they did ask Jason to submit a DNA test and as
00:51:10
far as I know he's never submitted that DNA test now again goes from the crime scene gets handcuffed goes downtown you
00:51:19
know extensive interview interrogation goes back with his lawyer to actually go through the property do walk throughs
00:51:28
being very Cooperative but they asked for DNA again when you lawyer up what's your
00:51:34
lawyer going to tell you no we're not submitting DNA so I don't know if I put that so much on
00:51:42
Jason but if that rumor is true then you can't sit there and tell me that you that he's
00:51:49
cleared and they're not suspects okay so let's stay on this for a little bit so we have a murdered young realtor
00:51:57
yeah mysterious foreign clients virtually no forensic evidence that the police will discuss
00:52:04
and no clues as to the Killer's identities or motives so let's go through what we do know
00:52:11
according to Sergeant Horsley we know from forensic evidence that both the man and female did go through the
00:52:19
home this is his words right he says quote we do have evidence of them leaving the home however we don't have
00:52:26
anything in the form of DNA or fingerprints end quote now thanks to our source Gary Rogers we can tell you
00:52:34
exactly what this evidence is according to Gary investigators were able to track
00:52:40
sock and nylon impressions of Lindsay and two others throughout the house they found a bloody trail of footprints one
00:52:50
in a larger wool blend pattern sock the other a smaller more feminine nylon print leaving bloody prints leading from
00:52:59
the upstairs down to the foyer this probably where they presumably picked up their Footwear
00:53:06
their shoes and out the French doors leading to the patio yeah now based on this police could tell pretty much
00:53:14
exactly what happened in the home and determined that the female and male couple seen with Lindsay were almost
00:53:21
certainly the perpetrators of her murder it seems that they just got lucky that there was a hole in the fence so that
00:53:29
they could sneak out of the patio and exit onto the street yeah got lucky or they knew they knew this house in
00:53:36
advance so but it but it does seem that their exit plan was to leave out the front door the way that they came in but
00:53:44
this was got all messed up when Jason drove up to the property right but they parked on a different Road or we could
00:53:51
assume that well we worked on a different Road well that that that is a good question
00:53:57
um they didn't park on that road we know that now could they have had a getaway car getaway driver where they dropped
00:54:04
off right where they picked up that's also the possibility yeah so again who are these two people
00:54:11
we know that per police statements that they are most 100 percent almost 100 percent the perpetrators of Lindsay's
00:54:19
murder and back to the two eyewitnesses the lady walking her dog saw two people in the driveway with Lindsay the
00:54:26
description she provided is of a six foot tall Caucasian man in his mid-30s with a medium build dark
00:54:36
hair now the woman walking her dog only saw the man from the back she didn't get
00:54:42
a look at the front of him okay and she also described a Caucasian woman in her mid-30s to 40s medium height and build
00:54:52
with shoulder length blonde hair now she only saw the woman from the side the woman she described was wearing a dress
00:55:01
the dress was a wavy pattern and white black and reddish pink this is described as a very distinctive
00:55:09
dress and actually police wondered at the time if it was worn specifically to distract any Witnesses from noticing any
00:55:17
facial features of the two or any other distinguishing characteristics and it wasn't reported that the man was wearing
00:55:25
a brown jacket of some kind from my notes I don't have anything regarding a brown jacket but keep in
00:55:33
mind the other eyewitness was driving his car so he only got like a glimpse right of these two people and I I bring
00:55:41
that up because I'm not saying it happens all the time but you we have this reddish pink black
00:55:48
dress man wearing a brown jacket chances are if the these couple left together then they would change the jacket to the
00:55:57
black jacket and they would match on some level um my gut feeling tells me that these
00:56:04
people don't leave that they live in separate houses that's what my gut feeling is telling me
00:56:11
um and I know that sounds silly based off of color coordination but that's my gut feeling
00:56:17
that they're not they're not wearing some type of uniform to indicate that they're together no I know it sounds
00:56:23
silly but I I that's my gut feeling well regarding went to pick up the woman she got in the car and we don't match we
00:56:32
don't match regarding the dress I think the dress is very important because it is described
00:56:38
as very distinctive again it was a wavy pattern in in white black and reddish pink
00:56:44
the police went on to say that because it was so distinctive they thought that maybe the dress would actually lead them
00:56:53
to the the killer or at least to whoever the woman was that that attended that showing right so but their their
00:57:00
statement was quote we think we may have even found the exact brand of the dress
00:57:07
it wasn't a designer high-end name brand unfortunately it was something that could commonly be purchased in a
00:57:15
department store so unfortunately the dress did not pan out for police well I think it had maybe possibly two purposes
00:57:21
one to distract people so they're not looking at facial features but I think on the other hand if it's red and pink
00:57:30
if you if you're leaving it's a reddish pink so it's it's actually a black and white dress with a reddish pink wavy
00:57:38
pattern right but what I'm saying is um so you're leaving a house with some blood on you
00:57:45
it might distract people from the of the fact that you have blood on you it's possible I personally I think that
00:57:53
whatever they were wearing that day was to look as if they should be looking at a home that cost
00:58:01
over nine hundred thousand dollars okay that's that's why I think when when they
00:58:05
get this description when law enforcement gets to the description of this dress I think that's why they
00:58:10
immediately thought that it could have been a higher end designer brand that there would have been less of and they
00:58:17
would have had a chance of tracing it in some form or fashion now a year after the murder police released a sketch of
00:58:25
the blonde female seen by the witness in uh profile unfortunately this did not lead to any leads
00:58:34
now police examined Lindsay's phone and her day planner and found the phone number for the quote Mexicans as she
00:58:43
called them they traced the phone number and found something startling the phone used was a burner phone
00:58:51
purchased with cash the previous November at a convenience store in Vancouver there was no surveillance
00:58:58
footage of the phone purchase now keep in mind it wasn't that the store didn't have
00:59:04
cameras it was more so that this took place so long before right nobody had asked for
00:59:12
this footage eventually eventually they lose it or you know copy over it anything like that
00:59:18
so the uh burner phone was activated online just days before the actual murder and
00:59:27
it was activated under a name uh Apollo Rodriguez p-a-o-l-o Rodriguez I've spelled that
00:59:36
just because I probably mispronounced it and was listed to a business address this business was located in Vancouver
00:59:44
now to be perfectly clear when they registered the phone and to get the phone number they had to
00:59:52
provide an address okay so they provided an address to a business and it's been determined that this business is
00:59:59
unrelated to anything in this case right now the first call on that phone the first call made to Lindsay was
01:00:09
possibly on January 31st 2008 and it came from the Vancouver area the phone then traveled to Victoria on Friday
01:00:22
February 1st 2018. this is by way of the two-hour ferry from Vancouver this is confirmed by cell phone pings along the
01:00:31
way and it was used again to call Lindsay more than once that day and again on February 2nd which was the day
01:00:39
of the killing the phone was never used again after the murder and it was never it's never been
01:00:47
found the phone was only ever used for one thing communicating with Lindsay Sergeant Horsley says quote it's a level
01:00:57
of planning that clearly shows Lindsey buziak was the target [Music] thank you Captain and thank you to all
01:01:15
of you out there for listening and telling a friend please join us back here in the garage tomorrow for part two
01:01:21
until then be good be kind and don't live foreign [Music]
