[AUDIO LOGO] [TENSE MUSIC] NARRATOR: In the early hours of the morning, on a quiet suburban street--
00:00:19
- Don't move. Don't move. NARRATOR: --a man is ambushed in his driveway. - Don't move.
00:00:25
Let me see your-- DREW TAYLOR: Do they know him? Where'd they come from? Did they follow him?
00:00:32
[GUNSHOT] - Oh! KAREN OLIVER: We screamed. I grabbed my chest because there were so many shots fired.
00:00:42
[GUNFIRE] - Whoever is shooting at Andre is trying to hit him. - What happened? Who did it?
00:00:59
REPORTER: This video, provided by a neighbor, shows a threatening man. He's seen walking past a home, holding an ax.
00:01:06
[INDISTINCT SHOUTING] [THEME MUSIC] [INTRIGUING MUSIC] NARRATOR: After a busy night, Dallas clubs and bars
00:01:30
are closing-- [LINE RINGING] --when a call comes in to 911. DREW TAYLOR: A bartender was driving home,
00:01:41
and he saw someone in the street, crawling. He just thought the person was intoxicated or in some kind
00:01:49
of other distress. [SIRENS BLARING] NARRATOR: First responders head to the street
00:01:54
in Old East Dallas. DREW TAYLOR: The police arrived within minutes and realized that he was in a very bad state.
00:02:05
He had a gunshot wound to his side. And he could speak but barely, and was just asking for help.
00:02:14
[SIREN BLARING] NARRATOR: Too weak to give his name, the young man is rushed to the hospital.
00:02:24
- The police had no idea what had happened because there were no shell casings in the area.
00:02:28
All they had was blood. So they thought maybe his body had just been dumped there.
00:02:35
What's going through the police officer's head is, where is the crime scene? How did he get here?
00:02:41
What happened? [SOLEMN MUSIC] NARRATOR: Three hours after the bleeding man was found,
00:03:03
Regina Oliver is heading to East Dallas with her son Andre's young daughter. REGINA OLIVER: I had to get up early
00:03:10
to deliver Andre's golden child to him because I was starting my new job. She was to be with her dad all day.
00:03:26
When I was leaving the house, I kept calling. No response. And I'm calling and calling, and I'm like, what is going on?
00:03:37
I got to his house. The car was in the driveway. The passenger door was open. And I called, and I called.
00:03:50
And all of a sudden, I spotted Andre's phone sitting on the armrest. I saw the cheeseburger was over in the car seat,
00:04:05
and it was smashed. Some fries were on the floor. I said, there's something-- no, something ain't right,
00:04:11
something ain't right. I'm a little freaked out. I'm a little scared. So I called 911.
00:04:21
DREW TAYLOR: Regina called the police. And the description that she gave of a tattoo
00:04:25
that he had triggered one of the officers to recall that the person they had found a couple of blocks
00:04:31
away had that same tattoo. [SIRENS BLARING] NARRATOR: Dallas PD officers head straight to Regina's son's
00:04:38
home. REGINA OLIVER: The officer kept questioning me. He said, what does your son look like?
00:04:46
I said, he has a short haircut, a little blonde on the top. He said, he's about how tall?
00:04:52
I said, he's 6' 5". He said, can you identify your son? I said, of course. I had my phone.
00:05:02
I said, this is my son right here. I showed him pictures of him. NARRATOR: Police are in no doubt.
00:05:11
Regina's son is the young man found gunned down in the street, who sadly didn't make it.
00:05:20
He died from his injuries in the hospital. [GENTLE MUSIC] - I-- I lost it. I lost it.
00:05:42
NARRATOR: He is not just Regina's adored son. He is also the much-loved local hero and NBA basketball
00:05:51
superstar Andre Emmett. - Half my heart was taken, my heart, my soul, my mind. It was-- it was a nightmare.
00:06:14
NARRATOR: News of Andre's death spreads quickly among friends and family. BRIAN EVANS: His mom calls me, hysterical, you know.
00:06:26
And her words, I'll never forget them. She was like, "They done killed my baby."
00:06:34
It was devastating, man. Like, it was a surreal moment. KAREN OLIVER: I broke down.
00:06:44
I just could not understand why something this is tragic were to happen to someone as sweet as Andre.
00:06:57
I just could not fathom us not having him around. It's just a day that changed our lives forever.
00:07:14
NARRATOR: Growing up in a tough area, 37-year-old Andre Emmett defied the odds
00:07:20
to become a sporting hero. [CHEERING] PLAYER 1: Hey, hurry up, man. PLAYER 2: Dre.
00:07:29
PLAYER 1: Hey, hurry up, Dre! - It's your boy, A to the E. [BACKGROUND CHATTER] PLAYER 1: Chill out, man!
00:07:34
- Got Dre, you dig? BRIAN EVANS: When I first met Andre, we were actually eighth graders at the time.
00:07:39
We were actually playing one-on-one basketball. And I got lucky. I won the first game.
00:07:45
And after that, I can't tell you the next time I beat him. So, you know, that's how it started.
00:07:51
KAREN OLIVER: Everybody just recognized his talents at a very early age. And I knew then we had a superstar.
00:08:03
NARRATOR: Starting his career in college basketball, Andre played for Texas Tech's Red Raiders.
00:08:10
REGINA OLIVER: He always had a trick. He always had a slick move that he thought he could, you know,
00:08:15
capitalize on. [CHATTER] - I charged it to him being a good dancer, because on basketball courts, you got to be
00:08:26
able to move a little bit. Literally, man, he would make a move, and it looked good
00:08:32
and scoring it easy. NARRATOR: Andre is still Texas Tech's all-time leading scorer.
00:08:40
- Good. Let's change it. Ready? Go. That's one. Practice. You got it? My name is Charlie Miller.
00:08:48
And I was a mentor, coach, friend, brother. Watching him play live, Andre was larger than life.
00:08:58
He had a knack for scoring. NARRATOR: Drafted to the NBA, Andre played for teams including the New Jersey Nets and
00:09:08
the Memphis Grizzlies. - Andre wanted to make his mom proud. And that's exactly what he did.
00:09:19
Every accomplishment, every award, every trophy is-- went to his mom. [CHEERING]
00:09:31
REGINA OLIVER: Andre was a good person. He never tried to hurt anybody. [TENSE MUSIC]
00:09:41
NARRATOR: As the police examine the crime scene, they begin gathering evidence.
00:09:48
- They believe that Andre had been shot near his condo. Crime scene found a number of shell casings, about five
00:09:57
near his Range Rover, and then some more were found down the sidewalk near a blood trail
00:10:03
that was leading in the direction where he ultimately collapsed, where the 911 caller found him.
00:10:10
NARRATOR: Devastated by their loss, Andre's family gather close to his apartment.
00:10:16
KAREN OLIVER: When I got there, I ran up to my sister, and I said, "I'm so sorry.
00:10:21
I'm so sorry." And at that point, I just remember being very, very angry. Very angry.
00:10:36
And I started to ask questions. What happened? Who did it? - Why would you shoot someone outside their house?
00:10:45
What is this over? Is it over money? Is this just a personal vendetta. Is this a robbery?
00:10:51
Is it a deal gone bad? [SUSPENSEFUL MUSIC] NARRATOR: Officers canvass the neighborhood.
00:11:00
DREW TAYLOR: They're looking for any kind of witnesses. They're looking for any kind of surveillance
00:11:05
that may assist in their investigation of why this happened and what happened. One of the big breakthroughs that the police had
00:11:16
was Andre's own Ring camera footage in front of where Andre was shot. Was Andre's killer caught on camera?
00:11:31
[SENTIMENTAL MUSIC] REGINA OLIVER: What I have here is something I'll always cherish--
00:11:45
Andre's personal phone. It has a lot of memories of him, his children, and some fun
00:11:56
videos of him and the kids. Andre is the father of two beautiful girls. The last video in here is when he took his babies to the park.
00:12:14
They played in the water. [SPLASHING, LAUGHTER] This has to be the last memory that they have with their dad
00:12:22
because that was the last time they saw him. They were having fun with Dada. He loved being a father.
00:12:32
He did. And they loved their daddy. He was weak behind the girls, very weak behind those girls.
00:12:39
Yes, he was. [SOMBER MUSIC] NARRATOR: Raised by his single mom Regina, Andre was born in Dallas in August 1982.
00:12:55
- Andre and my relationship was tight. KAREN OLIVER: He loved his mom. They were very close.
00:13:05
They talked every single day. REGINA OLIVER: Andre was-- he was an awesome kid. He was full of life.
00:13:15
He was fun. Everybody loved Andre. He was not a fighter. Mm-mm, he was not like that.
00:13:25
He was not like that. [TENSE MUSIC] - So a piece of information that the family provide
00:13:37
to the police is that Andre always wore two necklaces and then a custom Rolex that
00:13:43
was valued at about $80,000. At the time Andre was found, he did not have the watch or the necklaces that the family
00:13:52
said he always wore. The police suspected that this was a robbery. NARRATOR: When police view Andre's Ring doorbell footage,
00:14:04
it appears to confirm their theory. Andre had just arrived home after being at a local nightclub.
00:14:13
DREW TAYLOR: So finding this footage showing the events that happened was devastating.
00:14:19
But it also told the story of the last moments of Andre's life. The surveillance video captures Andre in his driveway,
00:14:28
and he's sitting there. And we come to find out that he's actually eating Whataburger.
00:14:35
And you see one of the suspects approach and then point a gun at him. - Don't move.
00:14:39
Don't move. Don't move. DREW TAYLOR: Andre, he's got his hands up. And now you see the second individual come.
00:14:48
And so Andre's gonna get out. At this point-- and I'll pause it right here-- you can see it's kind of blurry.
00:15:01
And so you can't really see the people's faces. And you see him taking off his jewelry.
00:15:09
And he gives it to him right there and takes off. [GUNSHOT] - Oh! - And you hear the first gunshot,
00:15:17
and you see Andre begin to run away. NARRATOR: A neighbor's doorbell camera captures what happens next.
00:15:28
[GUNFIRE] DREW TAYLOR: And so that was very shocking. Then you see the two suspects run away--
00:15:39
[GUNSHOT] --and another gunshot. That many gunshots tells me that whoever is shooting
00:15:48
at Andre is trying to hit him. The footage is great in the sense that you now have an idea of what happened.
00:15:58
But because you can't see their faces, you don't know who did it. The fact that Andre gave up his jewelry and the shooter
00:16:07
still shot him leads you to believe that maybe this was something more, something more personal.
00:16:16
NARRATOR: Police turn to Andre's family for help. REGINA OLIVER: Nobody I knew or ever thought of
00:16:23
wanted to hurt Andre. BRIAN EVANS: I can't think of anybody that would want to harm Andre.
00:16:30
He was a great individual, all smiles, always giving. - This is the nicest kid in the world who
00:16:38
would do anything for anyone. Didn't have any enemies. Gave back to the community.
00:16:46
Was a good kid. [GENTLE MUSIC] KRISTA TORRALVA: Andre was known in Dallas as a really upstanding individual,
00:17:04
a role model to the youth. He was a hometown hero. Andre's story is definitely inspirational
00:17:13
for kids in Dallas, especially in the neighborhood of Oak Cliff. That area is historically lower income
00:17:23
and has higher than average high school dropout rates. CHARLIE MILLER: Andre was well-loved in the community
00:17:31
because Andre was a hooper. Everyone in every neighborhood loves hooper in the urban community.
00:17:43
Andre would go play in the parks, and that's what made Andre relatable. He was a people's person.
00:17:52
He just had a big smile. He'd light up the room. He had an aura about himself. You know, a lot of people looked up to Andre.
00:18:03
BRIAN EVANS: Dre was very charismatic naturally. It wasn't something that he put on.
00:18:14
He had, you know, an it factor about him that everybody knew about. REGINA OLIVER: The neighborhood kids loved to see him.
00:18:26
They thought he was a big brother. They called him Big Bro, you know, Big Dre. BRIAN EVANS: He's a natural hero.
00:18:36
When I say that, I mean that he's always going to want to give back. He wants to do the right thing.
00:18:41
And he's just a gentle giant at heart, man. - Woo! [BACKGROUND CHATTER] [INTRIGUING MUSIC]
00:18:52
NARRATOR: Despite the video of Andre's murder, police still have no leads on the shooter.
00:18:59
So they continue canvassing the neighborhood. DREW TAYLOR: They were able to locate a witness that
00:19:05
heard the gunshots, looked out of a window of his apartment that was across the street, and saw
00:19:11
two men running into a white Chrysler 300 and then driving off. NARRATOR: Security footage with a timestamp
00:19:22
matching the door cam footage shows the white car. DREW TAYLOR: This video you're about to see right
00:19:28
now is from someone's apartment complex. And it captures the white Chrysler right here, arriving.
00:19:38
The people in the Chrysler 300 parked minutes before Andre had arrived. It's almost as if they were expecting him.
00:19:47
And so they were only there for a few minutes before the shots happened. And then they ran back into the Chrysler, and then drove away.
00:19:57
Then you see the car drive off. This video made it that much easier to say, yes, this
00:20:05
is, in fact, our suspect vehicle. - Don't move. DREW TAYLOR: Those two individuals were
00:20:10
waiting for Andre to rob him. [GUNFIRE] No one was able to positively identify the individuals.
00:20:20
How did they know he was going to be here? Why are they waiting? Where did they come from?
00:20:24
Did they follow him? [TENSE MUSIC] NARRATOR: As police check local traffic cameras,
00:20:40
hoping to follow the Chrysler's movements, Andre's postmortem report is released.
00:20:49
DREW TAYLOR: That autopsy told the investigators that Andre was killed by a single gunshot
00:20:55
wound that entered his shoulder and went to his chest. KAREN OLIVER: One bullet.
00:21:03
I kept saying, one bullet to the back of the shoulder. I said, that one bullet would not have killed him.
00:21:11
He was in such great shape. [GUNSHOT] DREW TAYLOR: The kind of bullet that hit him was an RIP bullet, a Radically Invasive Projectile,
00:21:20
that had eight prongs, that once it hit his body and got inside, those prongs spread.
00:21:27
They went into his shoulder bone, into his lungs. I believe it hit his heart. There is a world that someone shot with a regular
00:21:38
bullet survives. Someone who uses this kind of ammunition does not have much regard for human life.
00:21:47
That's just a cold killer. NARRATOR: The search for the white Chrysler draws a blank.
00:21:57
Investigators are struggling to find new leads. DREW TAYLOR: Despite the police's best efforts,
00:22:03
the search for Andre's killers went cold. [SOMBER MUSIC] REGINA OLIVER: September 30, 11:00 AM,
00:22:20
the day of Andre's funeral. Crazy. BRIAN EVANS: The funeral, man, it was really sad, man.
00:22:32
His mom, his aunt, the babies, they're not knowing what's really going on. REGINA OLIVER: I told his girls,
00:22:49
"Jesus needed a superstar." Andre had a beautiful service. And I'm glad I was able to at least touch his hand
00:23:04
and kiss him before I was able to lay him to rest. KAREN OLIVER: He meant a lot to the people here in Dallas.
00:23:18
So we had to allow the people who have supported him throughout the years to pay their respects.
00:23:33
REGINA OLIVER: It was police, FBI all over the church. It was crazy, because the guy was still out.
00:23:44
[TENSE MUSIC] NARRATOR: Andre's doorbell footage is the best evidence investigators have.
00:23:55
Forensic video analyst Nick Barreiro is routinely called to help solve difficult cases like this.
00:24:05
NICK BARREIRO: Having video footage for a police investigation, not only can it corroborate
00:24:11
what a witness may have said on the scene, it might be the only witness. And so what I do is I make that truth as clear
00:24:20
as it possibly can be. We use a wide variety of different pieces of software to authenticate, enhance, analyze video footage.
00:24:34
[GUNFIRE] When we watch this footage back, we can see the suspect come into frame behind the victim,
00:24:48
chasing the victim down the street here. But the suspect is almost entirely in shadow.
00:24:55
So what I've done is I've adjusted the brightness and contrast, just to see if we can
00:25:02
get a slightly better view. So, unfortunately, the level of detail in this video
00:25:14
is not quite enough to see their faces. But there's important details that can be extracted from this with just
00:25:25
a little bit of enhancement. We can tell that the suspect was using a handgun, likely with an extended magazine.
00:25:35
We can see that the suspect was right-handed. We can see that the suspect was wearing
00:25:40
what appears to be a light-colored, maybe a gray hooded sweatshirt, whereas none of that
00:25:47
was visible in the original unenhanced footage. We get a pretty good view of his stature, his body type,
00:25:56
the way that he walks, the that he runs. All of that can be critical in positively
00:26:02
identifying the suspect. The video footage is important from the investigative side.
00:26:10
If you don't have a suspect, you know, all of these things that we've learned about the suspect from enhancing the video can help
00:26:17
to narrow your suspect pool, can help to eliminate suspects, and help to confirm a suspect.
00:26:23
[SUSPENSEFUL MUSIC] NARRATOR: Police appeal directly to the public. KRISTA TORRALVA: Dallas Police released video surveillance
00:26:37
footage showing the crime, hoped that they would get tips to find out who those two people were.
00:26:46
KAREN OLIVER: We cut on the TV. We all sat in the living room, and we watched the news.
00:26:55
[GUNFIRE] We saw the footage. We screamed. I grabbed my chest because there were so many shots fired.
00:27:12
And again, I became very, very angry. - Andre's murder in the driveway of his own home
00:27:20
was shocking. He complied with these robbers and gave them what they wanted and then tried to flee,
00:27:27
and they shot him in the back. And I think that that was especially really shocking
00:27:30
for the community, that he had given these robbers what they wanted, and they still took his life.
00:27:39
NARRATOR: It doesn't take long for tips to come in. DREW TAYLOR: Releasing this footage paid off
00:27:45
so well because Andre was very well-respected, but also because of the heinous nature of the offense.
00:27:52
The way in which he was gunned down helped the public want to help out the police
00:27:57
in this kind of Investigation. NARRATOR: Two men are mentioned by several callers,
00:28:04
Michael Lucky and Keith Johnson. DREW TAYLOR: Now that we had names in this investigation
00:28:11
and we have a white Chrysler, what became of the paramount importance was identifying and linking somebody of these names
00:28:19
to that white Chrysler. [TENSE MUSIC] The police were able to identify that Keith Johnson had
00:28:31
a girlfriend who had recently purchased a Chrysler 300 from a used auto dealership.
00:28:38
NARRATOR: It's a significant break. She's brought in for questioning. - What I'm going to talk to you about is a murder, OK?
00:28:45
- Murder? - It's a murder case, yeah. So this is the case about the basketball player, Andre Emmett.
00:28:53
They shot and killed him after he gave them their stuff, right? And he took off running, OK?
00:28:59
Now, I also released that the car that they used was a white Chrysler 300, OK? And I've got the car on video leaving the scene, OK?
00:29:07
So I know you're the owner of the car. - But that car had been stolen. I can't report no stolen car.
00:29:17
I ain't even use my real information to get the car. I can't report no car stolen.
00:29:24
NARRATOR: Police know this claim is false, as the car was sold with a GPS tracking unit.
00:29:30
- Your car had a tracker on it, OK? And that tracker shows everywhere the car went, OK?
00:29:39
DREW TAYLOR: So with this GPS tracker, the GPS data showed that that Chrysler 300 was
00:29:46
around Club Theory, the club that Andre had been at that night he was murdered. And it showed that that Chrysler followed Andre
00:29:55
from Club Theory to the Whataburger, and then back to his home. As great of information as this GPS tracking data was,
00:30:06
it still didn't tell us who killed Andre. [SUSPENSEFUL MUSIC] NARRATOR: But the Chrysler's tracker
00:30:13
does reveal something else. DREW TAYLOR: The police eventually discover through the tracking of this Chrysler 300's
00:30:21
movements that it was taken to a salvage yard, or what's commonly referred to as a chop shop,
00:30:29
and that Keith Johnson and Michael Lucky had driven that Chrysler 300 there and asked that it be destroyed.
00:30:40
NARRATOR: Using the tracker's last known location leads police to the man they believe
00:30:45
helped dispose of the car. - Tell me what you did with the car. - We just parted the car out, sir.
00:30:54
- So you parted the car out? - Yes, sir. - OK. Where did you take the parts? - Like, I just sold them in different places,
00:31:01
different people. - Now, with regards to the car, where's the body? Where's the body?
00:31:10
- I sold it. - What junkyard do I need to go to, to find the frame? - The-- I was at Sunshine.
00:31:21
- Sunshine. NARRATOR: Police head straight to the auto parts scrapyard, where they find the crushed body of the Chrysler.
00:31:36
DREW TAYLOR: So this became a huge breakthrough because based on the fact that people fitting the description
00:31:41
of Keith Johnson and Michael Lucky destroyed that Chrysler 300, and the fact that there were tips that they were
00:31:48
the individuals in the surveillance video, we now had evidence linking them to the murder.
00:31:55
NARRATOR: Police waste no time. 32-year-old Keith Johnson and 29-year-old Michael Lucky are arrested on suspicion of murder.
00:32:12
- Keith Johnson was already in jail on suspicion of prior crimes. Michael Lucky turned himself in on a warrant.
00:32:21
DREW TAYLOR: I think for the police, this was a huge success. You started with a case that had few leads, a little bit
00:32:27
of camera footage. You get the public involved, and now you have two individuals arrested
00:32:34
for Andre Emmett's murder. [TENSE MUSIC] NARRATOR: Then the case takes a dramatic turn.
00:32:42
Tips come in saying a third person was involved in Andre's killing. BRIAN EVANS: I did some searching,
00:32:52
and I came up with some valuable information. I did go down to Dallas Police with audio, video,
00:33:01
where there's people stating clearly from a certain part of town saying, hey, this guy was the one that did it.
00:33:10
DREW TAYLOR: Tips were coming in that Keith Johnson and Michael Lucky were in the car and involved in the planned
00:33:18
robbery, but that neither one of them was the actual shooter. These tips were coming from people
00:33:25
with extensive criminal history. I believe the fact that Andre was so well-respected,
00:33:31
even known criminals are trying to help the police out. NARRATOR: One name stands out--
00:33:40
23-year-old Larry Jenkins. BRIAN EVANS: They had been ringing that name for a while, Larry Jenkins.
00:33:50
People had been saying that he was the one. [GUNFIRE] DREW TAYLOR: An individual stated
00:33:57
that he had heard whispers on the street that Larry was involved, and he was the one that shot Andre.
00:34:03
And so that person had met up with Larry a few days later at a smoke shop. And he asked him, why did you shoot that man if you
00:34:11
already had his valuables? And he said, he shouldn't have run and that he'd do it again.
00:34:18
NARRATOR: Another witness who knows Larry Jenkins comes forward. - I don't like people who kill people.
00:34:26
I just don't like it, and it bothers me. You know what I'm saying? Especially this deal.
00:34:30
Let me show you this, OK? So you see-- - The other guy hit him in the face with the gun.
00:34:36
- Yeah, he's already here. But let me just play it. - He just wasn't thinking it was going to hit.
00:34:43
- Don't move. Don't move. Give me everything! I want everything! - Yep, that's Larry right there.
00:34:49
"Give me everything." That's Larry. Larry's gonna hit him in the face with the gun.
00:34:54
- So you see he's taking the necklace off. - Yeah. - He's handing it over. Who's he handing it to?
00:34:59
[GUNSHOT] Who? - Oh! - Keith Johnson. Keith Johnson right there. [GUNFIRE] - Where was Mike then? - That's Larry.
00:35:06
Mike might have been in the car. - He stayed in the car? - Yeah, that's Larry right there.
00:35:13
DREW TAYLOR: He was able to identify Larry Jenkins's voice as being the shooter.
00:35:17
[SUSPENSEFUL MUSIC] NARRATOR: Jenkins is brought in for questioning. DETECTIVE: So we got a lot of people
00:35:25
that are calling in, saying, man, that guy's voice, that's Larry Jenkins, OK? - Man, I was [MUTED].
00:35:33
But I ain't did nobody. I'm telling you the truth, sir. I heard about it. Everybody talking about it.
00:35:40
Everybody saying they did some crazy [MUTED]. But it ain't got nothing to do with me, sir.
00:35:45
I promise you it don't. - All right. So you don't have any information on this case?
00:35:50
- No, sir. I don't know nothing about what happened besides what the news said. - Like I said, I just wanted to let
00:35:56
you know that you're a potential suspect in this case, OK? [TENSE MUSIC] NARRATOR: Police believe Larry Jenkins is their shooter.
00:36:10
But to build a case, they need more. So they access his phone to trace his movements
00:36:18
the night Andre was killed. NICK BARREIRO: CellHawk is an amazing piece of software.
00:36:27
It allows investigators to see suspect's movements in a way that was never possible before.
00:36:36
Everybody that's walking around with a cell phone in their pocket is essentially walking
00:36:40
around with a tracking device. Every time your cell phone interacts with a cell tower,
00:36:46
it's logging that location. And it can actually animate this trail on a map so you can see, visually, in real-time exactly
00:37:01
where this device was, creating a timeline of everywhere that that cell phone has gone and the time that it was there.
00:37:14
DREW TAYLOR: When they placed the information in the CellHawk, they were able to see
00:37:18
that Larry Jenkins's phone number identically tracking Chrysler 300's GPS location
00:37:26
the night of the murder. - What are you doing, man? - Don't move. I want everything!
00:37:31
DREW TAYLOR: Not only do you have two witnesses who identified that Larry Jenkins stated that he shot him,
00:37:37
but you now have information that shows that Larry Jenkins's phone is following that Chrysler 300.
00:37:46
This is why we now had enough to charge Larry Jenkins with capital murder. [SOMBER MUSIC]
00:38:01
NARRATOR: The three suspects are all charged with murder. Larry Jenkins is the first to face trial.
00:38:10
He pleads not guilty. REGINA OLIVER: My thoughts going into the trial, was, this has got to be the end.
00:38:36
The jury has to see what criminal act was committed toward an innocent person who
00:38:44
did nothing. DREW TAYLOR: I could not lose this case. It was important for me to secure justice for Andre.
00:38:58
REGINA OLIVER: Seeing the guy, I couldn't sit still. I was a nervous wreck. I couldn't take my eyes off the back of his head.
00:39:17
DREW TAYLOR: The first big piece of evidence that we introduced was, of course, the surveillance video.
00:39:23
- Don't move. Don't move. DREW TAYLOR: That piece of evidence was super important because it showed just
00:39:30
the brazenness of the robbery. [GUNSHOT] That was going to be powerful for the jury to understand,
00:39:39
these people got what they wanted. They robbed him. But they didn't have to kill him.
00:39:44
[GUNFIRE] - It's heartbreaking, the fact that he died behind some material. For me, it's heartbreaking.
00:39:54
Andre gave you the jewelry. To shoot him in the back after you already have what
00:40:02
you came for. DREW TAYLOR: When we played that piece of evidence of the surveillance for the jury,
00:40:11
you could look over and see they were mortified. BRIAN EVANS: It just puts a stamp on why he should never
00:40:19
see the light of day again. DREW TAYLOR: When you look at all the evidence, you basically get a version of events
00:40:28
that Michael Lucky, Keith Johnson, and Larry Jenkins followed Andre to the club, knew
00:40:36
that he had expensive jewelry. They followed him back to his home. They went up to rob him.
00:40:45
Andre gave them his jewelry, then he ran. And that's when Larry opened fire, shooting at him.
00:40:51
[GUNSHOT] And when you go through all the motives, it's pure and simple-- just greed.
00:41:06
NARRATOR: The trial lasts four days. The jury find Larry Jenkins guilty of capital murder.
00:41:18
KRISTA TORRALVA: I looked across the courtroom to Andre's mother, and she was hunched forward, crying softly.
00:41:26
And I can't imagine what that moment was like for her, to secure a conviction but know that her son was not going to be coming home.
00:41:36
- To me, looking at him, knowing what he had did, [CLICKS TONGUE], he didn't look remorseful, not at all.
00:41:47
He had no heart. He had no-- no soul. [INTRIGUING MUSIC] KRISTA TORRALVA: The video footage
00:42:00
was a major role in this case and the cornerstone of the prosecution's case at trial.
00:42:09
NICK BARREIRO: The prevalence of Ring doorbells, Arlo cameras, Nest cameras, that footage has proved
00:42:17
pivotal in so many criminal investigations that the world that we live in now, I'm not going to say it's
00:42:25
impossible to commit a crime and not be captured on video somewhere, but it's practically impossible.
00:42:32
NARRATOR: Jenkins is sentenced to life in prison with no possibility of parole.
00:42:39
BRIAN EVANS: I think he got what he deserved-- life in prison. You have to be behind bars.
00:42:44
You can't see and be out in the world. KAREN OLIVER: I'm sure he's going to run into some Andre Emmett fans in prison.
00:42:59
So he will be constantly reminded of the horrible, horrific thing that he did to our family.
00:43:12
DREW TAYLOR: This event didn't just result in Andre Emmett's loss. A mother lost her son.
00:43:21
A community lost a local hero. But most importantly, two little girls, they lost their dad.
00:43:28
That's the totality of what happened when these individuals took Andre's life. [SOMBER MUSIC]
00:43:41
NARRATOR: Jenkins' accomplice, Keith Johnson, takes a plea deal and is convicted of aggravated robbery
00:43:47
and sentenced to 20 years. Murder charges against Michael Lucky are dropped. - Andre, being a local hero, a city legend of Dallas, Texas,
00:44:05
they took one of their own. BRIAN EVANS: Andre grew up maybe a block or two away.
00:44:16
And we would come here in the past and play pickup games, you know, just have fun in the summertime and stuff like that.
00:44:25
NARRATOR: Today, this basketball court in Oak Cliff, Dallas, pays tribute to Andre.
00:44:33
BRIAN EVANS: The city knew that Andre played here a lot. It was named after him, you know,
00:44:37
just in honor of the person he was and the athlete that he was. The most important memory on this court
00:44:46
specifically was the day that they opened it as Dre's court. - 1, 2, 3. ALL: Long live Dre!
00:44:53
BRIAN EVANS: This whole place was packed. The city stepped out for Andre on that day.
00:44:58
[CHEERING] He'd be happy to know that there's something with his name on it in his community,
00:45:07
right by where he grew up at, right near his high school, where kids can go and enjoy themselves.
00:45:13
I've seen more kids trickle in, playing full court. And so to see that and to know when they say,
00:45:19
Where are y'all going to go play basketball at today? they're going to say, we're going to Andre Emmett's
00:45:24
court, right? That's the part that, like, makes my heart smile. That's the part where I'm like, good job, well done, Andre.
00:45:32
There we go. REGINA OLIVER: I'm so grateful to have had him 37 years. He was a big part of me.
00:45:53
He'll be forever remembered, forever loved. I just miss him so much. My angel. He is my angel.
00:46:09
He is. [THEME MUSIC] [AUDIO LOGO] [AUDIO LOGO]
