This episode of 48 Hours Mystery covers the disappearance of Michael Golib in Johnson City, Kansas, on May 20, 2005. Key discussions include Michael's troubled relationships with his ex-girlfriend Shannon and her husband Chad Floyd, the investigation into his disappearance, and the subsequent trials of Chad and Shannon.

Michael Golib was a dedicated father who went missing after leaving work to pick up his son Mikey. Friends and family express their suspicions about Shannon and Chad, noting their contentious relationship with Michael. Evidence suggests foul play, including Michael's blood found under the deck of Chad and Shannon's home.

The investigation reveals Chad Floyd's financial motives, as he cashed in stocks shortly before Michael's disappearance. Despite circumstantial evidence, including the blood and a missing gun, the case faces challenges due to the lack of a body.

Two trials result in hung juries, leaving Michael's family frustrated and without closure. The episode concludes with the Floyds being released after charges are dropped, and Michael's family still searching for answers.

Throughout the episode, the emotional toll on Michael's family is evident, as they grapple with his absence and the legal system's failure to deliver justice.

[Music] Johnson where I live is a mile square. It's a very small town. It's a farming community.
00:00:21
>> Let's take a look at your opening cash grain prices. Wheat at 803, Milo 563, corn at 606.
00:00:29
[Music] [Applause] It's a very cozy town actually. >> Good morning. >> Morning. >> You know, you feel comfortable there. I
00:00:40
do. >> Johnson tends to be a very boring place for the most part. So, when something like this happens,
00:00:52
it's so unfathomable to even try to think through what possibly could have happened. Michael went missing May 20th
00:01:00
of 2005. Michael got up early, gone to work. They were cutting at the time. He was the first one there at the shop.
00:01:12
He was the last one to leave. On Friday after work, Michael was planning on picking up his son Mikey for
00:01:19
the weekend. >> He was a great father. Michael was having some problems with his
00:01:24
exgirlfriend Shannon who he had a child with. >> Shannon wasn't happy. She always
00:01:31
complained. >> He was also having problems with a fellow by the name of Chad Floyd.
00:01:38
>> Chad Floyd was raised with money >> who was currently married to his former girlfriend Shannon.
00:01:46
>> I believe when Michael got to Chad and Shannon's house, some kind of altercation happened. They're the only
00:01:52
ones that had anything against him. >> I miss Michael every day. He was my baby.
00:02:07
>> It's clear to me that Michael Golib disappeared. The question is, what were the
00:02:13
circumstances involved in that disappearance? >> Michael just didn't take off. I thought foul play.
00:02:21
Michael's blood was on that porch. >> Was he shot? Was he hit over the head? We don't know.
00:02:31
>> You got no body and you don't have the murder weapon. Skimpy circumstantial evidence and you're trying to put
00:02:36
somebody away for life. >> Really shouldn't be hard to get justice in a town, any size town.
00:02:44
But when you are in a very tight-knit community like we are, I think it is tougher.
00:02:50
I believe that the evidence proves Chad and Shannon are guilty. If the justice system doesn't get them, God will.
00:03:00
>> Justice in the Heartland. Tonight's 48 hours mystery. [Music] [Applause] [Music]
00:03:37
You can drive a long way in Stanton County, Kansas, and rarely see another soul.
00:03:46
In tiny Johnson City, the county seat, the locals trade gossip at places like the County Fair Cafe
00:03:54
or the aptly named Rinky Dink drive-in owned by Mary Hart. >> I need a special, please.
00:04:02
>> It's a very close community. Things can divide it and cause hard feelings. things can draw close
00:04:10
together. >> It's the kind of place that doesn't welcome strangers easily. Deb Gallib
00:04:15
knows. She moved her family here from California after her husband died when her son Mike was 16. It was her
00:04:23
boyfriend Jim's hometown, but all new to Deb. We're newcomers. We've been here since 94. I'm an outsider. My son was an
00:04:33
outsider. His sister Chrissy stayed in California but made a point of being part of Mike's life.
00:04:41
>> I remember him calling me and about falling out relationships and likewise I remember confiding in him and he was so
00:04:50
good about that and I think that we really connected. >> Initially the local teens like D Murer
00:04:58
didn't know quite what to make of the newcomer they nicknamed California Mike. At first, I just thought he was a
00:05:04
smartass. I mean, he was kind of full of himself and cocky and walked around telling these stories that none of us
00:05:10
believed. And then we asked his mom and found out that most of them were actually true. And it just grew on me.
00:05:16
It didn't take very long until you were laughing as hard as he was when he was telling the stories.
00:05:21
>> Shannon and Steve Morris soon realized that behind that cocky exterior was a heart of gold.
00:05:28
>> Mike would make you feel good about yourself. Mike was a good guy. He'd give you the shirt off of his back.
00:05:33
>> He was uh funny. We were best friends as step brothers. He was a very smart guy
00:05:40
>> and a hard worker, adds his stepbrother, Bo Hines. Mike was a skilled mechanic
00:05:45
who spent long hours repairing equipment for his boss, Eric Kramer. >> Dependability was really good. Anything
00:05:52
you put that kid to, he would figure it out. He was pretty good. In 1995, Mike met another outsider, a
00:06:00
young woman named Shannon Alers from Montana. And from the start, Mike was smitten.
00:06:08
>> They seemed to get along very well at the beginning. It was let's let's go party. Let's go have fun. It was a fast
00:06:14
and furious thing. >> But the honeymoon didn't last. >> The only time Shannon ever talked to me
00:06:20
is when she wanted to complain about Mike and that's it. Michael never made enough money. She always complained
00:06:26
about money. >> She'd make comments like, "Uh, she has caviar taste on a hot dog budget." And
00:06:31
she'd say that in front of all her friends. >> The one bright spot, the couple's son,
00:06:36
Mikey, his father's pride and joy. >> Excellent father. He loved his boy. He was just a naturalb born dad.
00:06:46
>> But having Mikey didn't save the relationship. At its lowest point, Shannon even called the cops, alleging
00:06:53
that Mike had choked her. They arrested him. >> They had a fight and he had his hand on
00:06:59
her throat holding her away from him. >> The charges later were dropped, but Shannon soon moved out, taking Mikey
00:07:07
with her. >> I mean, he was in love with her, and he was devastated when they when they split
00:07:12
up. I mean, that was a hard time for him. [Music] Then at the age of 24, Mike Gulib had a
00:07:21
heart attack. Apparently the result of a genetic defect. It almost killed him. After his heart attack, he got scared.
00:07:29
He and I had a number of conversations that God had g given him a second chance and that he needed to pay attention to
00:07:35
that. >> Friends say that brush with death was a turning point and so was a new woman in
00:07:42
his life, Brooke Wilkerson. >> Young, fun. Um, they went skydiving together. She brought out a lot more a
00:07:50
lot of that life back to Mike. >> In 2004, Mike and Brooke had a son, Cameron. By all accounts, Mike Gulib
00:07:58
finally had grown up. His life was full. >> Mike turned into the young man that I
00:08:06
would have been proud to call my son. He he was in love with Brooke and he loved
00:08:11
his son Cameron very much and wanted to be the father that he never had. They were really happy. And Mike was talking
00:08:20
marriage. I mean, he was talking, you know, proposing to her. Mike's former girlfriend Shannon also
00:08:26
had moved on and up to marry Chad Floyd, who happened to be from one of the richest and most powerful families in
00:08:34
Johnson. Everybody knows the Floyds, whether it be through farming or sitting around a
00:08:40
coffee table at the local coffee shop. Their name is so prominent here. They're very huge in farming here. They've been
00:08:48
here for years. >> Chad and Shannon. What was the attraction there? >> It was money. Period. She's a gold
00:08:56
digger. >> And she wasn't out of Mike's life. They still were fighting now over Mikey. And
00:09:03
now Chad was involved. >> Michael wanted more time with his child. Shannon and Chad weren't willing
00:09:12
>> to to share. >> Mike was allowed to see Mikey only every other weekend. And despite the
00:09:18
bickering, the arrangement seemed to work for a while. But on May 20th, 2005, Mike Gulib drove away from work a little
00:09:26
before 6:00 to pick up his son. And he's not been seen since. As soon as Steve got off the phone with
00:09:34
Bo and told me he was missing, the very first thing I said was, "You don't think
00:09:39
Shannon did something to him?" >> You're kidding. It's >> the very first thing I said.
00:09:45
[Music] [Applause] [Music] Mike Golib's disappearance left his friends stunned and very suspicious of
00:10:10
both his ex-girlfriend Shannon and her new husband Chad Floyd. >> Cocky, arrogant,
00:10:17
>> arrogant, very arrogant, >> self-righteous. Comes from one of those families, a generation that's been
00:10:22
around, you know, generations of family that's been in this community forever. They have all the money in the
00:10:29
community. They control the community. Everybody's lives absolutely revolve around them, their money, and what they
00:10:36
do. >> It's not It's not that people are afraid of them like you would be someone from
00:10:40
the mafia, but everybody just kisses their ass and they bow down to them. >> No, money talks.
00:10:48
>> Money may talk, but Chad and Shannon did not when we asked them for their perspective.
00:10:54
[Music] and Golib's friends and family worried that the Floyd family's very prominence
00:11:03
in Johnson could influence the investigation. >> I mean, this is this is big stuff down
00:11:08
here. The police weren't talking publicly about this case. So, we brought in 48 hours veteran
00:11:18
homicide investigators Paul Celino and Joe Mura to look at the evidence and see where it would lead.
00:11:27
>> But we know he's right there between 614 and 620. >> Now, we know that the police spoke to
00:11:32
the neighbors. It's about half a mile or 3/4 of a mile up. >> All right. So, we're going into the uh
00:11:38
to Diane Floyd's restaurant and we're going to see if uh she'll speak with us. >> Well, the dynamic is is that the new
00:11:44
couple, Chad and Shannon, Chad decides he hates Michael because Michael is the father of a child that he's basically
00:11:51
raising in his home. Uh Shannon and Michael have a classic relationship of unmarried couple who had a child and
00:11:57
they're kind of at war with each other more often than not. >> Shannon had laid down strict rules for
00:12:04
Mike's visits with Mikey. He had to pick up his son in a car with a car seat at a
00:12:10
neutral spot, the local Amride convenience store. >> Very strict. We never vary. Okay. It's
00:12:18
always at AM Pride here. >> Not ever at their house. >> No. He picked her picked him up one time
00:12:23
only for a birthday party and that was Mikey's birthday party. That's the only time that I know of that Michael was out
00:12:29
there at their home. On May 20th, 2005, Mike Gallup was working with a crew in fields about 20
00:12:38
miles from Johnson. That afternoon, Shannon had called and asked him to do something very unusual.
00:12:47
Come to her house to pick up Mikey. So, around 6, Mike left in a truck borrowed from his boss.
00:12:56
The high school football coach next reports seeing Mike at 6:20 in Johnson at the corner of Lake and Logan, some 9
00:13:04
miles from Shannon's house. So, this is roughly where the last place anybody is known to have seen Mike.
00:13:12
>> Right. >> Shannon told police he never came to her house to pick up Mikey. When reliable Mike didn't show up for
00:13:24
work, >> calls started coming in the next morning that he hadn't made it home. So
00:13:27
>> So his family started calling her. >> Yeah. We started getting pretty worried
00:13:30
then. >> Yeah. >> His boss, Eric Kramer, feared an accident. A pilot, he took a helicopter
00:13:37
up, searched remote back roads, hoping to spot the truck. Not a trace. 5 days after Mike's disappearance, the
00:13:49
truck was spotted in a remote field. There was no evidence of any foul play and the mystery deepened. But given the
00:14:02
bad blood between Mike and the Floyds, Mike's mother says it never was a mystery to her.
00:14:08
>> I thought a foul play from the beginning. I would say so because there was so much hatred for me. It fit
00:14:17
together because I had known that she was vicious enough to do this and so is Chad
00:14:24
443. >> Police suspicions grew when it was learned that the Floyds were hoping to
00:14:31
move to leave Johnson for good. >> Him and Shantwell, they're looking at real estate. They're talking about
00:14:37
wanting to go to Colorado. They want to get out of here. And I who can blame him? Uh if you're young and there's not
00:14:43
a lot here for you in reality. I mean there's you know you're gonna farm or you're gonna farm some more.
00:14:49
>> Hi Sally, how are you? Joseph Mora. >> The couple already had talked about leaving to Sally Ooa, a child custody
00:14:56
worker from the state. >> So their plan when they saw you was to move out of state.
00:15:02
>> I don't know whether it was a plan at that time but it was definitely something they had discussed
00:15:06
>> as an option that they were really seriously >> seriously exploring it. I believe.
00:15:10
>> But then ooa told them something they didn't want to hear. If they left Kansas, Shannon probably would lose
00:15:18
custody of Mikey to his father. >> Chad wants out of here. He wants out with Shannon. He wants out with the kid
00:15:25
and he doesn't want Mike around. >> To the local cops, it sounded like a motive. They called in the Kansas Bureau
00:15:33
of Investigation. >> And what does Chad say when the KBI shows up at his house? What does he say
00:15:38
to the sheriff? Why'd you have to involve the F and KBI? You know why? Because Chad knows, uhoh, I got a
00:15:44
problem now because these guys aren't from here. They don't know me and they don't care.
00:15:50
>> Indeed, the KBI began digging into the Floyd's financial records and made a startling discovery. Two weeks before
00:15:58
Mike's disappearance, Chad had cashed in $50,000 in family stock. Investigators would
00:16:06
soon conclude the money was part of an elaborate scheme by the Floyds to make it look as if they had bribed Michael
00:16:12
Golib to leave town. In fact, Chad's cousin, who runs the local bank here, says that Chad told him exactly that,
00:16:20
the money was a payoff. So, Michael would disappear and give up custody of Mikey. He would never have sold his son,
00:16:29
especially not to those two. Not to Chad and Shannon. Never. 6 weeks after Mike vanished, KBI
00:16:37
investigators searched Chad and Shannon's house, already having discovered that Shannon had repainted
00:16:43
the front deck just days after Mike disappeared. Suspicious, they dismantled the deck and on the unpainted underside
00:16:52
of the boards, they hit pay hay dirt, small amounts of blood, and traces of Mike Golib's DNA.
00:17:02
It's some biological matter that came from Mike Golob. Okay, that's what we know. But of course, if he wasn't here
00:17:08
that day, how would it be there? >> Shannon and Chad also had recently replaced the front window. The repair
00:17:16
man said it had a hole in it. And finally, adding to the evidence against them, on the very day of Mike's
00:17:24
disappearance, Chad Floyd bought an untraceable rifle from his cousin. I think somebody was inside the house
00:17:31
with a gun. I think he came to the front door, rang the doorbell, and got shot. That's what the evidence looks like to
00:17:37
me. Um, and I think they got rid of the body. >> Assuming, of course, that Michael Golib
00:17:44
is even dead. [Music] [Music] He was my baby. He was fun. His laugh was invigorating.
00:18:24
He wanted to be a good father. losing that child. You never get over it. You never get
00:18:33
over it. >> I'm pretty sure. >> Good question. I don't know who that is, but I know that's Michael.
00:18:42
>> His mom and grandmother say there's an empty place in their hearts since Mike
00:18:47
Golib disappeared. >> You look like a kid. >> Adding to the pain, they no longer have
00:18:53
contact with their grandson. That BJ and Mikey. Yeah. >> We haven't been allowed to see Mikey and
00:19:02
he's been such a big part of our life and and then to have him ripped out, it's it's terrible.
00:19:09
>> But Shannon's a custodial parent and she doesn't want to have anything to do with
00:19:12
you. >> No. What is she afraid of? That's what I want to know. Why is she afraid for me
00:19:18
to see that child? Does Mikey know something? In fact, investigators never interviewed
00:19:25
Mikey, never asked the child what happened that day. 48 Hours consultant Joe Mur says that interview might have
00:19:33
shed light on the case. >> Police investigation initially could have figured out speaking to a
00:19:38
5-year-old. Did daddy come? Very simple question. Yes, daddy came. Did you see daddy leave? Very simple questions.
00:19:53
The Kansas Bureau of Investigation, the KBI, wouldn't discuss this case, but 48 Hours investigator Paul Celino says
00:20:01
their biggest challenge was obvious. They had no body. >> You could pick up all kinds of fibers,
00:20:08
issues off of the body, the injuries, what kind of bullet was used. Even without the body, KBI investigators
00:20:16
formed a theory that Chad shot Mike not with the untraceable rifle he bought from his cousin. Chad turned that over,
00:20:25
but rather with a Glock like this one. They know Chad owned a Glock, but that gun has disappeared. And on his lawyer's
00:20:35
advice, Chad never responded to questions about it. How's that possible? That Glock is just
00:20:42
gone. I don't know what happened to it. >> The investigator's theory, Celino says,
00:20:47
appeared to be that Chad shot Mike Gulib perhaps from inside the house. The bullet going through the living room
00:20:54
window and hitting Mike as he stood on the front deck. Adding to suspicion of the Floyds is
00:21:03
their cell phone record, a cluster of calls that Celino says supports the idea that Shannon took the kids off the
00:21:11
property while Chad committed the murder. Specifically, between 6:38, 657, there are 10 phone calls between Chad
00:21:21
and Shannon, >> right? >> That's when >> this murder takes place. >> That's probably it in that 18-minute
00:21:27
period. >> And then why are they calling each other on the phone? I mean, we got all kinds
00:21:30
of issues going on. You got a body you got to dispose of. You got to clean a deck. Brooke calls. He's not home. What
00:21:36
if somebody comes out here? What are we going to do? Listen, they're not serial killers. They've never done this before.
00:21:43
This is high anxiety. >> But illustrating what prosecutors are up against, Mora thinks those calls prove
00:21:51
nothing at all. >> We're talking about we're going to murder the individual at my house. I'm
00:21:56
then going to have to dispose of the body. Okay. So, I'm going to be wasting all this time making phone calls with a
00:22:02
person that I've already planned this murder with. I'm just not going to buy that. You know what I'm saying?
00:22:06
>> Still, nothing shakes Deb Golib's belief that the Floyds are responsible. >> So, you honestly believe that this this
00:22:13
young couple commits a murder? >> Oh, yeah. >> Over a custody fight? >> I do. >> That they've pre-planned?
00:22:21
>> Yes. >> They must be master criminals. >> Oh, no. Not at all. I think >> No one has found his body.
00:22:27
>> I think they're idiots. Who in their right mind would do something like this over a child?
00:22:34
>> But if Chad and Shannon did kill Mike Golib, what did they do with his body? Mike's family has several theories that
00:22:40
perhaps undercover of darkness, they simply buried it out in the fields or maybe even dumped it in an old abandoned
00:22:47
well like this one. You find them still scattered around these parts. Anything dumped down there is unlikely ever to be
00:22:59
found. Without a body, the evidence in this case was circumstantial. The painted deck, the blood under the
00:23:09
boards, the broken window, the missing gun. But prosecutors are convinced they know
00:23:16
what happened. And a year after Mike Gulib disappeared, they arrest, charge, and jail Chad and Shannon Floyd.
00:23:30
Bond was a million dollars each, and it takes only three weeks for Chad's father
00:23:35
to bail them out. And he hired two of the top lawyers in the state to defend them.
00:23:42
>> They've put a lot of money out there for those kids to protect those children.
00:23:47
to protect Chad and Shannon. What are they protecting? Are they protecting the name of Floyd?
00:23:53
>> Still, Deb Gulib has sympathy for Chad Floyd's parents. >> I feel sorry for them. They have had to
00:24:01
go through hell as much as I have. My family's not the only one that's been hurt by this.
00:24:08
[Music] A full cycle of planting and harvesting passed before the trial began in the
00:24:20
summer of 2007. It lasted two weeks and then after just 2 days of deliberations, the jury
00:24:29
declared itself hopelessly deadlocked. [Music] Deb Gallib was distraught. She was so
00:24:43
sure the evidence would convince even a jury from Johnson. >> I think it was such a private
00:24:50
devastating time for us. We have cried so much over this and it's an everyday occurrence for us to talk about it.
00:24:58
>> There's no evidence the jury was influenced by the Floyd family's power, but Mike Golib's friends have few
00:25:05
doubts. Any other place in the United States, any other jury that would have heard the evidence that was put forth,
00:25:11
they would have been guilty. >> Not so fast, say prosecutors Rick Gwyn and Barry Disney. They refile the
00:25:19
charges, rolling the dice again with a jury from Johnson. >> This is a big deal. I want to win this.
00:25:26
Nine months later, they seem confident that this time they will win justice for Mike Golib, even if Chad Floyd doesn't
00:25:36
seem the least bit worried. The defendant Chad Floyd is charged with the crime of murder in the first degree.
00:25:44
He pleads not guilty. [Music] April 2008, nearly 3 years after her son disappeared,
00:26:00
Deb Gallib is getting a second chance at justice. It's scary. It is scary. We've already
00:26:07
been through a hung jury once. >> With so much at stake, Mike's sister Chrissy has flown in from California.
00:26:14
>> Just sick to my stomach nervous. This final chapter for 3 years. I I'm ready for a final outcome.
00:26:21
>> But the family is concerned because this second trial is in the same county, the
00:26:27
same courthouse with the same small town jury pool. >> Stand for the jury, please.
00:26:34
>> I hope for a guilty verdict that we can get a fair trial in Stanton County. >> Under Kansas law, only the defense can
00:26:44
ask for a change of venue. And prosecutor Barry Disney knows Chad and Shannon want to keep the trial right
00:26:50
here in Johnson. >> So you're not just convicting this arbitrary defendant that tomorrow you
00:26:56
never know. You're convicting Gary's son or Mara's uh boy or Chris's, you know, cousin.
00:27:03
>> And it seems like there are so many people that live in this community they that work for the Floyds that are
00:27:10
related to them. And I mean, I just can't imagine working with these people and then having to go on the stand
00:27:17
against them. >> But when the trial finally begins here at the Stanton County Courthouse, that
00:27:22
is exactly what happens. Relatives and employees of the Floyd family are put in the uncomfortable position of testifying
00:27:31
against Shannon and Chad, adding to the tension in town. [Music] >> Would you please state your name for the
00:27:39
court, sir? Chris Floyd. >> Chad's cousin Chris the banker says Chad told him all about his plan to bribe
00:27:46
Mike Gulib to leave town. >> You were left with the impression that Michael Gulib had accepted $50,000 in
00:27:54
exchange for relinquishing parental rights. Correct. >> Yes, I was. >> But when Chris's wife, Dara,
00:27:59
>> I help you God. >> Yes, ma'am. >> ran into Mike at a school event just days before he disappeared. She says
00:28:05
Mike acted nothing like a man about to abandon his son. >> I remember um Michael telling Mikey as
00:28:15
he walked by um I love you son. [Music] If they tried to bribe Michael with $50,000,
00:28:28
Michael would have looked at that and looked at them and laughed in their face. He would not have taken a dime for
00:28:34
that child. >> There's no evidence he ever did take a dime. Bank records show Chad and Shannon
00:28:42
redeposited almost all of the money into an out of town bank. >> And these two knuckleheads, frankly,
00:28:50
that's why they're on trial because of this $50,000 and then Mike missing afterwards.
00:28:58
compounding their woes, a series of damning comments Chad made to co-workers. >> He got very angry, got in my face, and
00:29:08
said if he ever if Mike ever tried to get custody of that of little Mikey, he'd kill him.
00:29:13
>> What did he tell you? >> That it would be easy to uh make him disappear. >> And did he indicate how it would be easy
00:29:22
to do that? >> Drop him in the whale. And there was this from Chad's own cousin.
00:29:30
>> Chad said that uh if you had nothing to do with this, why kind of making things
00:29:34
difficult for the investigators? He said, "Wouldn't you cover? You wouldn't even cover for your wife." And I said,
00:29:40
"Not for murder." >> And what was his response to that? >> He said, "That's where you and I are
00:29:44
different." >> But perhaps the most telling comment of all. >> And he said, "They can't prosecute
00:29:50
without a body." Prosecutors don't have a body, but they do have Mike's DNA in the blood under
00:29:57
the deck. As to how it got there, >> man. Would you tell the jury your name? >> My name is Lisa Marie Berdett.
00:30:05
>> Defense attorneys get the state's expert, Lisa Berdett, to admit, well, she's not sure.
00:30:12
Suppose, they ask, Mike was on the deck once and happened to spit. And you'd find Michael Golib's DNA
00:30:22
because of the skin cells or blood cells in the saliva. Correct. >> Yes. >> 48 Hours investigator Joe Mura says it's
00:30:30
all about creating doubt. >> He could have been there once, sneezed, or spit on that portion. His DNA would
00:30:38
be there. >> Still, no one answers the question investigator Paul Celino poses. >> This is it. This is uh Shay Chad. Why is
00:30:47
only Mike Golov's DNA on those boards? >> Chad's been on the deck 35,000 times and
00:30:52
his DNA is not on there. Shannon and the children have been on there every day they've lived there. Their DNA is not on
00:30:58
there. What are the chances of poor Mike's DNA showing up on the deck and nobody else's?
00:31:03
>> The evidence is there. >> Now, can we turn to board two? >> Blood doesn't get someplace without
00:31:10
something something happening. It just doesn't it just doesn't go. With the forensic evidence looking so
00:31:19
bad for Chad and Shannon, the defense goes on the offense, attacking Mike Golov's character, asking his
00:31:26
stepbrother, Bo Hines. >> That was a good time there >> about Mike's supposedly heavy drug use
00:31:33
earlier. >> You told Agent Ber that you and Michael Golib had done cocaine, marijuana,
00:31:38
methampetamin, and alcohol together. Correct. >> Yes. In fact, there was a drug bust in
00:31:47
Johnson just days before Mike disappeared. The cops say he was not involved, but a key defense witness.
00:31:54
>> I appreciate you rushing in for us. Thank you. >> suggests a link. >> He says, "I did something that's going
00:32:00
to piss a lot of people off." >> Helen Bleven says Mike implied to her that he had tipped off the cops and was
00:32:08
worried about retaliation. >> He stated to me, he says, "Oh, believe me." He says, "I could disappear and
00:32:14
nobody'd ever find me." >> Made me mad because I don't know where she's getting her information, but it's
00:32:20
completely false. >> Mike's friends add Johnson is hardly home to drug kingpins out for revenge.
00:32:31
[Music] As for that big time bust, >> that is the most ridiculous thing I've ever heard. People in Johnson don't even
00:32:38
know what a real drug dealer is. They would go to the city and find one and maybe they would find out what one was.
00:32:44
That's absolutely ridiculous. >> But the defense isn't finished yet. Another theory that the disappearance is
00:32:51
somehow linked to Mike's girlfriend Brooke and a secret affair. >> So, could have been as long as two
00:32:59
months prior to May 20th, 2005 that Brooke and Mike had been arguing about who's sleeping with who. True.
00:33:07
>> Yes. But Bose says there was no reason for Mike to worry. >> We talked about it that one time. I
00:33:13
said, "Man, come on, dude." I said, "There's no way." >> If he had a suspicion that he voiced to
00:33:18
you, he only voiced this one time. >> Yeah. >> This is just garbage on from the defense
00:33:22
side. >> A drug ring, an affair, a jealous lover. Is it all preposterous, or is it
00:33:30
reasonable doubt? >> Did he confront somebody that was having an affair with Brooke? Did a fight break
00:33:37
out? Did he get hit over the head by the uh lover of Brooke? Who knows? The fact is
00:33:42
there are other possibilities. >> But this time around, Deb Gallib is confident.
00:33:47
>> We can only hope >> that a jury from Johnson can fairly weigh the evidence against a family
00:33:54
named Floyd. >> I feel a difference in the courtroom. We're hoping for a conviction.
00:34:05
[Music] It's 7:07 now and time for your hometown news. And with that, here's Eddie Ooa.
00:34:18
Good morning, Eddie. >> Well, in the news, the first-degree murder case against a couple accused of
00:34:22
killing the woman's ex-boyfriend in Southwest Kansas is expected to go to the jury today.
00:34:30
The second Golab murder trial is nearing its end. It's taken a toll on Mike's mother, Deb. You don't live your life as
00:34:38
if you're going to be put into a fishbowl. >> A fishbowl where the defense highlighted
00:34:44
every problem Mike Golib ever may have had. Consider too that if a desparing Golib returned to drugs anywhere and
00:34:55
with his fragile heart overdosed in some drug dealers's squalid drug den or shooting gallery, then other people
00:35:07
unknown to any of us had a motivation to get rid of his body and dispose of it to
00:35:14
protect their drugdeing enterprise. eyes. >> I thought they could do anything they
00:35:20
wanted to because Michael wasn't there to defend himself. >> So, you felt they're putting the victim
00:35:25
on trial? >> You bet. It was Michael's life that was on trial. It wasn't Chad and Shannon
00:35:31
that was on trial. >> Especially hurtful, she says, was defense attorney Kurt Karn's insistence
00:35:38
that since Mike's body's never been found, he may not even be dead. Maybe he's on a beach in Mexico with shades on
00:35:46
going suckers. Maybe that's the last scene of this movie. Huh? Got my revenge. I ain't
00:35:53
paying child support to nobody now. >> Prosecutor Rick Gwyn closes his case, urging jurors to ignore the rhetoric and
00:36:03
focus on the reason. There are two people in this entire world that had the motivation
00:36:12
to to kill Michael Gold that day. They wanted him out of the picture. He was an impediment to their future. Chad and
00:36:19
Shannon Floyd. Thank you. >> Ladies and gentlemen, the jury, you've now received all of the evidence. It's
00:36:27
time for you to go to the jury room and commence your deliberation. >> Good job, brother.
00:36:34
We'll win. >> The defense sounds cocky, but Deb Golib also is feeling upbeat. >> Oh, I'm I'm very optimistic with this
00:36:44
jury. Um I believe the evidence has come across better. The prosecutors were much
00:36:50
more prepared because they knew what the defense was coming in with. But after 3 hours that first day and
00:36:58
only two hours the next morning comes an all too familiar message from the jurors.
00:37:07
We have a hung jury. People of extreme adamant about their positions what to do.
00:37:15
I gave you this instruction before and >> try again. The judge says sending the panel back.
00:37:21
>> Maybe they're afraid to make a decision. Maybe they can't live with it on their
00:37:25
conscience that they've sent somebody to prison. >> Two more days of deliberations and then
00:37:43
for guilty or not guilty. >> It is over. Another hung jury. The vote split 7 to five. Unclear which way.
00:38:00
>> This is really disgusting. Unheard of. I don't understand with all the evidence that we have that they
00:38:08
can't come to a a right decision. He was my grandson and they get away with him.
00:38:19
>> You guys have any comment about it? >> Shannon and Chad Floyd simply walk out
00:38:24
of the courtroom, free to return to normal life, at least for now. >> You happy that the jury is hung, Chad?
00:38:31
Shannon. >> Neither has anything to say. The exasperated prosecutors do, however,
00:38:40
vowing they will try this case a third time. >> Two hung juries isn't going to discourage us. We'll be there until the
00:38:47
bitter end. >> An announcement that infuriates the defense. >> Apparently, the attorney general's
00:38:52
office is more interested in getting on TV than they are justice. >> But 7 months later, those same
00:39:02
prosecutors have changed their tune. There was a concern if we went a third time on the evidence that's already been
00:39:09
uncovered that it would result in a third hung jury. >> There will be no next trial for the
00:39:15
Floyds. Prosecutors announce all charges are dropped and won't be filed again unless some new evidence surfaces. They
00:39:24
will never find evidence incriminating Chad and Shannon Floyd because no such evidence exists, nor did it ever exist.
00:39:35
>> For Chad and Shannon, it's total vindication. For Deb Gallib, total defeat. The Floyds
00:39:43
are free. Her son is gone. And she has no idea where her grandson even is. As soon as they got their freedom, Chad
00:39:54
and Shannon skipped town with Mikey. Deb Gulib's pleas to Shannon to see him went
00:40:01
nowhere. >> And she just flatly refused to let me see Mikey. I don't know where Mikey is.
00:40:08
I have no clue. >> We We used to be friends. We used to be chummy. And I just I just want to ask
00:40:14
her what >> how are you doing? Why? I don't understand. But a year after the trial,
00:40:20
48 Hours investigators tracked Shannon down, living in Burlington, Colorado with Mikey and her other son. A source
00:40:29
told investigator Paul Celino that Chad is rarely seen with Shannon anymore. >> He went out and obtained a commercial
00:40:37
driver's license and has been driving a semitr. And Mike Gulib, forever California Mike
00:40:46
to his pals, is officially still missing. He was a great father. He was a great son.
00:40:57
[Music] I was very proud of my son. Do you think you'll get justice? >> Maybe not on this earth, but eventually,
00:41:09
yes. Shannon and Chad will get theirs in the end. Whether we do it or God. [Music]
